AFFIDAVIT OF INDIGENCY TO
PROCEED
IN FORMA PAUPERISSTATE OF FLORIDA
COUNTY OF BRADFORD
I, Bennie Demps, being first duly sworn, depose and state:
1. I am the petitioner in this case in which I am seeking a writ of
mandamus directed to Governor Jeb Bush and Attorney General Robert
Butterworth.
2. This affidavit is submitted in compliance with §57.081, Fla. Stat., in
support of my pending application to proceed
in forma pauperis in this action.2
3. I am currently incarcerated at the Florida State Prison under death
warrant.
4. In conjunction with my pending appeal to the Supreme Court of
Florida, Supreme Court of Florida Case No. SC00-1118, I have already been
declared indigent.
5. I have no assets from which to pay any of the necessary costs
associated with this lawsuit, including the required filing fee and service of process
fees.
6. For all of the above reasons, I am requesting the clerk of this court to
issue a certificate of indigency in this action.
