Laterthatmorning,thepolicespokewithCarrieNelson,a z womanwholivedbehindtheabandonedhouse.Shetoldthepolice &v thatsheandWillieDanSimmonssatonherporchtheevening " beforethefireandshesawRudolphHoltonenterthehouseat ~ ! approximately11:00p.m.(R.592).AccordingtoNelson,Mr. *"z# Holtonworeawhiteteeshirtwithredwritingonit" #  2      ׀(R.597). #&% NelsondidnotseeMr.Holtonleave,butshewentintoherhouse  aroundmidnight(R.594). \   Thatsameday,thepoliceinterviewedJohnnyNewsome.The X policeapproachedNewsomeandrequestedthathespeaktothemat   thepolicestation(R.358,464).ThepoliceinformedNewsome `  thattheywerelookingforRudolphHolton(R.464).Newsome  \  placedMr.Holton,carryingablackshavingbag,withMs.Graddy   attheabandonedhouse(R.350).Newsometestifiedattrialthat d  onJune22nd,at11:00p.m.,hesawMr.HoltonandMs.Graddyon `  thesideoftheabandonedhouse,talking(R.351).However,   Newsomestestimonyaboutthetimewasinconsistentwiththe h statementheprovidedtothepolice.Inhisstatement,Newsome d toldthepolicethathesawMr.Holton justafterdarkorat   dusk(R.465).NewsomealsotoldthepolicethathesawMr. l HoltononthemorningMs.GraddysbodywasfoundandMr.Holton h wasinpossessionoftheblackshavingbag(R.466). "$   OnJuly25,1986,defensecounsel,MinaMorgan,fileda t$& MotionforPoliceReportsinwhichsherequested anypolice  &p!( reports(R.799).Trialcounselrenewedthisrequestthe '#* weekendbeforetrial(R.847). x)$,   Duringthedefensesinvestigation,counsellearnedfromthe  victimsfamilyandfriendsthatMs.Graddyhadreportedthatshe \ wasrapedapproximatelyaweekbeforehermurderbyamanwho X usedthestreetnameof Pine.Inherfirstmotionfor   continuance,trialcounselinformedthecourtthatshewas `  investigatingtheinformationaboutPinesrapeofKatrinaGraddy  \  (R.8179).Thecourtdenieddefensecounselsmotion.Further,   onOctober29,1986,trialcounselrequestedadditionalfundsfor d  herprivateinvestigator.Amongthereasonswhycounselneeded `  additionalfundswasthatshebelievedshehadascertainedthe   trueidentityofPineandwasinvestigatingtherapefurther(R. h 8236).Thecourtauthorizedadditionalfundsforthedefense d investigator(R.828).    OnDecember1,1986,justfivemonthsafterMs.Graddys l murderandMr.Holtonwasindicted,Mr.Holtonscapitaltrial h began.    Attrial,theStatepresentedthetestimonyofNelsonand p  Newsome(R.5927,34768,591).InadditiontoNelsonand !l" NewsomeplacingMr.Holtonattheabandonedhouse,theState "$ elicitedtestimonyfromCarlSchenckthatMr.Holtonresembled t$& thepersonhedroppedoffacrossthestreetfromtheabandoned  &p!( house(R.328).OntheafternoonofJune22nd,Schenckpickedup '#* ahitchhiker(R.325).Hedescribedthehitchhikeras, Ablack x)$, malewithprettyfrizzyhair,agoodamountofit,wearinga $+t&. whitetshirtwithletteringonit,aballcapwithsomething  embroideredonit...anddarkbluepantsandablackshaving \ bag.? #  3      ׀(R.326).Schenckcandidlytestifiedthatwhenshownthe X photoarrayhecouldnotmakeapositiveidentificationofMr.   HoltonandthatMr.Holtonsphotoonly resembled[the `  hitchhiker]bytheshavingbumpsandhair.(R.344).  \    SchenckdrovethehitchhikertoTampaandspentseveral   hourswithhimsmokingmarijuana,drinkingandgoingtobars(R. d  331).Around10:00or11:00p.m.,thehitchhikerleftSchenckon `  ScottStreet,neartheabandonedhouse(R.332).Schenckpassed   outinhiscarandawokethenextmorningtothesoundoffire h engines(R.333).Thepoliceobtainedthehitchhikersblack d shavingbagfromSchenckscar,whereithadbeenleftbythe  hitchhikerthepreviousnight(R.333). l   Themedicalexaminertestifiedthatthecauseofdeathwas h strangulation(R.268).Further,Dr.Lardizbaltestifiedat  trialthatthefireoccurredpostmortem(R.270),andhenoted p  thattheonlyharmtothevictim,otherthanthestrangulation !l" wasthatabrokenbottlewaspartiallyinsertedintothevictims "$ anus(R.266). t$&   TheStatealsoinquiredaboutthephotographsofthemarks  &p!( onMr.Holtonschest.Dr.Lardizbaltestifiedthatthemarks '#* appearinginthephotographswereconsistentwithscratches  causedbyahand(R.278).Dr.Lardizbalopinedthatthemarks \ wereconsistentwithhealingabrasionsthatwerebetweentwenty X fourandthirtysixhoursoldatthetimeofthephotographs(R.   285). `    TheStateskeywitnessintheprosecutionofMr.Holtonwas  \  FlemmieBirkins,ajailhousesnitch. #  4      ׀Birkinstestifiedthathe   wasincarceratedwithMr.HoltononJune26,1986.Birkins d  statedthatonJune26th,Mr.Holtonandhespoketwice.During `  thefirstconversationMr.HoltonaskedBirkinsforacigarette   andtoldBirkinsthathewaschargedwithmurder(R.288). h Shortlythereafter,around5:00p.m.,Mr.HoltonmetBirkinsin d theclinicandtoldBirkinsthat: hehadkilledagirl,thathe  hadstrangledher.(R.295,289).Mr.HoltonthentoldMr. l Birkinsthatafterhekilledthevictim,hewenttotheStar h ServiceStationonNebraskatogetacanofgasandhesetthe  houseonfire(R.289). p    Birkinsadamantlydeniedthathewantedorwasreceivingany !l" benefitforhistestimony(R.290,301).Heinitiallytoldthe "$ jurythatthethreeyearsentencehewasreceivingwasbasedon t$&  thesentencingguidelinesandaccountedforhispriorcriminal  &p!( history #  5      ׀(R.308).However,Birkinsalsotestifiedthathe pled   openwhichmeantthatherejectedtheStatespleaofferof \ threeyearsandwouldallowthejudgetodecideonhissentence X (R.293).Birkinstoldthejurythathecameforwardbecause    itsnotrightforanyonetokillayounggirl(R.297). `    Inregardtophysicalevidence,theStatepresentedthe  \  testimonyofJohnQuill,aspecialagentwiththeFederalBureau   ofInvestigation.AgentQuilltestifiedaboutthethreehairs d  collectedfromthevictimsmouth.AgentQuillconducted `  microscopicanalysisonthehairsanddeterminedthatthehairs   exhibited, Negroidcharacteristics(R.316),andoneofthe h hairswasa transitionalbodyhair,i.e.ahairfromthenape d ofthenecktotheheadorfromthelowerabdomentothepubic  area(R.322).AgentQuilltoldthejury,thatbaseduponthe l characteristicsofthehairshecouldnotexcludeMr.Holtonas h beingthesourceofthehair(R.317).    DetectiveKevinDurkintestifiedattrialthathewasthe p  leaddetectiveintheinvestigationofKatrinaGraddysmurder !l" (R.371).Det.DurkintestifiedthatMr.Holtoninitiallymadea "$ statementthathehadpreviouslybeenintheabandonedhouseto t$& usedrugs,butthathehadnotbeeninthefrontroomofthe  &p!( house #  6      ׀(R.375).OnJune26th,Det.Durkinreturnedtothe  abandonedhouse,whichhadnotbeensecured,andlocatedanempty \ Koolcigarettepackandasyringeinthefrontroomofthehouse X (R.379).Mr.HoltonhadalreadytoldDet.Durkinthatheused   thesyringeafewweeksbeforethecrimeandleftitona `  windowsillinthehouse.UponquestioningMr.Holtononthe  \  26th,Mr.HoltontoldDet.DurkinthathesawNewsomenearthe   housethedayofthecrime,butitwasintheafternoonandMr. d  Holtondidnotenterthehouse(R.382,388).Mr.Holtondenied `  thatheleftthecigarettepackinthehouseonthedayofthe   crimeandsaidthatthelasttimehewasinthefrontroomofthe h housewasafewdaysbeforethecrime(R.382383).Alatent d fingerprintonthecigarettepackwasidentifiedasMr.Holtons  right,middlefingerprint(R.405). l   Mr.Holtonvoluntarilyprovidedhair,bloodandfingernail h scrapings.Nootherphysicalevidence,includingitemsfoundat  thecrimesceneorintheblackshavingbagwereconnectedtoMr. p  Holton. !l"   Inhisdefense,Mr.Holtonpresentedanalibi.Consistent "$ withMr.Holtonsinitialstatementtothedetectives,Solodon t$&  RedClemmonstestifiedthathelivedinahouseCharlotte  &p!( Street(R.388,491).OnthenightofJune22nd,Mr.Holton '#* stayedatMr.Clemmonshouse,likehehadfortheprecedingweek  orso(R.494).Mr.ClemmonsrecalledthenightbecauseMs. \ Graddysbodywasfoundthenextmorninganditcausedascenein X theneighborhood(R.496).Mr.ClemmonstestifiedthatMr.   Holtonarrivedatthehousebetween9:00and10:00p.m.andwent `  tosleep(R.495).HesawMr.Holtonsleepingat6:00a.m.when  \  heawoketotakehismedicine(R.497).     Mr.ClemmonsbelievedthatMr.Holtondidnotleavethe d  houseduringthenightbecause:1)hedidnothearanynoise;2) `  hisdoghadyoungpuppiesatthetimeandwouldbarkifanyone   movedaroundthehouseandtherewasnobarkingthatnight;3)he h didntsleepmuchatnightandwasnotaheavysleeperwhenhe d did;and4)hisdoorwaslockedwhenheawoke;thedoorlocked  automaticallyafteropeningitsoitwasnecessarytohaveakey l toreenterthehouse.Mr.Holtondidnothaveakeytothedoor h (R.4979).
