ЀOntheeveningofJune23,1986,Katrina_Graddy_ԀandherfriendPamwenttoNebraskaAvenueinordertobuydrugsandturntricks.Ataroundmidnight,Katrinaenteredthecarofablackmale.Pamdidnot seeKatrinaagainthatnight.IntheearlymorninghoursofJune24,1986,Katrina_Graddy_'sbodywasfoundinanabandonedhouseonScottStreet.Katrinahadbeensexuallyassaultedandherattackerhadsetthehouseonfire.  ЀInJune,1986,Rudolph_Holton_Ԁwasadrugaddictwhostoleinordertosupporthishabit.Hisrecordincludedseveralconvictionsforburglaryanddrugpossessionandhisonlyconvictionforviolence occurredwhenhefoughtwithanotherindividualoversomechangeinadicegame.WithintwentyfourhoursofthetimethepolicefoundKatrina'sbody,Rudolph_Holton_Ԁwasarrestedandchargedwith firstdegreemurderandrelatedcharges.  ЀThepolicetookastatementfromJohnny_Newsome_.HeindicatedthathehadseenMr._Holton_Ԁnearthecrimesceneonthenightofthemurder.Mr._Newsome_ԀalsosaidthathesawMr._Holton_ԀwithMs._Graddy_.Also,onthemorningthatKatrina'sbodywasfound,Carl_Schenck_,awhitemanwhotraveledtoTampawithahitchhikerhepickedupthenightbeforeinSt.Petersburg,wasasleepinhiscaracrossthe streetfromthevacanthouse.Mr._Schenck_ԀtoldthepolicethatMr._Holton_Ԁresembledtheindividualhedroppedoffinthearea;heidentifiedMr._Holton_Ԁbyhis"shavingbumps"and"frizzyhair".Thepolicealsoobtainedajailhouseinformant,_Flemnie_Ԁ_Birkins_,whoclaimedthatMr._Holton_Ԁconfessedthecrimetohiminjail.Histestimonydidnotmatchanyoftheevidencepresentedinthecase.Additionally,Mr._Birkins_testifiedthathereceivedminorconsiderationforthetestimonyheprovided.Hesaidthathehadfacedathreeandonehalftofourandonehalfyearsentenceforthecrimesforwhichhewascharged,buthewasgettingasentenceofthreeyears.Thus,thejuryheardthatthejailhouseinformantwasreceivingasixmonthbenefitforhistestimony.  񀀀_Flemnie_Ԁ_Birkins_ԀtestifiedinAprilof2001thatheliedatMr._Holton_strialinordertogetprosecutorialconsiderationinchargesthatwerethenpendingagainsthim.Mr._Birkins_ԀrevealedthatMr._Holton_Ԁneverconfessedtohim.Hemadeuphisstoryentirelyandliedabouttheconsiderationhewasreceivingforhistestimony.Hewasinfactfacingninetotwelveyearsinprisononhischarges.AtMr._Birkins_sentencingafterMr._Holton_strial,theStatehadclaimedthatthey"erred"whencalculatingthesnitch'ssentence.Inexchangeforathreeyearsentence(ultimately,theStaterequestedthatthe sentencingjudgedepartfromtherecommendedguidelinesbecauseofthejailhouseinformant'scooperationinthe_Holton_Ԁcaseandthesnitchwassentencedtofiveyearsofprobation,thefirsttwoyearstobeservedoncommunitycontrol,thefirstyeartobeservedwithspecifiedresidenceintheHillsboroughCountyJail),Mr._Birkins_ԀprovideduntruthfultestimonyagainstMr._Holton_.  񀀀Johnny_Newsome_ԀtestifiedinAprilof2001thatheliedatMr._Holton_strial.Hesaidhewasafraidthatifhedidntpointthefingeratsomeoneelsethepolicemaytrytolaytheblameonhim.  񀀀Carl_Schenck_ԀtestifiedinAprilof2001thataphotographoftheindividualknownas Pinemorecloselyresembledthehitchhikerhepickedupanddroppedoffinfrontofthesceneofthemurder.  񀀀Attrial,theStatehadpresentedphysicalevidencewhichpurportedlylinkedMr._Holton_Ԁtothecrimescene.TheexistenceofacigarettepackwithMr._Holton_'sfingerprintonitcameasnosurprise -6)2 duetothefactthatMr._Holton_,likemanyotherindividualsenteredthevacanthouseinordertousedrugs.  ЀFinally,theStatepresentedanFBIagenttotestifythatthreehairswhichwerefoundonthevictim'smouthcouldhavebeenMr._Holton_'sbodyhairandthatMr._Holton_Ԁcouldnotbeexcludedfrombeingthe sourceofthehairs.Theprosecutor,Joe_Episcopo_,arguedinhisclosingthatthehaircouldnothavebeenfromthevictim.  ЀThehairevidencewhichtheStatearguedlinkedMr._Holton_ԀtothecrimehasbeenanalyzedusingmitochondrialDNAandexcludesMr._Holton_Ԁasthedepositorofthehair.TheDNAmatchedthevictim.  ЀAttrial,Mr._Holton_Ԁpresentedanalibi._Solodon_Ԁ_Clemmons_ԀtestifiedthatonthenightofJune23,1986,Mr._Holton_Ԁarrivedathisroominghousearound10:00p.m.andwenttobed.Mr._Clemmons_Ԁtoldthejury thatMr._Holton_Ԁdidnotleaveduringthenightandwasinbedat6:00a.m.thenextmorning.  ЀAlso,Mr._Holton_'strialattorneywantedtopresentthetestimonyofthevictim'sfriend,Pam.EventhoughPamwasproperlysubpoenaedtotestify,shefailedtoappearatthetrial.Mr._Holton_'strialattorneyrequestedacontinuancesothatshecouldsecurePam'spresence,butthetrialjudgedeniedtherequest.ThejudgeallowedthejurytohearpartofPam'sdepositionbutonlythepartabout Katrina'sdepartingwithaman,whowasnotMr._Holton_,andneverreturning.Pamalsohadknowledgeandtestifiedinherdepositionaboutarapethatoccurredinthevacanthouseaboutaweekbeforethe murder.Katrinaidentified"Pine,"adrugdealerfromtheneighborhood,astherapist.  ЀInAprilof2001,Mr._Holton_ԀpresentedapolicereportthatwasnotdisclosedtohimuntilMarchof2001.ThisreportreflectedaKatrinaGrantwithKatrina_Graddy_s_birthdate_,livingatKatrina_Graddy_s addresshadinfactreportedthatshehadbeenrapedbyanindividualsheknewas PineonJune13,1986.Thepolicedeterminedwho Pinewasandarrestedhim.Hegaveafalsename,DonaldSmith.HisrealnamewasDavidPierson.Twocomplaintswerefilledoutbythepolice;oneforrapeandoneforobstructionbygivingafalsename.However,Katrinadecidedtonotprosecuteandthechargesweredropped.  ЀInAprilof2001,DonaldSmithtestifiedthatabouttendaysbeforeherdeath,Katrina_Graddy_Ԁcametohimandtoldhimthat Pinehadgivenhisnametothepolicewhenhewasarrestedforrapingher. Theywenttoconfront Pinetogether.Anastyargumentoccurredand PinemadethreatstowardKatrina.Thedayofthehomicide,Mr.Smithnoticedthehousewherethebodywasfoundwasonfire.Asheheadedinthatdirection,hesaw PinewhotoldhimsomeonehadstrangledKatrina.WhenMr.Smithgottothehouse,heaskedthepolicewhohadstrangledKatrina.Hewasimmediatelyquestionedabout thisbecausenooneatthetimeshouldhaveknownthattherewasawomanstrangledinsidetheburninghouse.Mr.Smithdidnotdisclosethebasisforhisknowledge,althoughhisnameandaddressweretaken forfollowup.Anundisclosedpolicereportconfirmsthisoccurrence.  ЀMr.Smithtestifiedin2001thatseveralmonthslaterhehadaconversationwith*Pine*whoconfessedthathehadkilledKatrina.
