Police say Virginia is not a credible witnesses for 4 reasons:

Here's why:

  1. Because Virginia says the getaway vehicle for the gunman was in place when he ran out the building.
  2. Because police say it would be foolish for a robber to use a sawed-off shotgun for a weapon.
  3. Because if it was a robber he would not have left 1.5 bottles of Valium behind (1500 pills), stating that this drug would be like gold to a robber/user. 
  4. The safe was opened without damage or signs of damage.  Police determined the safe was not robbed.  No fingerprints were taken.

Based on all the above, police cannot resolve how or why it would be a robbery and claim it would have been impossible for the gunman to be in the building and hiding in the back.

One reason Virginia was convicted was because one juror said that the defense had not offered a reasonable alternative as to what happened that day.  No such version was offered to account for the perfect timing of the getaway vehicle, the weapon and Valium left behind.  Defense had not provide reasonable doubt.
