ąSwafford€and€four€companions€drove€from€Nashville,ĻTennessee,€to€Daytona€Beach,€Florida,€departing€NashvilleĻat€about€midnight€on€Friday,€February€12€and€arriving€inĻDaytona€Beach€at€about€noon€the€next€day.€€After€settingĻup€camp€in€a€state€park,€Swafford€and€some€others€wentĻout€for€the€evening,€arriving€back€at€the€campground€atĻabout€midnight.€€Then,€according€to€the€testimony€atĻtrial,€Swafford€took€the€car€and€went€out€again,€not€toĻreturn€until€early€Sunday€morning.Š Š Š  ŠĢą8  ąState's€witness€Patricia€œAtwell›,€a€dancer€at€a€bar€calledĻthe€Shingle€Shack,€testified€that€Swafford€was€there€withĻhis€friends€on€Saturday€night,€that€they€left€at€aroundĻmidnight,€and€that€Swafford€returned€alone€at€about€1:00Ļa.m.€Sunday.€€When€œAtwell›€finished€working€at€3:00€a.m.,Ļshe€left€the€Shingle€Shack€with€Swafford.€€They€spent€theĻrest€of€the€night€together€at€the€home€of€Swafford'sĻfriend.€€At€about€6:00€a.m.,€he€returned€her€to€theĻShingle€Shack€and€left,€driving€north€on€U.S.€1,€a€courseĻthat€would€have€taken€him€by€the€œFINA›€station.€€In€theĻlight€traffic€conditions€of€early€Sunday€morning,€theϜFINA›€station€was€about€four€minutes€away€from€the€ShingleĻShack.€€According€to€Swafford's€traveling€companions,€heĻreturned€to€the€campsite€around€daybreak.€€The€court€tookĻjudicial€notice€of€the€fact€that€sunrise€took€place€onĻthe€date€in€question€at€7:04€a.m.Š Š Š  ŠĢą8  ąOn€Sunday€Swafford€and€his€friends€attended€an€auto€raceĻin€Daytona€Beach.€€That€evening€they€went€back€to€theĻShingle€Shack,€where€one€of€the€party€got€into€a€disputeĻwith€some€other€people€over€money€he€had€paid€in€theĻexpectation€of€receiving€some€drugs.€€Swafford€displayedĻa€gun€and€got€the€money€back.€€The€police€were€called,Ļand€Swafford€deposited€the€gun€in€a€trash€can€in€one€ofĻthe€restrooms.€€The€police€seized€the€gun,€and€ballisticsĻtests€performed€later€conclusively€established€thatŠ ś+J'/ ŠSwafford's€gun€was€the€gun€used€to€kill€the€victim.€€TheĻevidence€also€showed€that€Swafford€œhad€had›€the€gun€forĻsome€time.€€Although€the€gun€was€not€tested€until€moreĻthan€a€year€after€the€murder,€after€authorities€receivedĻa€tip€concerning€Swafford's€possible€involvement,Ļevidence€established€the€chain€of€police€custody€and€theĻidentification€of€the€gun.Š Šą  ąSwafford's€first€witness€was€Walter€Levi.€œ(T›€24).€€On€Sunday,ĻFebruary€14,€1982,€the€day€of€the€Daytona€500,€he€was€in€a€motelĻroom€in€Daytona€Beach€with€James€Walsh.€€œ(T›€24„25).€€Mr.€Walsh€leftĻwith€Michael€œLestz›€at€"5:00,€5:30,€6:00€maybe."œ×ƒWׯ ƒ #ĆŻņņŚ  Ś3Ś  ŚóóŻ  Ż×  כ€œ(T›€25).€€The€menŠ šź  Š"showed€up€between€twelve€and€one€o'clock"€that€afternoon.€€œ(T›€50„¼51).€Ģą  ąMr.€Levi€met€Mr.€œLestz›,€€"an€acquaintance€of€Mr.€Walsh's,"€inĻDaytona€Beach€approximately€a€"[œw]eek›€or€two"€before€February€14,Ļ1982.€œ(T›€38).€€Mr.€œLestz›€never€stayed€with€Mr.€Levi€and€Mr.€Walsh,Ļalthough€Mr.€Levi€saw€him€most€every€day€during€the€two€weekĻperiod.€€œ(T›€39).€€During€that€period,€Mr.€Walsh€dropped€Mr.€LeviĻand€Mr.€œLestz›€off€at€a€œlaundromat›€"four,€five,€six.€€I€don'tĻremember"€times€and€told€them€he€was€going€to€buy€dope.€€œ(T›€40).€ĻMr.€Walsh€showed€the€men€the€dope,€"a€narcotic,"€upon€his€return.€Ļœ(T›€40).€€"[œN]umerous›€times,"€Mr.€Levi€saw€Mr.€Walsh€"mixed€it€up€onĻthe€spoon€and€shot€it€in€his€arm."€œ(T›€41).Ģą  ąœMr.€Levi€was€in€"Loxahatchee›€Prison"€when€he€gave€the€AugustĻ25,€1982€statement€to€the€police.€€œ(T›€52).€€Right€after€beingŠ 'R") Šreleased€from€the€prison€where€he€was€when€he€gave€his€August€25,Ļ1982€statement€to€Detective€œBuscher›,€Mr.€Levi€"moved€back€toĻIllinois"€to€the€address€he€had€been€living€at€prior€toĻincarceration.€œ(T›€37).€ą h ą€œMr.€Levi€"moved€to€Michigan€in€the€latterŠ “  Špart€of€'90,€first€part€of€'91."€(T€53).€€He€lived€at€the€sameĻaddress€in€Michigan€until€November,€1996.€(T€53„54).Ģą  ą›€Mr.€Levi€was€contacted€by€œcollateral›€œcounselššs€investigator›ĻMichael€œChavis›€in€1994.€€œ(T›€36„37).€€Mr.€œChavis›€obtained€hisĻaddress€by€contacting€Mr.€Levi's€mother€in€Illinois.€€œ(T›€54).€€HisĻmother€had€lived€at€the€same€address€in€Illinois€from€approximatelyĻDecember,€1990€to€the€present€(February€6,€1997).€€œ(T›€55).€€She€hadĻbeen€at€that€address€from€at€least€mid€1991.€€œ(T›€55).Ģą  ąMr.€Levi€said€that€he€had€a€driver's€license€and€œhad€had›Ļ"[œt]his›€particular€one€five,€six€years."€œ(T›€51).€€He€added€that€heϜhad€had›€a€driver's€license€"[œm]ost›€of€my€life.€€Since€I€turnedĻage."€œ(T›€51).€€Mr.€Levi€œhad€had›€licenses€in€five€states,€and€at€theĻtime€of€the€murder,€he€most€likely€had€a€Florida€license,€althoughĻhe€"could€have€had€an€Illinois€license."€€œ(T›€51„52).€€Mr.€Levi€hadĻa€Florida€license€when€he€was€living€in€Florida€and€a€MichiganĻlicense€when€he€was€living€in€Michigan.€€œ(T›€œ52).€€He€also€had€aĻprison€ID€number€and€had€been€in€prisons€in€Florida€and€Illinois.€Ļ(T€53).›Ģą  ąMr.€Levi€knew€Mr.€Walsh's€wife's€residence.€€œ(T›€61).€€He€"knewĻhow€to€get€a€hold€of€his€wife."€œ(T›€61).€€At€some€point,€Mr.€WalshŠ $+t&. Šwas€in€the€process€of€getting€a€divorce.€€œ(T›€61).Ģą  ąSwafford's€next€witness€was€Michael€œLestz›.€œ(T›€63).€€ForĻš š[œa]bout›€three€monthsšš€prior€to€February€14,€1982,€he€lived€in€theĻDaytona€Beach€area,€Orlando,€or€œOcala›.€€œ(T›€88).€€Mr.€œLestz›Ļmaintained€an€address€at€12€South€Oak€Street,€Du€Quoin,€Illinois,Ļwhich€he€had€š šoff€and€on€for€like€five€or€six€years.šš€€œ(T›€96,€97).€ĻThat€address€was€listed€on€his€Illinois€driverššs€license,€and€itĻwas€his€correct€address€prior€to€his€incarceration€in€the€federalĻprison€in€September,€1982.€œ(T›€69,€89,€90,€95„96).€€He€was€releasedĻtherefrom€on€December€3,€1984,€placed€in€his€brotherššs€š šcare,ššœ×ƒ[ׯ ƒ #ĆŻņņŚ  Ś4Ś  ŚóóŻ  Ż×  כ€andŠ ¼  Šš šremanded€to€the€Seventh€District€of€Illinois€ProbationĻDepartment.šš€€œ(T›€79,€90,€91).€€The€federal€prison€authorities€š šknewĻwhere€I€was€at.šš€€œ(T›€91„92).€€Ģą  ąMr.€œLestz›€lived€in€a€trailer€š šon€Route€51€in€œElkville›,ššĻIllinois,€a€small€town€of€š šabout€a€hundred€and€four€peoplešš€inĻ1990.œ×ƒ]”ׯ ƒ #ĆŻņņŚ  Ś5Ś  ŚóóŻ  Ż×  כ€œ(T›€78,€92).€€This€residence€was€š š[œs]even›€milesšš€from€the€OakŠ Ä ŠStreet€address.€€œ(T›€101).€€œHe›€lived€at€that€address€until€š šroughlyĻJune€or€July€of€1985.šš€€œ(T›€93).€€Thereafter,€he€moved€to€a€homeĻš š[œa]bout›€threešš€miles€away,€located€at€š šRural€Route€1,Š Č"$ МHallidayboro›,€Illinois,šš€which€was€a€š šsmall€townšš€š š[œj]ust›€on€theĻoutskirts€ofšš€œElkville›.œ×ƒ^ׯ ƒ #ĆŻņņŚ  Ś6Ś  ŚóóŻ  Ż×  כ€€œ(T€93).›€€He€lived€there€with€his€wife€andŠ \¬ Šdaughter€continuously€š šuntil€today€.€.€..šš€€œ(T›€93,€105).€Ģą  ąMr.€œLestz›ššs€federal€probation€officer,€Bruce€Chambers,€was€š šinĻBenton,€which€is€a€town€close€by,šš€and€he€knew€where€œMr.€Lestz›Ļlived.€€œ(T›€92).€€œMr.€Lestz›€reported€to€Mr.€Chambers€š ševery€week.šš€Ļœ(T›€92).€€Indeed,€after€his€probation€ended,€Mr.€œLestz›€continued€toĻhave€contact€with€Mr.€Chambers.€€œ(T›€124).Ģą  ąAfter€he€was€released€from€federal€prison,€Mr.€œLestz›€had€someĻmotor€vehicles€titled€in€his€name.€€œ(T›€100).€€Some€of€those€titlesĻbore€his€correct€address.€€œ(T›€100).€Ģą  ąMr.€œLestz›€owns€and€operates€a€š š[œp]est›€controlšš€business€andĻhas€done€so€š š[œs]ince›€the€time€I€got€out€of€prison€last,šš€i.e.,ĻDecember€3,€1984.€œ(T›€102).€€Mr.€Chambers€likely€knew€that€he€ranĻthat€business€as€the€two€men€had€contact€š š[œs]everal›€timesšš€in€theĻyears€after€œLestz›€successfully€completed€his€parole.€€œ(T›€124,€125).Ģą  ąSwafford€introduced€the€œVolusia›€County€Sheriffššs€OfficeĻ[hereinafter€š šœVCSO›šš]€reports€into€evidence.€€Included€thereon€is:€ĢņņJuly€26,€1982€œVCSO›€Reportóó:Š Č"$ ŠÓÓą8  ąą8` Š Š ąœLESTZ›€gave€an€address€of€#12€South€Oak€StreetĻin€œDuquoin›,€Illinois,€Zip€Code€is€62832.€ĻœLESTZ›€indicated€that€he€could€be€reached€atĻtelephone€number€Area€Code€618„542„4804.Š ` x` x ŠĢDefendantššs€Exhibit€œ6›€at€1.Š ¢(ņ#+ ЇņņJanuary€31,€1983€œVCSO›€Reportóó:Š ° ŠĢą8  ąą8` Š Š ąIt€was€learned€by€œInv›.€€œBuscher›€that€œLESTZ›€wasĻat€that€time€incarcerated€in€the€FEDERALĻPRISON€CAMP,€U.S.€Penitentiary,€Marion,ĻIllinois,€under€inmate€number€02997„010,Ļtelephone:€618/964„1441,€Ext.€€229.Š ` x` x ŠĢÓÓDefendantššs€Exhibit€œ5›€at€3.Ģą  ąAccording€to€Mr.€œLestz›,€on€the€morning€of€February€14,€1982,ĻJames€Walsh€"dropped€me€off€of€(sic)€a€œlaundromat›€and€came€backĻabout€five€hours€later€to€pick€me€up."€œ(T›€63).€€It€was€"[œa]bout›Ļ6:00€in€the€morning."€œ(T›€64).€€Mr.€Walsh,€a€drug€addict,€told€Mr.ϜLestz›€he€was€being€dropped€off€because€"he€needed€the€vehicle€to€goĻpurchase€some€drugs€and€I€wasn't€allowed€to€be€there."€œ(T›€64,€65).€ĻHe€did€not€recall€a€œFina›€station€in€the€vicinity.€€œ(T›€65).Ģą  ąMr.€Walsh€returned€"around€10:30,€eleven€o'clock."€œ(T›€65).€€He€Ļseemed€"[œp]retty›€nervous,€sweaty.€€He€was€real€hyper.€€I€thought€itĻwas€œsomething€to›€do€with€the€drugs."€œ(T›€65).Ģą  ąLater,€œ"[t]hat›€evening€he€wanted€me€to€take€him€to€someĻdifferent€bars€and€see€if€he€could€sell€the€guns."€œ(T›€65).€€œMr.ĻLestz›€recalled€the€name€of€only€one€bar,€"the€Shark€Lounge."€œ(T›Ļ65).€€Defense€Counsel€œMcClain›€then€suggested€"the€Shingle€Shack,"Ϝ(T›€65),€and€when€the€State's€objection€was€sustained,€counselĻoffered€"an€affidavit€of€Michael€Eugene€Lestz"€which€he€showed€toĻMr.€Lestz.€€œ(T›€68).€€He€asked€his€witness€whether€that€documentĻrefreshed€his€recollection€of€the€Shingle€Shack€as€one€of€the€barsĻhe€took€Mr.€Walsh€to€on€the€night€of€the€œ14th›.€€œ(T›€68).€€Mr.€LestzŠ $+t&. Šresponded:€€"No."€œ(T›€68).€€Mr.€Lestz€said€that€he€"dropped€him€offĻon€the€strip€known€as€Atlantic€Avenue€in€Daytona.€€He€seemed€atĻthat€point€to€be€relieved€.€.€.."€œ(T›€68).€€He€did€not€know€whetherĻMr.€Walsh€still€had€the€guns€at€the€end€of€the€evening.€€œ(T›€68).€ĻHe€did€not€see€him€dispose€of€any€guns,€and€he€did€not€know€whetherĻhe€had€disposed€of€any€guns.€€œ(T›€120).€€Further,€even€assuming€thatĻhe€had€disposed€of€guns,€Mr.€Lestz€did€not€know€where€he€hadĻdisposed€of€them.€€œ(T›€120).Ģą  ąMr.€Lestz€recalled€having€been€interviewed€by€law€enforcementĻofficers€twice€regarding€the€events€of€February€14,€1982.€€œ(T›€69).€ĻHe€said€that€he€did€not€tell€them€the€truth.€€œ(T›€70).Ģą  ąMr.€Lestz€said€that€Mr.€Walsh€"was€arrested€for€assaultingĻme."€œ(T›€72).€€He€claimed€that€Mr.€Walsh€"pointed€a€pistol€at€me"Ļand€eventually€"slapped€me€in€the€middle€of€the€forehead€with€thatĻpistol."€œ(T›€72).€€He€added€that€Mr.€Walsh€"burned€me€several€timesĻon€the€arm€with€a€cigarette,"€and€threatened€to€kill€him€byĻshooting€him€in€the€head€with€the€gun.€€œ(T›€72).Ģą  ąMr.€Lestz€testified€that€the€affidavit€he€signed€was€preparedĻby€œCCR›.€€œ(T›€107).€€It€was€ņ ņnotó ó€admitted€into€evidence.€€œ(T›€136).Š Č"$ Šą  ąSheriff's€Investigator,€Bernard€E.€œBuscher›€testified.€€HeĻconcluded€his€investigation€without€an€arrest€of€Mr.€Walsh€becauseĻ"[œt]here›€was€no€evidence€to€support€it."€œ(T›€154).Ģą  ąSwafford's€next€witness€was€veteran€Public€Defender€HowardĻPearl€who€worked€with€Ray€Cass€on€Swafford's€case€throughout€theŠ @+&. Šdiscovery€process.€€œ(T›€171„172).€€He€and€Mr.€Cass€"took€it€uponĻourselves€to€go€to€the€city€of€Ormond€œBeach›€Police€Department€andĻask€them€if€they€had€any€additional€files€or€evidence.€€And€theyĻturned€over€to€us€a€rather€large€package€of€work€that€they€hadĻdone."€€œ(T›€173).€€He€acknowledged€that€he€and€Mr.€Cass€could€haveĻdone€the€same€thing€with€the€œVolusia›€County€Sheriff's€Office.€€œ(T›Ļ207).€€Mr.€Pearl€added€that€Prosecutor€White€was€an€"honest€man"Ļand€upon€request,€"[œw]hatever›€he€had€he€would€turn€over."œ×ƒׯ ƒ #ĆŻņņŚ  Ś7Ś  ŚóóŻ  Ż×  כ€œ(T›€207).Š d“  Šą  ąMr.€Pearl€talked€to€œWitness›€œSeiler›€at€length.€€œ(T›€180).€€Mr.̜Seiler›€indicated€that€the€man€he€saw€at€the€œFina›€station€wasĻbearded,€and€"I€knew€that€Mr.€Swafford€was€not€bearded,€okay,€so€IĻknew€there€was€a€possibility€of€another€suspect."œ×ƒo<ׯ ƒ #ĆŻņņŚ  Ś8Ś  ŚóóŻ  Ż×  כ€€œ(T›€180).Š d Šą  ąMr.€Pearl€said€that€he€"had€heard€during€the€.€.€.€pretrialĻdiscovery€.€.€.€that€Mr.€Harper€was€asking€for€compensation€as€wellĻas€some€slack€because€he€wanted€to€get€out€of€prison."€€œ(T›€184).€ĻHe€claimed€not€to€have€known€"about€Mr.€Tanner€and€hisĻinvolvement."€œ(T›€185).€€However,€he€knew€that€Prosecutor€White€wasĻattempting€to€help€Mr.€Harper€with€his€prison€situation€because€heĻbelieved€Mr.€Harper€to€be€"an€important€witness€against€Mr.ĻSwafford."€œ(T›€192).€€At€the€hearing,€Mr.€Pearl€testified:€"IŠ t$Ä& Šremember€Gene€White€certainly€dealing€with€it.€€I€remember€that€Mr.ĻHarper€was€certainly€in€the€case€as€an€informant€or€witness€for€theĻState,"€and€"he€was€looking€for€some€monetary€compensation€inĻreturn€for€his€services."€œ(T›€192,€193).€€Mr.€Pearl€acknowledgedĻthat€he€"could€have€asked€him€[Mr.€Harper}€anything,"€includingĻabout€his€motivations€for€testifying€against€Swafford,€during€theĻdeposition€which€he€took€from€Mr.€Harper.€€œ(T›€196„197).Ģą  ąMr.€Pearl€œdisclosed›€that€the€defense€trial€theory€was€thatĻSwafford€was€"not€guilty."€œ(T›€187).€This€strategy€was€based,€inĻpart,€on€€witnesses€at€the€Shingle€œShack;€one›€allegedly€claimedĻthat€œshe›€saw€"someone€fleeing€the€police€had€run€into€the€women'sĻrestroom"€and€another€œsaid›€"a€person€trying€to€flee€the€police€ranĻinto€the€men's€œrestroom."€(T€201„202).€€Mr€Pearl€added:›€€œ"And›€fromĻthat€I€probably€„„€.€.€.€believe€more€than€I€should."׃ׯ ƒ #ĆŻņņŚ  Ś9Ś  ŚóóŻ  Ż×  ׀œ€ņņId.ó󛀩 l¼ Šą  ąOn€recross,€Mr.€Pearl€testified€that€the€defense€"accepted€.Ļ.€.€as€true"€that€Swafford€was€in€the€Shingle€Shack€on€the€night€ofĻFebruary€14,€1982.€€œ(T›€216).€€œHe›€conceded€that€given€that€SwaffordĻwas€there,€the€fact€that€the€gun€belonging€to€Swafford€was€found€inĻone€trash€can€versus€another€was€significant€only€"because€there'sĻa€basket€that€hadn't€been€looked€at."€€œ(T›€216).€€Ģą  ąRegarding€locating€Mr.€Lestz,€Mr.€Pearl€testified€that€if€heĻhad€known€that€Mr.€Lestz€had€been€in€a€federal€prison€in€Illinois,Š Ų'(#* Šhe€"would€have€inquired€of€the€federal€correctional€people,€[and]Ļthe€Department€of€Justice,€to€determine€his€present€whereabouts"Ļand€learn€"his€background."€œ(T›€220).€€Given€that€the€police€reportĻcontained€an€address€for€the€prison€Lestz€was€in,€and€the€prisonĻauthorities€had€an€address€where€Lestz€had€gone€upon€release,€andĻthat€while€on€probation,€Mr.€Lestz€had€moved€only€three€miles€fromĻthat€address,€Mr.€Pearl€opined€that€it€would€not€have€beenĻdifficult€to€locate€Mr.€Lestz.€œ(T›€223„226).Ģą  ąMoreover,€since€Mr.€Lestz€had€been€released€from€federalĻprison€into€the€custody€of€his€brother,€he€certainly€would€haveĻattempted€to€contact€the€brother.€œ(T›€226).€€Mr.€œMcClain›€asked:€"IfĻthe€brother€had€been€instructed€by€Mr.€Lestz€not€to€tell€anybodyĻwhere€he€was€„„"€Mr.€Pearl€interjected:€"I€would€have€choked€himĻuntil€he€told€me."€œ(T›€227).€€€Mr.€œMcClain›€pressed:€"What€if€Mr.ĻLestz€was€deliberately€hiding€because€he€was€afraid€.€.€.€and€hadĻinstructed€his€family€and€friends€in€that€regard?"€œ(T›€227).€€Mr.ĻPearl€responded:€"Mr.€œMcClain›,€all€I€can€tell€you€is,€somebodyĻwould€have€found€him.€€Somebody€did€find€him.€.€.€.€€So€he€wasĻfindable."€œ(T›€227).€€He€added:€"[I]€found€a€man€who€was€hiding€andĻI€found€him€by€mail."€œ(T›€228).€€Mr.€Pearl€also€said€that€if€"aĻprofessional€outfit"€was€hired€to€find€Mr.€Lestz,€it€should€be€oneĻ"up€there"€near€the€address€to€which€Mr.€Lestz€had€moved€afterĻleaving€federal€prison.€€œ(T›€229).Ģą  ąSwafford's€next€witness€was€trial€counsel,€Raymond€Cass,€Jr.€Š $+t&. М(T›€231).€€He€said€that€he€and€Mr.€Pearl€"would€counsel€with€eachĻother,"€although€only€one€of€them€would€try€a€given€case;€it€wasĻhis€responsibility€to€try€Swafford's€case.€€œ(T›€232).€€He€and€Mr.ĻPearl€"had€it€a€year€and€a€half€or€two€before€we€got€to€trial."€œ(T›Ļ232).€€Mr.€Cass€admitted€that€a€defense€as€to€the€guilt/innocenceĻphase€looked€"[œs]omewhat›€bleak."€œ(T›€234).€€Ģą  ąMr.€Cass€said€that€he€did€not€get€any€written€communicationĻbetween€Prosecutor€White€and€Mr.€Harper.€€œ(T›€241).€€He€claimed€heĻlearned€of€the€alleged€reward€"from€John€Tanner,"€and€speculatedĻthat€occurred€"in€January€or€February"€of€1986.€œ(T›€245„246).€€HeĻ"then€wrote€to€Mr.€Swafford€telling€him€what€I€had€found."€œ(T›€246).€ĻMr.€Cass€said€that€he€had€intended€to€"look€into€the€possibility€ofĻsome€kind€of€post„conviction€relief€motion"€regarding€the€matter,Ϝ(T›€255),€but€never€filed€such€a€motion.€€œ(T›€304).€€Ģą  ąMr.€Cass€spoke€with€Prosecutor€White€well€before€trial€and€Mr.ĻWhite€told€him€that€there€were€other€suspects€besides€Swafford.€€œ(T›Ļ252).€€He€said€that€with€the€information€regarding€Mr.€Walsh,€Mr.ĻLevi,€and€Mr.€Lestz,€he€"would€have€started€on€a€background"€onĻthem.€œ(T›€255„256).€€He€"would€have€asked€.€.€.€Mr.€White€to€get€theĻwrap€[sic]€sheets€for€me€.€.€.€[œa]nd›€also€any€other€local€policeĻreports."œ×ƒiׯ ƒ #ĆŻņņŚ  Ś10Ś  ŚóóŻ  Ż×  כ€œ(T›€256).€The€rap€sheets€would€give€him€the€criminalŠ  &p!( Šhistories€of€the€individuals€involved€and€other€backgroundŠ Ģ'#* Šinformation€such€as€addresses.€€œ(T›€257).€€Mr.€Cass€said€that€it€wasĻunlikely€that€he€could€have€gotten€most€of€the€subject€informationĻinto€evidence€at€trial.€€œ(T›€265„267).Ģą  ąRegarding€the€prosecution's€alleged€deal€with€Mr.€Harper,€Mr.ĻCass€said€that€he€was€"aware€prior€to€trial€that€Mr.€White€wasĻattempting€to€help€Mr.€Harper€with€regard€to€his€federal€prisonĻsentence."€œ(T›€269).€€During€cross„examination€at€trial,€Mr.€CassĻelicited€testimony€from€Mr.€Harper€that€Mr.€Harper€had€written€"toĻtwo€different€lawyers€and€things€before€then€[reporting€hisĻknowledge€of€Swafford's€involvement€in€Ms.€œRucker›'s€murder]€askingĻthem€what€I€should€do,€because€I€thought€I€had€information."€œ(T›Ļ270).€€Mr.€Harper€testified:€"I€wrote€to€a€lawyer€here€in€Daytona,Ļa€John€Tanner.€€I€even€wrote€to€my€public€defender."€œ(T›€270).€ĻResponding€to€further€questions€from€Mr.€Cass€on€the€issue,€Mr.ĻHarper€said€that€his€letters€to€Mr.€Tanner€were€written€"in€lateĻJanuary€or€February€of€'83€.€.€.."€œ(T›€271).€€Mr.€Cass€explainedĻthat€he€did€not€delve€into€this€information€at€Mr.€Harper'sĻdeposition€because€"[œS]ometimes›€it's€a€little€better€if€you€reserveĻit€for€the€trial."€œ(T›€272„273).€€Upon€being€asked:€"So€are€youĻsuggesting€that€you€made€a€strategic€decision€not€to€ask€inĻdeposition?"€œ(T›€273).€€Mr.€Cass€responded:€"I€believe€so.€€I€thinkĻHoward€[Pearl]€and€I€both€had€a€feeling€about€that."€œ(T›€273).€€HeĻfurther€testified:ĢÓÓą8  ąQą ` ąSo,€you,€.€.€.€were€suspicious€that€he€was€gettingŠ $+t&. Ša€deal€or€attempting€to€get€a€deal,€but€you€decided€thatŠ ś+J'/ Šstrategically€it€was€better€to€kind€of€catch€him€offĻguard€about€it,€rather€than€give€him€a€chance€to€thinkĻabout€it€and€get€his€answer€all€ready?Š Š Š  ŠĢą  ą.€.€.€[œT]hat›€was€your€strategy?ĢĢą8  ąAą ` ąYes,€sir,€it€was.Š“ Š Š  ŠĢÓӜ(T›€273).œ×ƒvׯ ƒ #ĆŻņņŚ  Ś11Ś  ŚóóŻ  Ż×  כ€€He€also€said€that€ņ ņat€trialó ó,€if€he€had€wanted€to€delveŠ ` ° Šinto€the€"cooperation€that€he€may€have€been€attempting€to€get€andĻalso€regarding€what€Mr.€Tanner€may€have€done€for€him,"€he€couldĻhave€done€so,€"depending€on€the€strategy."€œ(T›€276).€Ģą  ąMr.€Cass€testified€that€at€trial,€Prosecutor€White€made€itĻclear€on€redirect€that€he€had€told€Mr.€Harper€"if€you€cooperatedĻand€tell€the€truth€and€be€honest,€I€will€try€to€continue€to€get€youĻsome€favorable€treatment€as€far€as€maybe€an€early€release€period."Ϝ(T›€274).€€Further,€at€Mr.€Harper's€May€21,€1984€deposition,€Mr.ĻWhite€gave€Mr.€Cass€and€Mr.€Pearl€a€copy€of€a€letter€from€Mr.ĻHarper€to€Prosecutor€White€regarding€his€potential€testimony€andĻfavorable€treatment€by€the€State.€€œ(T›€279).€€Finally,€on€recross,ĻMr.€Cass€opined€that€the€evidence€brought€out€at€trial€of€the€dealĻto€gain€his€freedom€earlier€was€stronger€motivation€evidence€thanĻthat€of€a€potential€reward€would€have€been.€€œ(T›€291).€€Š ä"4$ Šą  ąIn€fact,€Mr.€Cass€testified€that€he€did€make€a€"strategicĻdecision€not€to€make€more€inquiries€with€regards€to€that€[letter€toĻMr.€White€attached€to€deposition]€.€.€.."€œ(T›€302).€€He€added€thatĻhe€could€have€ascertained€Mr.€Harper's€release€date€from€theĻinformation€provided€in€the€letter,€but€he€"chose€not€to."€œ(T›€303).€Ļą  ąSwafford's€next€witness€was€former€œCCR›€lawyer,€JeromeϜNickerson›,€Jr.€€œ(T›€325).€€Mr.€œNickerson›€"was€lead€counsel€for€Mr.ĻSwafford's€case€when€he€originally€received€the€first€[death]Ļwarrant."€€œ(T›€326).€€The€warrant€was€signed€on€September€7,€1990,Ļand€œCCR›€had€done€no€work€until€then.€€œ(T›€326,€327).€€Ģą  ąMr.€œNickerson›€had€an€assistant€lawyer€working€with€him€onĻSwafford's€case,€Mr.€œShabazz›,€and€he€also€had€the€assistance€ofĻinvestigators;€one€of€whom€was€Mr.€œHarvil›.€€œ(T›€329,€340).€€Later,ĻMr.€œNickerson›€had€the€assistance€of€a€second€attorney.€€œ(T›€340).€€Ģą  ąMr.€œNickerson›€recalled€seeing€materials€referencing€Mr.€WalshĻand€"two€other€individuals."€€œ(T›€334,€342).€€œCCR›€"had€traced€oneĻguy€.€.€.€to€Arkansas€.€.€.."€œ(T›€342).€€He€pled€claims€regardingĻMr.€Walsh€in€the€first€Rule€3.850€motion€as€a€ņņBradyóó€issue.€€œ(T›Š !l" Š335).€€Mr.€œNickerson›€left€œCCR›€when€Swafford's€death€warrant€wasĻstayed€by€the€federal€circuit€court.€€œ(T›€348,€354).€€At€that€time,ĻMr.€œShabazz›€took€over€Swafford's€case.€€œ(T›€360).Ģą  ąRegarding€locating€potential€witnesses€or€suspects,€Mr.ϜNickerson›€testified€that€if€a€document,€including€police€reports€ĢÓÓą8  ąleads€me€out€of€state,€if€it€turns€out€that€there's€aĻconnection€with€the€other€state,€I'm€going€to€go€to€theŠ ,V'/ Šother€state,€I'm€going€to€go€to€Arkansas.€€I'm€going€toĻtalk€to€the€investigator€who€made€the€arrest€and€see€whatĻI€can€get€there.€€I'm€going€to€try€and€access€thatĻstate's€public€records€files.€€Š Š Š  ŠĢÓӜ(T›€368,€369).€€Regarding€locating€Mr.€Lestz€specifically,€Mr.ϜNickerson›€said€that€the€first€thing€to€do€would€have€been€to€"callĻthe€federal€locator€service,€Department€of€Justice."€€œ(T›€370).€€HeĻalso€said€he€would€have€called€the€prison€itself;€he€has€locatedĻprisoners€that€way.€€œ(T›€371).€€He€would€also€"try€and€find€outĻwhere€his€family€is€from,€where€does€this€guy€hang€œout€.€.€.€he's›Ļgoing€to€try€and€go€back€to€what€he€knows€or€try€and€findĻassociates€.€.€.."€€œ(T›€371).€€Mr.€œNickerson›€testified€that€if€the€Ļperson€being€sought€has€"a€9:00€to€5:00"€or€has€"gotten€a€loan€fromϜGMAC›€financing.€€Things€like€that€make€it€very,€very€easy€to€findĻpeople€in€the€œcountry."›€€œ(T›€375).€€Further,€Mr.€œNickerson›€said€thatĻif€he€had€been€looking€for€Mr.€Lestz,€he€"would€have€gone€to€theĻfederal€œprobation›€officer€.€.€.."€€œ(T›€376).€€Also,€he€"wouldĻattempt€to€access€state€of€Illinois€records,€driver's€licenseĻrecords,€things€like€that."€€œ(T›€377).€€He€would€also€have€gone€toĻthe€old€address€on€the€police€report€and€have€tried€to€find€eitherĻMr.€Lestz€or€someone€who€knew€something€about€him€that€would€helpĻput€him€in€contact€with€Mr.€Lestz.€€œ(T›€377).Ģą  ąMr.€œNickerson›€had€"numerous€letters€.€.€.€between€Mr.€GeneĻWhite€.€.€.€and€Roger€Harper"€at€the€time€he€did€the€initial€RuleĻ3.850€motion.€€œ(T›€384,€386).€€Although€Mr.€Nickerson€said€that€heĻdid€not€believe€he€had€seen€the€letter€indicating€that€Mr.€HarperŠ ś+J'/ Šreceived€a€reward€for€information€provided€in€Swafford's€case,€œ(T›Ļ389),€he€admitted,€when€confronted€with€the€initial€3.850€motion€heĻwrote€that€he€had€information€regarding€the€reward€and€"may€haveĻdone€it€through€the€document€you€showed€me€.€.€.."€€œ(T›€390).Ģą  ąMr.€Nickerson€went€to€Tennessee€twice€in€preparing€the€firstĻ3.850€motion.€€œ(T›€390).€€He€was€looking€for€relatives€of€SwaffordĻand€"also€looking€for€Harper€.€.€.€and€what€I€could€get€on€him."€Ļœ(T›€391).€€Mr.€Nickerson€claimed€to€have€"absolutely€no€recollectionĻof€having€Mr.€Lestz's€address€.€.€.."€€œ(T›€401).Ģą  ąSwafford€next€called€another€of€his€former€œCCR›€attorneys,ϜHarun›€œShabazz›,€who€"was€employed€at€œCCR›€from€August€of€1990€toĻJanuary€of€.€.€.€1997."€€œ(T›€414„415).€€He€began€working€with€Mr.ĻNickerson€on€Swafford's€case€"in€September€of€1990."€€œ(T›€416,€424).€ĻThere€were€three€attorneys,€and€at€least,€one€investigator€workingĻon€the€case.€€œ(T›€426).€€"[œT]owards›€the€end€of€September,€first€partĻof€October,"€the€information€regarding€Mr.€Lestz,€Levi,€and€WalshĻwas€received.€€œ(T›€426,€427).€€At€that€point,€Mr.€œShabazz›€andĻAttorney€Phillips€were€"assigned€to€the€whole€issue€of€Lestz,€LeviĻand€Walsh€that€became€paramount€in€the€case."€€œ(T›€426).Ģą  ąMr.€œShabazz›€was€"trying€to€find€certain€individuals"€includingĻ"Mr.€Lestz,€Levi€and€Walsh."€€œ(T›€418).€€Attempting€to€locate€theseĻmen,€he€"went€through€the€Chapter€119€public€records€material,Ļwhich€consisted€of€several€police€reports"€and€"sifted€throughĻthere€for€names,€addresses,€telephone€numbers€and€the€like."€€œ(T›Š $+t&. Š418).€€He€claimed€to€have€"contacted€the€state€and€federal€prisonϜsystem[s›],"€and€the€federal€officials€"told€me€that€once€theyĻrelease€the€individual,€they€didn't€give€any€information€how€youĻcould€contact€an€individual,€telephone€number€or€address€and€thingsĻof€that€sort."€€œ(T›€419).€€However,€he€later€admitted€that€he€"mostĻlikely€would€have€told€the€investigator€to€do€it€for€me.€€So€IĻdon't€know€if€I€ever€personally€had€called€the€prison,€federalĻprison€system.€€But€I€know€it's€been€done€on€other€cases."œ×ƒׯ ƒ #ĆŻņņŚ  Ś12Ś  ŚóóŻ  Ż×  כ€€œ(T›Š d“  Š431).€€He€also€admitted€that€he€had€seen€the€police€reports€whichĻ"in€the€case€of€Lestz€we€also€ran€across€an€address€or€.€.€.Ļtelephone€number"€and€got€other€information€such€as€birth€dates,Ļrace€and€social€security€numbers.€€œ(T›€419„420).€€Mr.€œShabazz›€didĻnot€recall€"making€a€phone€call€to€see€if€he€was€in€the€parole€andĻprobation€system."€€œ(T›€433).€€He€said€that€"after€.€.€.€making€thatĻinitial€.€.€.€attempt€to€locate€these€people,€I€don't€think€that€IĻmade€another€attempt€until€the€summer€of€'91."€€œ(T›€433).Ģą  ąMr.€œShabazz›€had€seen€the€police€report€containing€the€OakĻStreet,€Du€Quoin,€Illinois€address€for€Mr.€Lestz.€€œ(T›€434).€€HeĻ"thought"€that€he€"called€the€telephone€number€.€.€.€[œa]nd›€this€wasĻ1990."€€œ(T›€435).€€He€said:€"I€believe€someone€answered€the€phone.Ļ.€.€[œa]nd›€they€said€no€one€by€that€name€lived€there."€€œ(T›€435).€€HeĻsaid€that€he€contacted€the€Department€of€Motor€Vehicles€inŠ Ģ'#* ŠTallahassee.€€œ(T›€435,€436).€€He€made€no€such€attempt€in€the€StateĻof€Illinois,€or€any€state€other€than€Florida.€€œ(T›€436,€437).€€Ģą  ąAnyone€from€œCCR›€"could€put€in€a€request€for€a€search"€byĻGlobal.€œ(T›€421).€€Mr.€œShabazz›€claimed€to€have€made€a€request€forĻsuch€a€search€"in€the€spring€of€'91,"€but€later€changed€the€date€to€Ļ"June€or€July€of€that€summer."€€œ(T›€439).€€He€claimed€that€"GlobalĻwas€contacted,€you€know,€two€or€three€times€before€we€actually€gotĻany€results€from€Global."€€œ(T›€440).€€Mr.€œShabazz›€"didn't€think€thatĻthere€was€anything€else€that€we€could€do"€to€locate€Mr.€Lestz.€€œ(T›Ļ422).€€He€made€no€attempts€to€locate€Mr.€Lestz,€Levi,€or€WalshĻafter€contacting€Global€in€June€or€July€of€1991.€€œ(T›€442).€€Ģą  ąMr.€œShabazz›€became€lead€counsel€when€Mr.€Nickerson€left;€heĻwas€given€two€other€attorneys€and€two€investigators€to€help€himĻwith€the€case.€€œ(T›€417,€418).€€He€conceded€that€beginning€inĻJanuary,€1991,€"things€got€better€œfor€CCR›€in€terms€of€their€abilityĻto€effectively€represent€their€clients€based€on€the€fact€that€theĻsevere€warrant€policy€.€.€.€was€no€longer€being€followed."€€œ(T›Ļ445).€€Ģą  ąMr.€œShabazz›€filed€œSwafford›'s€second€Rule€3.850€motion€inĻ"November€of€1991."€€œ(T›€442).€€Thereafter€Mike€œChavis›€was€assignedĻto€the€case.€€œ(T›€422).€€In€the€"spring€of€1994,"€Mr.€ChavisĻreported€that€he€had€located€Mr.€œLestz›.€€œ(T›€423).Ģą  ąœSwafford›€next€presented€œCCR›€Investigator,€Michael€Chavis,€œ(T›Ļ451),€who€testified€that€he€was€assigned€to€œSwafford›'s€case€inŠ $+t&. Š"like€October€of€'92."€œ(T›€452).€€He€took€over€from€Mr.€œHarvil›Ļ"[œw]ho›€was€the€previous€investigator"€as€well€as€"the€initialĻinvestigator."€œ(T›€467).€œ€He›€"went€through€all€of€the€material€.€.Ļ.€on€Mr.€Swafford's€case,"€including€"œROAs›,€119€requests€.€.€.."€Ļœ(T›€452).€€Mr.€Chavis€claimed€to€have€contacted€both€the€State€ofĻFlorida's€prison€system€and€the€federal€prison€system€in€IllinoisĻregarding€locating€Mr.€Lestz,€Levi,€and€Walsh.€€œ(T›€453,€457).Ģą  ąMr.€Chavis€said€that€he€contacted€Global€for€the€first€time€inĻ"early€'93."€œ(T›€457).€€In€the€"first€part€of€'94,"€he€contactedĻGlobal€again.œ×ƒׯ ƒ #ĆŻņņŚ  Ś13Ś  ŚóóŻ  Ż×  כ€œ(T›€458).€€He€gave€Global€the€same€information."€€œ(T›Š ¼  Š458).€€He€got€an€address€for€Mr.€Lestz€and€Mr.€Levi.€€œ(T›€459).€€Ģą  ąMr.€Chavis€went€to€the€address€Global€gave€for€Mr.€Levi€andĻdiscovered€that€he€was€not€at€that€address.€€œ(T›€461).€€The€residentĻwas€Mr.€Levi's€mother,€who€"told€me€she€had€no€idea€where€he€was."€Ļœ(T›€461).€€He€claimed€to€œhave›€"contacted€Global€again"€and€gotĻ"another€address."€€œ(T›€461,€475).€€This€one€was€valid.€€œ(T›€475).Ģą  ąThe€address€received€from€Global€regarding€Mr.€Lestz€"wasĻcorrect."€€œ(T›€461).€€Within€two€to€three€weeks€of€getting€thatĻinformation,€Mr.€Chavis€went€"to€talk€to€Mr.€Lestz"€in€"aroundĻApril€of€'94."€€œ(T›€461,€462).Ģą  ąRegarding€his€own€efforts€to€find€Mr.€Lestz,€Mr.€Chavis€saidŠ  &p!( Šthat€he€called€the€federal€prison€in€Marion,€Illinois,€and€"all€IĻcould€get"€was€that€"[œh]e›€was€no€longer€there."€€œ(T›€469„470).€€HeĻclaimed€to€have€checked€the€"Department€of€Motor€Vehicles€to€(sic)Ļalmost€every€state,€if€not€every€state,"€including€Illinois.€€œ(T›Ļ471,€472).€€He€claimed€that€he€did€not€get€an€address€for€eitherĻMr.€Lestz€or€Mr.€Levi.€€œ(T›€473).Ģą  ąThe€State€called€Captain€Randall€C.€œBurnsed›,€one€of€theĻinvestigators€involved€in€Brenda€œRucker›'s€œmurder.›€€œ(T›€522,€523).€ĻHe€testified€that€Mr.€Lestz€was€"a€suspect€in€the€homicide."€œ(T›Ļ527).€€Indeed,€Lestz,€Levi,€and€Walsh€"tended€to€put€the€blame€onĻthe€other€two€.€.€.."€€œ(T›€528).Ģą  ąMr.€Lestz€did€not€appear€to€know€anything€about€the€œRucker›Ļhomicide€during€the€early€phases€of€the€initial€interview.€€œ(T›Ļ529).€€Rather,€he€claimed€that€Mr.€Walsh€had€œdone›€"[a]€lot€ofĻproperty€crimes"€and€eventually€claimed€that€œhe›€"had€killed€aĻperson,€a€male."€€œ(T›€529).€€It€was€only€"after€Investigator€œBuscher›Ļhad€laid€the€[œRucker›]€homicide€out€to€him€.€.€.€that€he€had€startedĻtalking€about€that€.€.€.."€€œ(T›€529).€€Prior€to€that,€Mr.€Lestz€hadĻnot€indicated€that€Mr.€Walsh€had€anything€to€do€with€the€œRucker›Ļmurder,€or€even€the€killing€of€a€woman.€€œ(T›€529).Ģą  ąAt€neither€interview€did€Mr.€Lestz€œindicate›€that€Mr.€Walsh€hadĻ"attempted€to€dispose€of€guns€of€any€kind€at€the€Shingle€Shack€BarĻon€February€œ14th›€of€1982."€€œ(T›€530).€€To€the€contrary,€he€indicatedĻthat€Mr.€Walsh€had€tried€to€"get€rid€of€at€least€two€guns€on€orŠ $+t&. Šabout€that€time€in€the€Daytona€Beach€area€.€.€.€to€an€individual€byĻthe€name€of€Orlando€Tony."€€œ(T›€531).€€This€occurred€at€"Rudy'sĻPost„time€Lounge,€which€is€located€in€the€vicinity€of€the€DaytonaĻSpeedway€on€Highway€92."€€œ(T›€531).€€Mr.€Lestz€indicated€that€thereĻwas€only€the€one€bar€that€they€went€to€for€this€purpose.€€œ(T›€565).€ĻNeither€did€the€description€of€the€guns€Mr.€Lestz€gave€the€officersĻat€the€time€of€the€initial€interviews€match€the€murder€weapon,Ļalthough€there€was€some€mention€of€a€thirty„eight.€€œ(T›€532,€563„¼564).€€The€initial€interview€was€given€after€"Lestz€through€hisĻattorney€contacted€Agent€Baker€.€.€.€and€informed€Baker€that€LestzĻwould€like€to€deal€with€federal€authorities€for€information€whichĻhe€possessed€on€Walsh."€€œ(T›€536,€537).Ģą  ąDue€to€"some€problems€œthat›€Mr.€Lestz€had€with€the€polygraphĻexam€he€took€after€the€initial€interview,"€Captain€œBurnsed›€andĻInvestigator€œBuscher›€went€to€Illinois€and€œreinterviewed›€Mr.€Lestz.€Ļœ(T€538).›€€The€"problems"€seemed€to€indicate€that€Mr.€Lestz€and/orĻMr.€Walsh€may€have€been€involved€in€the€œRucker›€homicide.€€œ(T›€538,Ļ558).€€They€wanted€to€confront€Mr.€Lestz€with€the€questions€onĻwhich€deception€was€indicated.€€œ(T›€538,€553).Ģą  ąAt€the€second€interview,€Mr.€Lestz€maintained€that€he€had€toldĻthe€truth€the€first€time,€yet€he€changed€his€version€of€eventsĻseveral€times€during€the€interview.€€œ(T›€539,€540).€€Having€observedĻMr.€œLestz's›€behavior€and€considering€his€psychological€condition,ĻCaptain€œBurnsed›€œformed›€the€impression€that€"he€was€a€very€weirdŠ $+t&. Šindividual€.€.€..€€I€didn't€know€what€to€believe€.€.€.€in€any€ofĻthe€information€that€he€provided."€€œ(T›€539).Ģą  ąAlthough€an€affidavit€was€executed€and€a€search€warrantĻobtained,€none€of€the€evidence€from€the€Lestz/Walsh€vehicle€wasĻlinked€to€the€crime€scene,€the€victim's€body€or€clothing€"orĻanything.€€There€was€just€nothing€.€.€.."€€œ(T›€541,€542).€€Moreover,Ļthe€"latent€fingerprints€developed€at€the€crime€scene€were€comparedĻwith€all€three€of€the€individuals€[Lestz,€Walsh€&€Levi]€major€caseĻprints"€without€a€match.€€œ(T›€542).€€Having€"nothing€that€we€couldĻshow€to€link€[them]€with€the€homicide,"€the€investigation€of€thoseĻsuspects€ended.€€œ(T›€542).Ģą  ąEventually,€Roger€Harper€contacted€the€authorities€and€saidĻthat€"he€had€information€that€he€thought€.€.€.€was€relevant€to€theĻhomicide€of€Brenda€œRucker›."€€œ(T›€543).€€This€lead€was€followed€up€onĻexactly€as€the€lead€regarding€Mr.€Walsh€had€been.€€œ(T›€570).€€"TheĻdifference€being€the€lead€.€.€.€from€Roger€Harper€led€us€to€the€gunĻthat€was€positively€identified€as€the€murder€weapon€that€killedĻBrenda€œRucker›."€€œ(T›€570).Ģą  ąBeginning€with€the€first€interview,€Mr.€Harper€consistentlyĻtold€the€officers€that€Swafford€disposed€of€the€murder€weapon€atĻthe€Shingle€Shack.€€œ(T›€570).€€Mr.€Lestz€never€gave€any€informationĻindicating€that€Mr.€Walsh€did,€or€might€have,€disposed€of€a€gun€atĻthat€location.€€œ(T›€543).Ģą  ąMr.€Walsh€denied€Mr.€Lestz's€claims€that€he€had€committed€anyŠ $+t&. Šhomicides,€and€essentially€denied€"all€of€the€criminal€activity."€Ļœ(T›€572„573).€€He€suggested€that€the€claims€œwere€a€"figment›€ofϜLestz's›€imagination."€€œ(T›€573).€€He€opined€that€the€burns€on€Mr.ϜLestz's›€body€were€self„inflicted,€œan›€opinion€which€Mr.€Levi€alsoĻheld.€€œ(T›€573,€292).Ģą  ąInvestigator€Buscher's€report€indicated€that€Mr.€Lestz'sĻattorney€claimed€that€Mr.€Lestz€claimed€that€Mr.€Walsh€claimed€toĻhave€murdered€two€white€females.€€œ(T›€574).€€When€this€claim€wasĻmade,€Mr.€Lestz's€attorney€was€trying€to€get€favorable€treatment€onĻMr.€Lestz's€œfederal€sentences›€in€exchange€for€information€on€Mr.ĻWalsh.€€(Defendant's€Exhibit€œ3›€at€1).€€However,€when€InvestigatorĻBuscher€personally€interviewed€Mr.€Lestz,€"he€never€referred€to€theĻkilling€of€the€female,€he€referred€to€the€killing€of€a€white€œmaleĻ.›€.€.."€€œ(T›€581).€€It€was€clear€that€"the€information€regarding€aĻwhite€female€actually€came€from€Lestz'€attorney€.€.€.."€€œ(T›€585).€Ļ"[œT]he›€Rucker€homicide€itself€did€not€come€up€until€InvestigatorĻBuscher€brought€it€up;"€moreover,€"at€that€time€Lestz€denied€havingĻany€knowledge€of€that€.€.€.."€€œ(T›€œ585).€€Finally,›€the€captainĻtestified€that€although€both€Mr.€Lestz€and€Mr.€Levi€placed€Mr.ĻWalsh€in€the€vicinity€of€the€murder€at€the€time€thereof,€"[œt]here›Ļwas€conflicting€information€as€to€what€both€of€them€had€said."€€œ(T›Ļ583,€584).Ģą  ąState€Attorney€Investigator,€Deborah€œReith›€Champion,€phonedĻthe€œMarion,›€Illinois€federal€penitentiary€using€the€phone€numberŠ $+t&. Š"listed€in€the€first€paragraph,€618„964„1441."€€œ(T›€588).€€She€gaveĻa€man€in€the€Records€Department€Mr.€Lestz's€name€and€inmate€number€Ļ(from€the€police€report),€and€inquired€as€to€Mr.€Lestz'sĻwhereabouts.€€œ(T›€588).€€She€was€told€that€Mr.€Lestz€was€"no€longer€Ļthere"€and€"that€his€files€were€transferred€to€Arkansas."€€œ(T›€588„¼589).€€She€was€given€a€number€for€the€U.S.€Probation€Office€for€theĻWestern€District€of€Arkansas.€€œ(T›€589„590).€€She€received€all€ofĻthis€information€in€"not€even€two€minutes."€œ(T›€589).Ģą  ąMs.€Champion€called€the€Arkansas€number€and€was€told€that€Mr.ĻLestz's€files€had€been€transferred€to€the€Southern€District€ofĻIllinois.€€œ(T›€590).€€She€was€given€"two€phone€numbers€for€that."€Ļœ(T›€590).€€This€call€also€took€"two€minutes."€€œ(T›€590).Ģą  ąMs.€Champion€then€called€the€number€for€the€Southern€DistrictĻof€Illinois€and€spoke€with€a€probation€officer,€Jon€œKoechner›.€€œ(T›Ļ590).€€He€was€readily€familiar€with€Mr.€Lestz€and€"explained€aboutĻhim€a€bit€to€me."€€œ(T›€590).€€He€then€told€her€the€type€ofĻinformation€relative€to€locating€Mr.€Lestz€which€would€be€containedĻin€his€file.€€œ(T›€591).€€That€included:ĢÓÓą8  ąą8` Š Š ą[œH]is›€employment€information,€any€kind€of€homeĻaddress,€employment€address,€and€any€kind€ofĻfamily€that€he€had,€.€.€.,€any€kind€of€work,€.Ļ.€.,€as€far€as€medical€anything€like€œthat€that›Ļ(sic)€would€have€been€in€the€file.€€ÓÓŠ ` x` x М(T›€591).€€Ģą  ąMr.€œKoechner›€said€that€the€file€was€no€longer€on€the€premises;Ļit€was€stored€in€"their€database€outside€the€state."€€œ(T›€591).€€Ms.Š $+t&. ŠChampion€inquired€whether€the€information€in€the€file€would€beĻavailable€to€a€defense€attorney€or€an€investigator.€€œ(T›€592).€€Mr.ϜKoechner›€indicated€that€it€would,€explaining€that€the€procedureĻbeing€used€to€obtain€that€information€was€to€petition€a€federalĻjudge€for€permission€"to€look€at€the€file."œ×ƒׯ ƒ #ĆŻņņŚ  Ś14Ś  ŚóóŻ  Ż×  כ€€œ(T›€592).Š ` ° Šą  ąMs.€Champion€also€called€Global€Tracing€Services€in€Seattle,ĻWashington.€€œ(T€593).›€€She€spoke€with€John€Spencer.€€œ(T›€593).€ĻAfter€checking€Global's€records,€Mr.€Spencer€reported€that€thereĻwere€only€two€inquiries€made€by€Swafford's€counsel€„€one€in€1990Ļand€the€other€in€1994.€€œ(T›€594).Ģą  ąThe€trial€judge's€order€denying€the€third€Rule€3.850€motionĻafter€the€evidentiary€hearing€made€numerous€factual€findings€on€theĻissue€of€due€diligence.€€Those€include:ĢÓÓą8  ą[œA]s›€of€October€15,€1990,€.€.€.€the€defendant's€CapitalĻCollateral€counsel€had€information€regarding€Mr.€LestzĻand€his€contention€regarding€Mr.€Walsh€and€Mr.€Levi€.€.Ļ.€which€reasonably€could€have€led€to€the€discovery€of€Mr.ĻLestz's€whereabouts€back€in€the€fall€of€1990.€.€.€.€[œA]s›Ļof€October€15,€1990,€the€defendant€was€aware€of€the€twoĻ(2)€œVolusia›€County€Sheriff's€Office€supplemental€reportsĻ.€.€.€as€they€were€raised€as€ņņBradyóó€violations€in€œitsŠ F –! Š(sic)€first›€3.850€motion€.€.€..€€Accordingly,€this€CourtĻspecifically€finds€that€the€defendant,€through€theĻexercise€of€due€diligence,€could€have€located€Mr.€LestzĻand€would€have€had€until€October€15,€1992,€to€file€theĻinstant€3.850€motion€.€.€.€rather€than€raising€same€inĻits€June,€1994,€third€3.850€motion.€.€..Š Š Š  ŠŠ &&v!( Šą8  ąMr.€Lestz€testified€.€.€.€and€this€Court€finds€from€hisĻtestimony€that€he€was€living€in€the€same€place€over€thatĻtwo€year€time€frame€of€October€15,€1990€through€OctoberĻ15,€1992.€€This€Court€finds€.€.€.€that€the€defendant'sĻcollateral€counsel€could€have€located€Mr.€Lestz€withinĻthat€two€œ(2)›€year€window€.€.€..€€Mr.€Lestz€had€providedĻan€address€to€the€Sheriff's€Office,€which,€if€followedĻup,€would€have€led€to€him€living€just€seven€(7)€milesĻaway€in€a€very€small€town€of€100€plus€citizens.€€Further,Ļthis€Court€finds€œthat›€had€the€defendant's€collateralĻcounsel€followed€up€the€information€.€.€.,€they€couldĻhave€learned€the€name€of€his€Federal€probation€officerĻand€the€name€of€Lestz's€brother€and€the€address€of€LestzĻwhile€he€was€on€probation€and€this€Court€finds€that€anyĻof€those€leads€would€have€led€the€defense€to€where€Mr.ĻLestz€was€residing€over€that€two€(2)€year€time€period€inϜElkville›,€Illinois,€a€town€of€approximately€104€people€inĻ1990.€.€.€.€[œT]his›€Court€finds€that€had€the€defendant'sĻcollateral€counsel€followed€up€with€the€informationĻcontained€in€the€two€œ(2)›€Sheriffs€supplemental€œreports›Ļreferred€to€previously,€they€would€have€discovered€thatĻMr.€Lestz€was€living€in€a€house€approximately€three€(3)Ļmiles€from€œElkville›,€Illinois,€they€would€have€alsoĻdiscovered€that€œhis›€wife,€daughter,€and€his€brother€allĻlive€in€that€same€very€small€community€and€that€Mr.€LestzĻowned€and€operated€a€pest€control€business€there.€€TheyĻwould€have€also€discovered€that€Mr.€Lestz's€brother€wasĻwell€known€in€the€community€and€had€co„signed€as€aĻguarantor€on€Mr.€Lestz's€car€and€business€loans.Š Š Š  ŠĢ€€ą8  ąThe€.€.€.€trial€counsel,€Ray€Cass,€.€.€.€testified€thatŠ Ä Šprosecutor€White€told€him€there€had€been€other€suspects,Ļbut€they€had€been€eliminated.€.€.€.€[œP]rosecutor›€WhiteĻgestured€at€several€file€boxes€.€.€.€and€offered€Mr.€CassĻthe€opportunity€to€go€through€Mr.€White's€files€.€.€.,Ļbut€Mr.€Cass€.€.€.€declined€to€do€so€because€of€theĻamount€of€time€involved€.€.€..€€This€Court€specificallyĻfinds€that€had€.€.€.€Cass,€taken€up€prosecutor€White'sĻoffer€.€.€.,€then€the€trial€counsel,€weeks€before€theĻstart€of€the€murder€jury€trial,€would€have€discoveredĻalso€those€two€(2)€Sheriff€œ(sic)€reports›€.€.€..€€Š Š Š  ŠĢą8  ąAs€this€Court€has€found€that€the€defendant€has€failed€toĻmeet€the€threshold€requirement€.€.€..€€Although€it€is€notĻnecessary,€this€Court€.€.€.€finds€that€had€the€testimonyĻof€Mr.€Lestz€been€presented€to€the€jury€that€it€would€notĻhave€probably€produced€an€acquittal.Š ąThe€only€issues€properly€before€this€Honorable€Court€are€thoseĻauthorized€in€the€opinion€remanding€this€case€to€the€trial€courtĻfor€an€evidentiary€hearing,€i.e.,€whether€Mr.€Lestz's€alleged€"new"Ļstatement€is€newly€discovered€evidence.€€Mr.€Lestz's€alleged€"new"Ļstatement€cannot€be€newly€discovered€evidence€because€it€was€notĻadmitted€into€evidence.€€Neither€was€Mr.€Lestz's€evidentiaryĻhearing€testimony€newly€discovered€evidence.€Swafford€has€notĻcarried€his€burden€to€establish€the€threshold€requirement,€i.e.,Ļthat€his€third€Rule€3.850€motion€was€filed€within€two€years€of€theĻtime€the€"new"€statement€could€have€been€discovered€if€it€had€beenĻpursued€with€due€diligence.€€Mr.€Lestz€could€have€been€located€manyĻyears€earlier€by€either€trial€or€collateral€counsel.€€Moreover,ĻSwafford€has€failed€to€show€that€the€alleged€"new"€evidence,Ļtogether€with€the€evidence€introduced€in€the€first€Rule€3.850Ļmotion€and€the€trial€evidence€would€have€probably€produced€anĻacquittal.€€Having€failed€to€establish€either€requirement€forĻrelief,€muchless€both,€Swafford€is€entitled€to€no€relief.€Ģņņņ ņUNAUTHORIZED€ISSUESóóó ó:Š .'~") Šą  ąThe€State€objects€to€each€of€Swafford's€five€unauthorizedĻclaims,€and€submits€that€same€are€procedurally€barred.€€In€theĻalternative,€the€State€asserts€that€each€unauthorized€issue€isŠ N,ž'/ Šwithout€merit.Ģņņņ ņIssue€Ióóó ó:Š \¬ Šą  ąThe€State's€1990€response€to€Swafford's€first€Rule€3.850Ļmotion€was€not€misleading.€€Mr.€Walsh€and€company€were€investigatedĻfor€months€and€were€eventually€discarded€as€suspects€because€thereĻwas€no€evidence€to€support€further€investigation.€€The€failure€toĻinterview€Mr.€Levi€a€third€time€in€no€manner€prejudiced€Swafford.€ĻAlthough€Swafford€produced€Mr.€Levi€at€the€evidentiary€hearing,€heĻpresented€nothing€new€which€casts€any€doubt€on€the€validity€ofĻSwafford's€conviction.€€Any€ņņBradyóó€and€ņņKylesóó€components€to€thisŠ Ų( Šclaim€are€procedurally€barred.Ģņ ņņņIssue€IIóóó ó:Š <Œ Šą  ąSwafford's€ņņBradyóó€and€ņņKylesóó€claims€are€procedurally€barred.Š T Šņ ņņņIssue€IIIóóó ó:Š ¼  Šą  ąSwafford€has€failed€to€establish€that€the€circuit€court€judgeĻabused€his€discretion€in€deciding€not€to€take€judicial€notice€ofĻthe€"Overton€Commission€Report"€or€the€"Shevin€Report."€€€SwaffordĻfailed€to€authenticate€the€reports,€and€did€not€produce€anyĻevidence€establishing€that€the€reports€fell€within€any€of€theĻstatutory€categories.€€Any€claim€that€it€was€mandatory€for€theĻjudge€to€take€judicial€notice€of€the€reports€was€not€made€below,Ļand€therefore,€is€procedurally€barred;€it€is€also€without€merit.€ĻThe€content€of€the€reports€was€subject€to€the€rule€prohibitingĻhearsay,€and€thus,€could€not€be€used€as€substantive€evidence.€€InŠ Šany€event,€any€error€was€harmless.Ģņ ņņņIssue€IVóóó ó:Š \¬ Šą  ąSwafford's€claim€that€the€rule€relating€to€due€diligence€inĻconnection€with€newly€discovered€evidence€applies€only€toĻcollateral€counsel€is€procedurally€barred€because€it€was€not€raisedĻbelow.€€It€also€lacks€merit.€€Moreover,€the€issue€is€not€whetherĻcollateral€counsel€used€"reasonable€steps€to€investigate"€orĻ"reasonably€conducted€a€search€for€Mr.€Lestz€based€on€theĻinformation€counsel€had€in€1990,"€but€is€that€specified€by€thisĻCourt€in€the€opinion€on€remand.€€Swafford€has€utterly€failed€toĻestablish€either€the€due€diligence€or€prejudice€components€of€theĻissue€on€remand.Ģņ ņņņIssue€Vóóó ó:Š Ü, Šą  ąSwafford's€claim€that€the€circuit€court€judge€should€haveĻdisqualified€the€entire€State's€Attorney's€Office€from€handling€theĻevidentiary€hearing€is€without€merit.€€He€failed€to€establish€anyĻbasis€to€disqualify€the€State€Attorney,€muchless€his€assistants.€ĻThe€State€Attorney€had€no€direct€involvement€(except€as€Swafford'sĻwitness€on€this€issue)€in€the€evidentiary€hearing€which€was€handledĻby€an€assistant.€€Swafford€has€not€demonstrated€that€the€trialĻjudge€abused€his€discretion€in€ruling€that€there€was€no€basis€forĻdisqualification€in€this€case.ĢĢŠ \+¬&. Šą@  &ģąņ ņņņARGUMENT›ˆŠ ° Šó óóóą  ąThe€only€issues€before€this€Honorable€Court€are€thoseŠ xČ Šspecified€in€this€Court's€opinion€on€remand,€to„wit:ĢÓÓą8  ąWhether€Swafford€has€demonstrated€as€a€thresholdĻrequirement€that€his€untimely€and€successive€motion€forϜpostconviction›€relief€was€filed€within€two€years€of€theĻtime€when€Lestz's€statement€could€have€been€discoveredĻthrough€the€exercise€of€due€diligence.€[citationsĻomitted].€€If€the€trial€court€determines€that€Lestz'sĻstatement€is€newly€discovered€evidence,€it€must€thenĻdetermine€whether€the€statement,€in€conjunction€with€theĻevidence€introduced€in€conjunction€with€the€evidenceĻintroduced€œin›€Swafford's€first€rule€3.850€motion€and€theĻevidence€introduced€at€trial,€would€have€probablyĻproduced€an€acquittal.€Š Š Š  ŠĢņņÓÓSwafford,óó€679€So.€2d€at€739.€€Very€little€of€Swafford's€initialŠ ®ž Šbrief€addresses€those€issues.€€The€State€asserts€that€to€the€extentĻthat€Swafford€has€failed€to€brief€and€argue€the€issues€this€CourtĻauthorized,€he€has€abandoned€and/or€waived€any€claims€in€regard€toĻsame.Ģą  ąœAssuming€ņņarguendo€óóthat€said€claims€are€not€waived,€the›€State'sŠ f Šposition€on€the€issue€œon›€remand€follows:̜ņ ņņņą@ģąNewly›€Discovered€œEvidenceˆŠ z Ź! ŠStandardóóó ó:›Š B"’# Šą  ąIn€his€third€Rule€3.850€motion,€Swafford€claims€that€theĻaffidavit/statement€of€Michael€Lestz€constitutes€newly€discoveredĻevidence€of€his€innocence€of€the€first€degree€murder€for€which€heĻhas€been€convicted€and€sentenced€to€death.€€For€evidence€to€beĻnewly€discovered,€it€must€have€been€"unknown€by€the€trial€court,€byŠ ŗ* &- Šthe€party,€or€by€counsel€at€the€time€of€trial,€and€it€must€appearĻthat€defendant€or€his€counsel€could€not€have€known€[of€it]€by€theĻuse€of€diligence."€€ņņJones€v.€Stateóó,€591€So.€2d€911,€916€(Fla.Š X Š1991)[quoting€ņņœHallman›€v.€Stateóó,€371€So.€2d€482,€485€(Fla.€1979)].€Š Ą  ŠFurther,€Even€if€there€is€newly€discovered€evidence,€to€meritĻrelief,€the€new€evidence€must€be€so€substantial€that€it€wouldĻprobably€produce€an€acquittal€on€retrial.€€ņņId.óó€œat›€911.Š Š  Šą  ąIn€the€opinion€remanding€this€claim€for€an€evidentiary€hearingĻon€the€newly€discovered€evidence€issue,€this€Court€held:ĢÓÓą8  ą[œA]s›€a€threshold€requirement€[Swafford€must€prove]€thatĻhis€untimely€and€successive€motion€for€œpostconviction›Ļrelief€was€filed€within€two€years€of€the€time€whenĻLestz's€statement€could€have€been€discovered€through€theĻexercise€of€due€diligence.€.€.€.€€ņ ņņņIfóóó ó€the€trial€courtŠ 8ˆ Šdetermines€that€Lestz's€statement€is€newly€discoveredĻevidence,€it€must€ņ ņthenó ó€determine€whether€the€statement,Š ņB Šin€conjunction€with€the€evidence€introduced€in€Swafford'sĻfirst€rule€3.850€motion€and€the€evidence€introduced€atĻtrial,€would€have€ņ ņprobablyó ó€produced€an€acquittal.ÓÓŠ‚ŅŠ Š  М(citations€omitted)ņņ€Swafford›€v.€State,óó€679€So.€2d€736,€739€(Fla.Š Jš М1996)(emphasis€added).›€€It€was€Swafford's€burden€to€demonstrateĻthat€the€Lestz€evidence€was€newly€discovered€and,€if€so,€that€itĻwas€so€substantial€as€to€probably€have€produced€his€acquittal.€€HeĻutterly€failed€to€do€œso.Ģ€€First,€Mr.€Lestz's€alleged€"new"€statement€„€the€"Lestz'sĻaffidavit"€679€So.€€2d€at€739€„€cannot€be€newly€discovered€evidenceĻbecause€it€was€not€admitted€into€evidence.€€(T€136).€€Mr.€LestzĻsaid€that€CCR€prepared€the€document,€and€his€testimony€at€theŠ ¶*&- Ševidentiary€hearing€did€not€track€the€allegations€in€the€affidavit.€ĻOf€particular€importance€is€that€the€specific€allegations€in€theĻaffidavit€on€which€the€remand€was€based€were€not€substantiated€atĻthe€hearing.€€This€Court€specifically€identified€the€part€of€theĻaffidavit€(alleged€to€have€been€that€of€Mr.€Lestz)€which€underliesĻthe€remand,€to„wit:€€"Lestzššs€statement€[the€affidavit]€placesĻWalsh€at€the€Shingle€Shack€with€the€.38€caliber€hand€gun€at€or€nearĻthe€time€that€the€murder€weapon€was€discovered€in€that€locale."€Ļ679€So.€2d€at€736.€€Contrary€to€the€allegation€in€the€CCR„preparedĻaffidavit,€Mr.€Lestzššs€testimony€at€the€hearing€does€not€place€Mr.ĻWalsh€at€the€Shingle€Shack€"with€the€.38€caliber€hand€gun"€at€anyĻtime,€muchless€near€the€time€that€the€murder€weapon€was€discoveredĻthere.€€Moreover,€his€testimony€does€not€even€remotely€suggest€thatĻMr.€Walsh€actually€ņņdisposedóó€of€the€gun,€or€any€gun,€at€the€ShingleŠ l¼ ŠShack.€€Rather,€Mr.€Lestz€testified€that€he€did€not€know€if,€or€ifĻso,€where,€Mr.€Walsh€disposed€of€any€guns.€€(T€120).€€However,€ņ ņifó óŠ Ä ŠMr.€Walsh€disposed€of€a€gun€on€the€night€in€question,€it€mostĻlikely€occurred€at€a€bar€on€Atlantic€Avenue€and€not€at€the€ShingleĻShack€(which€was€located€on€U.S.€1):€€"He€[Walsh]€was€prettyĻanxious€.€.€.€[a]nd€.€.€.€I€dropped€him€off€on€the€strip€known€asĻAtlantic€Avenue€in€Daytona.€€He€seemed€at€that€point€to€be€relievedĻ.€.€.."€€(T€68).€€Thus,€the€"new"€statement€of€Lestz€does€notĻestablish€the€alleged€fact€on€which€the€remand€was€based.€ĻConsequently,€the€relief€Swafford€seeks€should€be€denied.Š @+&. Šņ ņņņThreshold›€Issue€„€Due€œDiligenceóó:Š ° Šą  ąó óAssuming€ņņarguendoóó€that€neither€the€failure€to€obtain€admission€Š xČ Šof€the€affidavit€into€evidence€nor€to€establish€the€criticalĻallegations€contained€in€the€affidavit€at€the€evidentiary€hearingĻends€this€Courtššs€consideration€of€this€matter,€Swafford€must€proveĻthat€the€statement€of€Lestz€given€at€the€evidentiary€hearing€wasĻnewly€discovered€evidence.€€The›€threshold€issue€is:ĢÓÓą8  ąWhether€Swafford€has€demonstrated€.€.€.€that€his€untimelyĻand€successive€motion€.€.€.€was€filed€within€two€years€ofĻthe€time€when€Lestz's€statement€could€have€beenĻdiscovered€through€the€exercise€of€due€diligence.€Š Š Š  ŠĢņņSwafford,óó€679€So.€2d€at€œ739.€€ÓÓLestz's›€statement€was€established€atŠ ŗ  Šthe€evidentiary€hearing.œ×ƒׯ ƒ #ĆŻņņŚ  Ś15Ś  ŚóóŻ  Ż×  כ€€Relevant€to€the€due€diligence€issue,€heŠ rĀ Štestified:€Ģą  ą1)ą ` ąHe€maintained€an€address€at€12€South€Oak€Street,€DuŠ Ź ŠQuoin,€Illinois,€which€he€had€"off€and€on€for€like€five€or€sixĻyears."€€œ(T›€96,€97).€€That€address€was€listed€on€his€IllinoisĻdriver's€license,€and€it€was€his€correct€address€prior€to€hisĻincarceration€in€the€federal€prison.€€œ(T›€95„96).Ģą  ą2)ą ` ąHe€was€imprisoned€in€September,€1982€in€the€"MarionŠ &"v# ŠFederal€Penitentiary€in€Marion,€Illinois,"€and€was€released€onĻDecember€3,€1984.€€œ(T›€69,€79,€89,€90).€€He€was€required€to€go€backĻto€his€"point€of€conviction"€which€was€œ"Arkansas,"›€but€shortlyŠ *'z") Šthereafter,€he€was€placed€in€his€brother's€"care"œ×ƒׯ ƒ #ĆŻņņŚ  Ś16Ś  ŚóóŻ  Ż×  כ€and€"remandedŠ ° Što€the€Seventh€District€of€Illinois€Probation€Department."€€œ(T›€91).€ĻThe€federal€prison€authorities€"knew€where€I€was€at."€œ(T›€91„92).Ģą  ą3)ą ` ąHe€returned€to€his€home€and€lived€in€a€trailer€"on€œRoute›Š “  Š51,€in€œElkville›,"€Illinois,€a€small€town€of€"about€a€hundred€andĻfour€people"€in€1990.€€œ(T›€78,€92).€€This€residence€was€"[œs]even›Ļmiles"€from€the€Oak€Street€address.€€œ(T›€101).€€He€lived€at€thatĻaddress€until€"roughly€June€or€July€of€1985"€when€he€moved€to€aĻhome€"[œa]bout›€three"€miles€away,€located€at€"Rural€Route€1,ϜHallidayboro›,€Illinois,"€in€a€"small€town"€"[œj]ust›€œon›€the€outskirtsĻof"€œElkville›.€€œ(T›€93).€€He€lived€there€continuously€"until€today.Ļ.€.."€€œ(T›€93).€€Ģą  ą4)ą ` ąFederal€Probation€Officer€Bruce€Chambers€was€in€"a€townŠ Ą Šclose€by"€and€knew€where€Lestz€lived.€œ(T›€92).€€Mr.€Lestz€reportedĻto€Mr.€Chambers€"every€week."€œ(T›€92).€€Indeed,€after€his€probationĻended,€Lestz€continued€to€have€contact€with€Mr.€Chambers.€€œ(T›€124).€Ļą  ą5)ą ` ąAfter€his€release€from€federal€prison,€some€motorŠ pĄ  Švehicles€were€titled€in€Mr.€Lestz's€name.€œ(T›€100).€€Some€of€thoseĻtitles€bore€his€correct€address.€œ(T›€100).Ģą  ą6)ą ` ąœMr.€Lestz€owns›€and€operates€a€"[œp]est›€control"€businessŠ t$Ä& Šand€has€done€so€"[œs]ince›€the€time€I€got€out€of€prison€last,"€i.e.,ĻDecember€3,€1984.€œ(T›€102).€€Mr.€Chambers€likely€knew€that€Mr.€LestzĻran€that€business€as€the€two€men€had€contact€"[œs]everal›€times"€inĻthe€years€after€Mr.€Lestz€successfully€completed€his€parole.€œ(T›Ļ124,€125).Ģą  ą7)ą ` ąœMr.€Lestz€married›€in€"'85€or€'86"€and€lived€with€his€wifeŠ  \  Šand€their€daughter€continuously€"until€this€present€time."€œ(T›€105).Ģą  ąThe€œVCSO›€reports€list€the€Oak€Street€address€in€œDuquoin›,ĻIllinois,€along€with€a€telephone€number€for€Mr.€Lestz.€Ļœ(Defendant's›€œExhibit›€œ6›€at€œ1).›€€Another€report€lists€the€prisonĻwhere€Mr.€Lestz€was€incarcerated€and€gives€his€inmate€number€and€œaĻtelephone›€number.€€œ(Defendant's›€œExhibit›€œ5›€at€œ3).›Ģą  ąWith€that€information,€Investigator€Champion€was€able€toĻquickly€find€information€which€would€have€been€sufficient€to€locateĻMr.€Lestz.€€This€information€was€available€to€Swafford€upon€aĻproper€request€thereafter.Ģņ ņI.ą  ąTrial€CounselŠ pĄ  Šó óą  ąDespite€having€served€a€standard€discovery€demand,€Swafford'sŠ 8!ˆ" Štrial€attorneys,€Howard€Pearl€and€Ray€Cass,€went€to€the€OrmondĻBeach€Police€Department€to€inquire€about€any€"additional€files€orĻevidence."€œ(T›€173).€€They€received€"a€rather€large€package€of€workĻthat€they€had€done"€on€Swafford's€case.€œ(T›€173).€€The€attorneysĻcould€have,€but€did€not,€take€such€action€with€the€primaryĻinvestigating€agency,€the€Sheriff€of€œVolusia›€County.€œ(T›€174,€207„Š @+&. Š208).Ģą  ąMr.€Pearl€had€interviewed€witness,€Paul€œSeiler›,€and€therefromĻ"knew€there€was€a€possibility€of€another€suspect,€someone€else."€œ(T›Ļ180).€€Mr.€Cass€shared€his€belief€"that€Mr.€œSeiler›€could€point€toĻsomeone€else€.€.€.€although€he€could€not€identify€him.€.€.."€œ(T›Ļ180).€€Also,€due€to€an€alleged€evidentiary€conflict€regardingĻspecifically€where€the€murder€weapon€was€found,€Mr.€Pearl€believed€Ļthat€there€may€have€been€two€guns,€and€thus,€another€suspect.€œ(T›Ļ203).€€Due€to€his€"extremely€good"€relationship€with€the€officersĻinvolved,€he€could€have€asked€them€whether€there€were€additionalĻsuspects,€but€he€"did€not."€œ(T›€208).€€Defense€counsel€did€notĻfurther€investigate€suspect€possibilities.€œ(T›€203).€€Ģą  ąAttorney€Cass€admitted€that€he€had€spoken€to€Prosecutor€WhiteĻprior€to€trial€and€that€Mr.€White€told€him€that€there€were€suspectsĻother€than€Swafford.€œ(T›€252).€€Mr.€Cass€testified:ĢÓÓą8  ą.€.€.€€He€was€in€an€office€.€.€.€in€which€there€had€to€beĻabout€fifty€cartons€of€files.€€And€when€I€mentioned€anyĻothers,€I€said,€well,€where€are€they,€you€know.€€And€heĻsaid€well,€they€had€ruled€them€out,€ņ ņbut€they€are€there.ó ó€Š F –! ŠAnd€he€indicated€.€.€.€some€fifty€file€boxes.€€And€IĻsaid,€well,€you€don't€want€to€pull€them.€€He€said,€no,Ļņ ņyou€can€just€go€ahead€and€look€through€them€yourself,€ifŠ Ö"&$ Šyou€want.ó ó€Šŗ# %Š Š  ŠĢÓӜ(T›€œ261)(emphasis›€added).€€Mr.€Cass€thought€that€it€would€take€aĻlong€time€to€go€through€the€files;€he€did€not€ask€Mr.€White€if€heĻcould€quickly€find€the€suspect€information€for€him.œ×ƒׯ ƒ #ĆŻņņŚ  Ś17Ś  ŚóóŻ  Ż×  כ€€œ(T›€262).Š Ģ($+ Šą  ąAttorney€Pearl€admitted€that€had€he€been€looking€for€Mr.ĻLestz,€he€would€have€found€him€with€the€information€contained€inĻthe€VCSO€repots.€œ(T›€œ226„227).›€€Mr.€Cass€and€œCCR›€Attorney€NickersonĻalso€testified€to€steps€they€would€have€taken€to€find€Mr.€LestzĻwith€that€information.€œ(T›€255„257,€368„377).€€From€Mr.€Lestz'sĻtestimony€at€the€1997€evidentiary€hearing,€it€is€clear€that€hadĻthose€steps€been€taken,€Mr.€Lestz€would€have€been€found€from€theĻinformation€contained€in€the€VCSO€reports.Ģą  ąThe€trial€court€found€"had€.€.€.€Cass,€taken€up€prosecutorĻWhite's€offer€.€.€.,€then€the€trial€counsel,€weeks€before€the€startĻof€the€murder€jury€trial,€would€have€discovered€also€those€two€(2)ĻSheriff€reports€.€.€.."€œ(T›€287).€€Certainly,€Swafford€has€presentedĻnothing€to€invalidate€that€determination.€€Thus,€trial€counselĻcould€have€found€Mr.€Lestz,€Mr.€Levi,€and€Mr.€Walsh€with€theĻexercise€of€due€diligence,€and€therefore,€œthere›€is€no€newlyĻdiscovered€evidence.Ģą  ąThe€evidence€developed€at€the€evidentiary€hearingĻoverwhelmingly€shows€that€Mr.€Lestz€could€have€been€located€priorĻto€trial€if€trial€counsel€had€exercised€due€diligence.€€To€theĻextent€that€the€failure€to€locate€Mr.€Lestz€within€the€applicableĻtime€frame€might€appear€to€be€ineffective€assistance€of€trialĻcounsel,€the€State€points€out€that€such€a€claim€is€thriceĻprocedurally€barred,€as€follows:Ģą  ą(1)ą ` ąIn€his€first€Rule€3.850€motion€(filed€October€15,€1990),Š $+t&. ŠSwafford€alleged€that€his€trial€counsel€rendered€him€ineffectiveĻassistance€in€some€ņ ņ15ó ó€respects,€but€did€ņ ņnotó ó€complain€of€counsel'sŠ \¬ Šfailure€to€investigate€other€potential€œsuspects.€€ņņSwafford€v.Š $t ŠDugger,€óó569€So.€2d€1264,€1267€(Fla.€1990)[See€Rule€3.850€motion,Š Ü , Šclaims€III€and€IV,€pages€44„78].€€The€failure€to€raise€the€issue€inĻthe€prior€Rule€3.850€motion€constitutes€an€abuse€of€process.€ĻņņFoster€v.€Stateóó,€614€So.€2d€455,€459€(Fla.€1992);€ņņSmith€v.€Stateóó,Š ģ<  Š453€So.€2d€388€(Fla.€1984).€›Ģą  ą(2)ą ` ąIt€is€procedurally€barred€because€such€a€claim€ofŠ P   Šineffective€assistance€was€not€properly€raised€in€the€subjectĻ(third)€Rule€3.850€œmotion.€€The€only€mention€of€anything€close€isĻthe€following:€€"When€viewed€in€conjunction€with€other€evidenceĻnever€presented€because€of€the€Stateššs€discovery€violations€and/orĻtrial€counselššs€deficient€performance,€there€can€be€no€questionĻthat€his€conviction€cannot"€stand.€€(Motion€at€18).€€The€StateĻcontends€that€this€passing€reference€to€one€prong€of€an€ineffectiveĻassistance€of€counsel€claim€is€wholly€insufficient€to€put€thisĻissue€before€the€court.›Ģą  ą(3)ą ` ąIt€is€procedurally€barred€because€there€has€been€noŠ #X$ Špresentation€of€evidence€sufficient€to€meet€the€materiality€prongĻā āof€the€ņņœStricklandóó׃%ׯ ƒ #ĆŻņņŚ  Ś18Ś  ŚóóŻ  Ż×  כ€ineffective€assistance€standard.€€ņņSee€Mills€v.Š `&°!( ŠState,óó€684€So.€2d€801,€œ804›€n.4€œ(Fla.›€1996).œ×ƒ(ׯ ƒ #ĆŻņņŚ  Ś19Ś  ŚóóŻ  Ż×  כŠ ° Šā āņ ņII.€Collateral€Counsel.Š hø Šó óą  ąSwafford's€first€Rule€3.850€motion€was€filed€on€October€15,Š 0€ Š1990.€œ(T›€330).€€It€alleged€that€the€subject€VCSO€reports,€includingĻthe€reports€of€July€26,€1982€and€January€31,€1983,€had€not€beenĻprovided€at€trial€in€violation€of€ņņBrady€v.€Maryland.óó׃/Šׯ ƒ #ĆŻņņŚ  Ś20Ś  ŚóóŻ  Ż×  ׀€Thus,€it€isŠ 4 „  Šclear€that€as€of€October€15,€1990,€Swafford's€collateral€counselĻhad€the€information€contained€in€the€VCSO€reports€pertinent€toĻlocating€Mr.€Lestz.œ×ƒb ׯ ƒ #ĆŻņņŚ  Ś21Ś  ŚóóŻ  Ż×  כ€€Consequently,€if€Mr.€Lestz€could€have€beenŠ D”  Šlocated€with€the€exercise€of€due€diligence€based€œupon›€theĻinformation€in€the€VCSO€reports,€Swafford€had€until€October€15,Ļ1992€to€file€his€instant€3.850€motion.׃1* ׯ ƒ #ĆŻņņŚ  Ś22Ś  ŚóóŻ  Ż×  ׀€œņņSee€Swafford›€v.€State,óó€679Š H˜ ŠSo.€2d€at€739.Ģą  ąThe€State€contends€that€the€evidence€developed€at€theĻevidentiary€hearing,€and€set„out€hereinabove,€overwhelmingly€showsŠ XØ Šthat€Mr.€Lestz€could€have€been€located€prior€to€October€15,€1992,Ļif€collateral€counsel€had€exercised€due€diligence.€€To€the€extentĻthat€the€failure€to€locate€Mr.€Lestz€within€the€applicable€timeĻframe€might€be€ineffective€assistance,€the€State€points€out€thatĻthere€is€no€right€to€effective€collateral€counsel.€€ņņœLambrix›€v.Š ` ° ŠState,óó€698€So.€2d€œ247,›€248€(Fla.€1996).€€Neither€is€there€any€legalŠ  h  Šbasis€for€relief€from€the€time€bar€based€on€a€claim€of€excusableĻneglect€or€delay€due€to€collateral€counsel's€work€load€and/orĻstaffing€shortages,€if€any.œ×ƒ7ׯ ƒ #ĆŻņņŚ  Ś23Ś  ŚóóŻ  Ż×  כ€œŠ (x  Šą  ąThe€truth€of€the€matter€is€that€collateral€counsel€did€notĻneed€to€hire€a€"tracing"€agency€to€find€Mr.€Lestz.€€All€he€neededĻto€do€was€to€send€his€investigator€to€the€address€in€the€VCSOĻreport€and€inquire.€€That€address€was€in€a€small€town€seven€milesĻfrom€Elkville›€where€Mr.€Lestz€had€lived€for€five€or€six€years.€€Mr.ĻLestz€had€an€Illinois€driverššs€license€with€that€address€on€it,€andĻhe€had€car€titles€in€his€name€with€that€address€on€them.€€He€hadĻbeen€imprisoned€in€Illinois.€€Thus,€any€reasonably€prudent€attorneyĻwould€have€soon€realized€that€Mr.€Lestz€would€likely€be€found€in€ĢIllinois,€and€that€the€South€Oak€Street€address€was€a€good€place€toĻbegin€looking€for€him.œ×ƒ9īׯ ƒ #ĆŻņņŚ  Ś24Ś  ŚóóŻ  Ż×  כŠ Œ$Ü& Šą  ąFurther,€collateral€counsel€could€have€obtained€theĻinformation€from€the€federal€prison€files.€€Had€he€examined€them,Ļhe€would€have€soon€learned,€at€a€minimum,€the€name€and€address€ofĻMr.€Lestz's€probation€officer€(who€knew€where€Lestz€was);€the€nameĻ(and€most€likely€the€address)€of€Mr.€Lestz's€brother;€and,€theĻaddress€of€Mr.€Lestz's€residence€while€he€was€on€probation.€€AnyĻone€of€those€pieces€of€information€would€have€led€straight€toϜElkville›,€Illinois,€a€town€of€104€people€(in€1990).œ×ƒ;ׯ ƒ #ĆŻņņŚ  Ś25Ś  ŚóóŻ  Ż×  כŠ d“  Šą  ąThroughout€the€entire€period€at€issue€„€October€15,€1990€toĻOctober€15,€1992€„€Mr.€Lestz€was€living€at€a€residence€three€milesĻfrom€œElkville›.€€He€owned€and€operated€a€pest€control€businessĻthere,€and€had€for€many€years.€€He,€his€wife,€his€daughter,€and€hisĻbrother€all€lived€in€that€small€town.€€His€brother€was€well€knownĻat€the€bank,€having€signed€Mr.€Lestz's€car€and€business€loans€as€a€Ģguarantor.׃g2ׯ ƒ #ĆŻņņŚ  Ś26Ś  ŚóóŻ  Ż×  ׀€With€these€substantial,€lengthy€œcontacts›€andŠ h Šinteraction€with€that€small€community,€there€is€no€reasonableĻpossibility€that€a€diligent€attorney€would€not€have€found€Mr.ĻLestz,€and€found€him€quickly.€€Indeed,€one€of€Swafford's€collateralŠ !l" Šattorneys€testified€that€when€a€person€has€a€stable€job,€a€carĻloan,€and€a€driver's€license€it€œis›€œ"very,›€very€easy€to€find€peopleĻin€the€œcountry."›€œ(T€375›,€377).€€He€added€that€he€would€"try€andĻfind€out€where€is€his€family€from,€where€does€this€guy€hang€œout€.Ļ.€.€.›€œon›€the€assumption€that€he's€going€to€try€and€go€back€to€whatĻhe€œknows€€.€.€.."›€œ(T›€371).€€If€collateral€counsel€had€looked€at€Mr.ĻLestz's€federal€prison€file,€he€would€have€found€out€where€hisĻfamily€was€from.€€Further,€the€VCSO€report€indicated€that€Mr.€LestzĻwas€from€that€small€town€in€œIllinois€„›€all€counsel€had€to€do€wasĻcheck€to€see€if€he€had€gone€back.€€Collateral€counsel€knew€how€toĻfind€Mr.€Lestz;€he€simply€failed€to€do€it.Ģą  ąThus,€as€the€trial€court€found,€had€the€information€containedĻin€the€VCSO€reports€been€followed€up€on,€Mr.€Lestz€could€have€beenĻlocated€by€collateral€counsel€in€time€to€raise€the€instant€claimsĻin€1992,€rather€than€in€1994.€€œThus,›€any€claim€that€the€informationĻcontained€in€the€alleged€affidavit€of€Mr.€Lestz,€or€any€providedĻduring€the€1997€evidentiary€hearing,€was€newly€discovered€evidenceĻfails.Ģą  ąUnder€the€circumstances€of€this€case,€it€is€clear€that€eitherĻtrial€or€collateral€counsel€could€have€found€Mr.€Lestz€if€they€hadĻdiligently€searched€for€him.€€Thus,€Swafford€has€failed€to€meet€theĻthreshold€requirement,€and€his€claim€of€newly€discovered€evidenceĻfails.€This€Court's€consideration€of€œthis€case€should€end€at€thisĻpoint.›€€œņ ņņņŠ $+t&. ŠSecondary›€Requirement€„€No€œAcquittaló ó:óó›Š ° ŠÓӜą  ąAssuming€arguendo€that€Swafford€met€the€threshold€requirement,ĢĢÓÓhe€is€entitled€to€no€relief€because€he€cannot€meet€the€secondĻrequirement.€ĢÓÓą8  ąIf€the€trial€court€determines€that€Lestzššs€statement€isĻnewly€discovered€evidence,€it€must€then€determine€whetherĻthe€statement,€in€conjunction€with€the€evidenceĻintroduced€in€Swaffordššs€first€rule€3.850€motion€and€theĻevidence€introduced€at€trial,€would€have€probablyĻproduced€an€acquittal.ą Ą ąŠŖś Š Š  ŠĢÓÓSwafford,€679€So.€2d€at€739.€€The€evidence€Swafford€claims€is€newlyĻdiscovered€is€not€such€as€would€have€probably€produced€anĻacquittal.€€That€determination€does€not€change€when€that€evidenceĻis€considered€"in€conjunction€with€the€evidence€introduced€inĻSwafford's€first›€Rule€3.850€motion€and€the€evidence€introduced€atĻtrial."€œņņId.óó›Š ² Šą  ąIt€is€important€to€remember€that€all€of€Swafford's€claims,Ļincluding€œthe›€claim€about€Mr.€Walsh,€have€been€previously€summarilyĻdenied€by€the€trial€court,€and€those€rulings€have€been€affirmed€byĻthis€Court.€€See€ņņSwaffordóó,€569€So.€2d€œ1264›€(Fla.€1990);€ņņSwaffordóó,Š n ¾! Š636€So.€2d€1309€(Fla.€1994).€€The€"new"€Lestz€statement€is€the€onlyĻreason€this€matter€is€back€before€this€Court.€€Therefore,€shouldĻthis€Court€find€that€the€new€Lestz€statement,€as€established€duringĻLestz's€testimony€at€the€evidentiary€hearing,€contains€informationĻof€little€or€no€significance,€there€is€no€need€to€again€considerĻā āthe€allegations€offered€in€Swafford's€first€3.850€€motion€or€theŠ ‚*Ņ%- Ševidence€admitted€at€trial.œ×ƒ?ׯ ƒ #ĆŻņņŚ  Ś27Ś  ŚóóŻ  Ż×  כŠ ° Šā āą  ąœAs€pointed€out€earlier,€this›€Court€œspecified€that€the€remandĻwas€based€on€the€allegation€in€the€CCR„prepared€affidavit€thatĻWalsh€had€at€the€Shingle€Shack€€a€.38€caliber€hand€gun€"at€or€nearĻthe€time€that€the€murder€weapon€was€discovered€in€that€locale."€Ļ679€So.€2d€at€736.€€However,€Mr.€Lestz's€testimony€at€the€hearingĻdid€not€establish€that€allegation.€€ņņSee€supra€óótext,€at€40„41.€Š ø  ŠMoreover,€Mr.€€Lestz€did€not€testify€to€most€of€the€things€set€outĻin€the€CCR„prepared€affidavit€which€was€the€basis€for€the€hearing.€ĻThus,€there€is€no€additional€evidence€of€any€significance€beyondĻwhat€Swafford's€trial€and€collateral€attorneys€had€no€later€thanĻthe€first€3.850€proceeding€(October,€1990).€€Having€previouslyĻdetermined€that€that›€evidence€was€insufficient€to€afford€SwaffordϜpostconviction›€relief,€this€Court€should€reject€the€instant€claimĻand€affirm€the€trial€court's€denial€of€Swafford's€third€3.850Ϝmotion.›Ģą  ąMoreover,€in€the€alternative,€the€trial€court€made€briefĻfindings€on€the€probability€of€an€acquittal.€€Judge€œHutcheson›€foundĻthat€Mr.€Lestz's€statements€as€reflected€in€the€police€reportsĻSwafford€introduced€into€evidence€at€the€hearing€"contained€manyĻinconsistencies€and€œ.€.€.€had›€that€testimony€been€presented€œ.€.€.›Ļit€would€not€have€probably€resulted€in€an€acquittal€given€theŠ Ų'(#* Šstrong€case€the€state€had€against€Mr.€Swafford."€€(R€287).€€ThisĻconclusion€is€well„supported€by€the€evidence.Ģą  ąMr.€Lestz€"never€referred€to€the€killing€of€the€female,"€norĻdid€he€imply€that€Mr.€Walsh€may€have€killed€Brenda€Rucker€untilĻafter€the€investigator€put€the€specifics€of€the€Rucker€murderĻbefore€him.€€œ(T›€581).€€Neither€did€he€ever€tell€the€police€anythingĻabout€the€Shingle€Shack,€œ(T›€570),€much€less€that€Mr.€Walsh€mightĻhave€disposed€of€gun(s)€there,€or€at€any€other€topless€bar€onĻFebruary€14,€1982.€€œ(T›€530„531).€€Mr.€Lestz€failed€the€firstĻpolygraph,€and€repeatedly€told€inconsistent€stories€during€theĻsecond€interview.€€œ(T›€539„540).€€His€motive€was€to€retaliateĻagainst€Mr.€Walsh€for€attacks€which€he€claimed€Mr.€Walsh€had€madeĻagainst€him.€€œ(T›€79„80).€€Also,€he€thought€that€Mr.€Walsh€mightĻcome€after€him€for€having€reported€the€attack(s).€€œ(T›€78„80).€ĻMoreover,€Mr.€Lestz€had€been€institutionalized€for€psychologicalĻproblems€several€times,€(Appendix€œB›€at€œ2),›€and€Mr.€Levi€describedĻhim€as€"crazy."œ×ƒAׯ ƒ #ĆŻņņŚ  Ś28Ś  ŚóóŻ  Ż×  כ€€€œ(Appendix€C›€at€œ15).›€€œCertainly,›€Mr.€Lestz'sŠ pĄ  Šselective€memory,€and€other€serious€problems€at€the€evidentiaryĻhearing,€further€reduced€his€credibility.€€œ(ņņSeeó󛀜T›€œ175„179).›Š Č"$ Šą  ąIt€is€clear€that€the€"new€Lestz€statement"€has€no€realĻsignificance€in€terms€of€exculpating€Swafford€of€Mrs.€Rucker'sĻmurder.€€The€first€3.850€and€trial€evidence€have€already€been€heldŠ Ų'(#* Šinsufficient€for€that€purpose.€€Thus,€this€Court€need€go€no€furtherĻwith€its€analysis€in€this€case,€as€nothing€added€to€nothing€isĻstill€nothing.€€The€trial€court's€order€should€be€affirmed.Ģņ ņņņTrial€Evidenceóó:ó óŠ “  Šą  ąAssuming€arguendo€that€the€trial€evidence€should€again€beĻconsidered,€it€clearly€does€not€benefit€Swafford.€€œAs›€the€trialĻcourt€found,€the€State's€case€against€Swafford€was€"strong."€ĻIndeed,€it€was€overwhelming!€€The€evidence€included:€œ€Swafford›€wasĻfamiliar€with€the€area€in€which€the€victim€was€abducted€and€whereĻher€body€was€found;€he€was€driving€right€by€the€place€from€whichĻthe€victim€was€abducted€at€precisely€the€time€at€which€she€wasĻtaken;€the€place€where€the€body€was€found€was€close€to€whereĻSwafford€was€staying;€Swafford's€gun€killed€the€victim,œ×ƒCׯ ƒ #ĆŻņņŚ  Ś29Ś  ŚóóŻ  Ż×  כ€and€it€wasŠ Ü, Šrecovered€from€Swafford€the€night€after€the€murder€when€heĻdiscarded€it€upon€police€arrival€at€the€scene€where€Swafford€hadĻthreatened€others€with€it;€Swafford€bought€a€newspaper€and€calledĻhis€companions'€attention€to€an€article€about€the€victim's€œmurder;›ĻSwafford€told€these€companions€on€the€trip€back€to€Tennessee€thatĻhe€was€mad€because€he€had€lost€his€gun;€Swafford€admitted€his€guiltĻin€the€Rucker€homicide€when€he€subsequently€asked€another€man€toĻparticipate€with€him€in€the€commission€of€another€abduction,€rape,Š <&Œ!( Šand€murder€(bullets€into€the€back€of€the€head)€of€a€woman€and€whenĻasked€wouldn't€that€bother€him,€replied,€"you€just€get€used€to€it;׃Eׯ ƒ #ĆŻņņŚ  Ś30Ś  ŚóóŻ  Ż×  ׊ \¬ ŠSwafford€proceeded€to€select€a€victim,€instructed€his€companionĻwhat€to€do,€and€"drew€a€gun,"€(at€which€point€the€companion€refusedĻto€participate,€and€so,€the€plan€was€abandoned);€and,€while€escapedĻfrom€the€authorities€who€were€holding€him€for€the€victim's€murder,ĻSwafford€took€hostages€at€a€local€hospital,€threatened€to€killĻthem,€and€told€a€newspaper€reporter€that€he€was€a€murderer!€€Thus,Ļthere€is€no€reasonable€probability€that€the€alleged€evidenceĻregarding€Mr.€œWalsh€„›€which€falls€far,€far€short€of€connecting€himĻto€the€subject€œmurder€„›€would€have€made€a€difference€in€the€outcomeĻof€the€trial,€much€less€that€it€would€have€produced€an€acquittal!€Ļœņ ņņņFirst›€Rule€3.850óó:ó óŠ Ą Šą  ąAssuming€arguendo€that€Swafford's€alleged€evidence€from€hisĻfirst€Rule€3.850€motion€should€also€be€considered,€it€fails€toĻprovide€a€basis€for€the€relief€Swafford€seeks.€€As€Judge€HammondĻruled€on€that€first€motion€(with€regard€to€the€same€evidence€whichĻis€asserted€in€the€third€3.850€œmotion),›€"Swafford€has€failed€toĻshow€that€the€hearsay€information€on€other€suspects€was€admissibleĻ.€.€.."€€ņņSwafford€v.€Stateóó,€679€So.€2d€at€737„738.€€Neither€did€heŠ $ą& Šshow€that€its€omission€was€prejudicial€to€him.€€œņņId.ó󛀀To€date,Š H&˜!( ŠSwafford€still€has€not€demonstrated€that€œany›€of€the€"otherŠ (P#* Šsuspects"€evidence€would€have€been€admissible€at€trial€or€that€itsĻomission€prejudiced€him.€€The€State€contends€that€he€cannot€showĻeither.Ģą  ąFor€example,€there€was€no€basis€for€admission€of€the€ArkansasĻpolice€officer's€alleged€opinion€that€Mr.€Walsh€resembled€theĻsketch€of€the€suspect€in€the€Rucker€BOLO.€€Indeed,€at€Swafford'sĻtrial,€the€court€found€that€the€sketch€of€the€alleged€perpetratorĻwas€not€admissible€because€Mr.€œSeiler›€(the€person€who€observed€andĻdescribed€the€perpetrator€to€the€police)€could€not€state€whetherĻthe€sketch€accurately€represented€the€person€that€he€had€seen.€Ļœ(TR׃rׯ ƒ #ĆŻņņŚ  Ś31Ś  ŚóóŻ  Ż×  כ€1301„1302).€€Thus,€it€is€highly€unlikely€that€any€comparisonŠ hø Šof€the€BOLO€sketch€with€Mr.€Walsh€would€have€been€permitted.€ĻAnother€example€is€Investigator€Buscher's€opinion€(as€stated€in€hisĻaffidavit€for€search€warrant)€that€the€cigarette€burns€on€Mr.ĻLestz's€body€"strongly€resemble€those€burns€found€on€the€body€ofĻBrenda€Rucker."€€Obviously,€such€an€opinion€would€not€be€admissibleĻin€the€absence€of€a€finding€that€Buscher€was€an€expert€in€cigaretteĻburns.€€Swafford€has€neither€alleged,€nor€shown,€him€to€be€such.€ĻNeither€would€Volusia€County€investigators'€opinions€that€Mr.€LestzĻwas€a€"significant€witness"€or€that€Mr.€Walsh€was€a€significantĻsuspect€in€the€Rucker€homicide€be€admissible.€€At€trial,€the€courtĻrejected€the€defense's€attempt€to€introduce€the€specifics€of€theĻBOLO€description€on€the€theory€that€"the€police€felt€sufficientŠ x)Č$, Šconfidence€in€it€to€issue€a€BOLO:"ĢÓÓą8  ąHow€is€the€police's€confidence€relevant?€€If€it€wereĻrelevant,€a€whole€lot€of€other€things€would€probably€comeĻin€œfrom›€the€State's€point€of€view.€.€.€€I€feel€it's€notĻrelevant€what€the€police€believe€or€think.€€If€it€wereĻtrue,€that's€what€they€believe,€I€think€they€could€comeĻin€and€testify€as€to€whoever€they€think€was€guilty€andĻfor€whatever€reason€they€come€to€the€conclusion€andĻimpose€that€upon€the€jury.€€They€don't€have€the€abilityĻto€do€that.€€They€are€not€entitled€to€do€that€nor€areĻthey€entitled€to€come€to€some€conclusions€and€expressĻthose€as€to€who€they€believe€œis›€not€guilty€or€as€toĻconclusions€they€have€about€a€description.€€That€is,Ļtheir€thought€processes€based€upon€hearsay€received€byĻthem€is€not€legitimate€evidence€of€a€case€of€this€nature.Š Š Š  ŠĢą8  ąThe€fact€that€they€may€have€thought€any€number€ofĻdifferent€people€may€have€been,€what€they€thought€is€notĻimportant.€€What€is€important€are€the€facts€in€the€case,Ļwhat€was€seen,€what€was€observed,€what€was€heard.€€ThoseĻare€the€facts,€not€necessarily€the€conclusions€that€otherĻpersons€may€have€reached€concerning€that,€except€theĻconclusions€the€jury€reaches.Š Š Š  ŠĢÓÓ(TR€1296„1297).€€There€are€many€other€factual€allegations€containedĻin€the€police€reports€which€formed€the€basis€for€the€first€3.850,Ļand€Swafford€has€utterly€failed€to€offer€any€justification€forĻadmissibility€of€œthem.›Ģą  ąMoreover,€had€they€all€been€admissible,€they€still€do€notĻundermine€confidence€in€the€outcome€of€Swafford's€trial.€€None€ofĻthe€alleged€"evidence"€against€Mr.€Walsh,€which€is€composed€chieflyĻof€Mr.€Lestz's€incredible€allegations€made€through€the€attorneyĻwhich€he€did€not€have,œ×ƒGׯ ƒ #ĆŻņņŚ  Ś32Ś  ŚóóŻ  Ż×  כ€begins€to€approach€the€wealth€of€credibleŠ ö&F") Ševidence€establishing€that€Swafford€brutally€raped€and€murderedŠ ¢(ņ#+ ŠMrs.€Rucker.€€œņņSee›€œsupra€text,€ató󛀜55„56.›€€Neither€does€considerationŠ ° Šof€the€trial€evidence,€the€first€3.850€"evidence,"€and€the€allegedĻnewly€discovered€evidence€result€in€a€determination€that€admissionĻof€same€would€have€probably€produced€Swafford's€acquittal€of€theϜmurder.›€€Thus,€Swafford€is€entitled€to€no€relief,€and€thisĻHonorable€Court's€consideration€of€this€appeal€should€go€noĻfurther.̜ņ ņņņĢ›ą@0 0 ģąSwafford's€Unauthorized€œArgumentsóóó óˆŠ 8ˆ  Šą  ąIn€his€initial€brief,€Swafford€purports€to€raise€some€fiveĻclaims.€€The€State€submits€that€all€five€are€unauthorized€by€thisĻHonorable€Courtššs€remand.€€Since€they€are€unauthorized,€they€areĻprocedurally€barred.€€However,€in€an€abundance€of€caution,€theĻState€hereinafter€more€particularly€responds€to€the€unauthorizedĻclaims:Ģņ ņņņą@ ģąSwaffordššs€Argument€Ió óóóˆŠ X Šņ ņņņAllegations€of€False€Argument:óóŠ Š   Šó óą  ąSwafford€claims€that€the€State's€1990€response€to€his€firstŠ ˜!č" Š3.850€motion€misled€the€courts.€(IB›€at€41).€€He€quotes€theĻstatement€that€Mr.€Walsh,€Mr.€Levi,€and€Mr.€Lestz€"were€'thoroughlyĻinvestigated€and€discarded€as€suspects,'"€and€claims€that€at€theĻ1997€œhearing,›€œevidence›€showed€that€"the€'further€investigation'Ļpolice€said€was€warranted€on€January€31,€1983,€never€occurred."€€Ļ(œIB›€at€41).€He€then€claims€that€this€alleged€misstatement€was€soŠ  +š&. Šserious€that€it€would€œprevent›€"some€kind€of€procedural€barĻprecluding€consideration€of€the€merits€of€Mr.€Swafford'sĻconstitutional€claims€.€.€.."€(IB€at€42).€€Swafford's€position€isĻabsurd.Ģą  ąThe€authorities€œinvestigated›€Mr.€Walsh€and€company€for€someĻten€months€after€the€murder.€œ(T›€32„33,€35).€€The€thoroughĻinvestigation€included€œinterviews›€with€Mr.€Walsh€(at€least€once),ĻMr.€Levi€(at€least€twice),€and€Mr.€Lestz€(at€least€three€times),Ļpolygraphs,€bodily€fluid€samples,€fingerprint€comparisons,€andĻsearch€and€testing€of€personal€property.€œ€The›€investigation€ofĻthese€persons€ended€some€five€months€prior€œto€the€commencement€of›Ļany€investigation€of€œSwafford.›€€Moreover,€the€further€investigationĻreferred€to€is€simply€a€third€interview€of€Mr.€Levi.׃,ׯ ƒ #ĆŻņņŚ  Ś33Ś  ŚóóŻ  Ż×  ׀(IB€at€42).Š Ą ŠThus,€it€is€clear€that€the€investigation€as€to€Mr.€WalshĻterminated,€as€Investigator€Buscher€testified€at€the€1997€hearing,Ļand€Captain€Burnsed€agreed,€because€"[œt]here›€was€no€evidence€toĻsupport€it."€œ(T›€154,€542).€€The€State€submits€that€the€record€wellĻsupports€the€1990€representation€that€Mr.€Walsh€and€company€wereĻthoroughly€investigated€and€discarded€as€suspects.Ģą  ą€œMoreover,€although›€Swafford€produced€Mr.€Levi€at€the€1997Ļhearing,€he€revealed€nothing€new€which€incriminated€Mr.€Walsh€orŠ  &p!( Šexonerated€Swafford.€€Thus,€any€failure€to€œreinterview›€him€did€notĻprejudice€Swafford€in€any€manner,€and€therefore,€even€if€theĻState's€"thorough€investigation"€statement€is€considered€deficientĻin€that€Mr.€Levi€was€not€interviewed€a€third€time,€sameĻunquestionably€was€not€prejudicial€to€Swafford€and€can€hardlyĻexcuse€the€procedural€bar€he€seeks€to€avoid.€€Ģą  ąOf€equal€absurdity€is€the€claim€that€the€failure€to€discloseĻthat€a€third€interview€of€Mr.€Levi€did€not€occur€constitutes€aĻņņBradyóó€violation.€€First,€any€such€ņņBradyóó€claim€is€procedurallyŠ `  Šbarred€because€it€was€not€raised€below.€ņņœSteinhorst›€v.€Stateóó,€œ412›Š Č МSo›.€2d€œ332›€(Fla.€œ1982).›€€Assuming€no€procedural€bar,€SwaffordĻcannot€establish€a€ņņBrady€óóviolation.€€To€do€so,€Swafford€must€show:€Š ,| ŠÓÓą8  ą(1)€the€government€possessed€evidence,€includingĻimpeachment€evidence,€favorable€to€the€defense;€(2)€theyĻdid€not€possess€the€evidence€nor€could€have€obtained€itĻwith€reasonable€diligence;€(3)€the€prosecution€suppressedĻthe€favorable€evidence;€and€(4)€had€the€evidence€beenĻdisclosed€to€the€defense,€a€reasonable€probability€existsĻthat€the€trial€outcome€would€have€been€different,€i.e.,Ļthe€evidence€was€material.Ó“ÓŠ Š Š  ŠņņUnited€States€v.€Arnoldóó,€117€F.œ3d›€1308,€1315€(œ11th›€Cir.€1997).€€HeŠ j ŗ! Šhas€failed€to€establish€these€elements.Ģą  ąFirst,€Swafford€has€not€alleged,€nor€shown,€that€the€failureĻto€interview€Mr.€Levi€for€a€third€time€constitutes€"evidence"Ļwithin€the€meaning€of€ņņBradyóó.€Second,€as€has€been€demonstratedŠ &'v") Šhereinabove,€he€cannot€show€that€the€failure€to€inform€him€that€Mr.ĻLevi€was€not€œreinterviewed›€was€favorable€to€him.€Neither€can€heĻshow€that€he€could€not€have€obtained€that€information€withŠ 6,†'/ Šreasonable€diligence€„€after€all,€he€had€the€police€report€whichĻidentified€the€officers,€and€he€could€have€asked€them€whether€theĻfurther€investigation€occurred.€€Moreover,€he€could€have€locatedĻMr.€Levi€years€ago€and€asked€him.€ņņSeeóó€Statement€of€œthe€Case€and€theŠ “  ŠFacts€ņņsupra,óó€at›€œ11„12.›€€Finally,€he€cannot€show€that€had€he€beenŠ l ¼ Štold€that€Mr.€Levi€had€not€been€interviewed€a€third€time,€thatĻinformation€would€have€probably€resulted€in€a€different€outcome€atĻtrial.Ģą  ąFinally,€Swafford's€ņņœKyles›€v.€Whitleyóó,€115€œS.Ct›.€1555€(1995)Š (x  Šclaim€piggybacked€onto€the€utterly€deficient€ņņBradyóó€claim€isŠ ą0 Šlikewise€devoid€of€merit.€€It€is€also€procedurally€barred€becauseĻit€was€not€raised€in€the€lower€court.€ņņœSteinhorst›€v.€State,€œóó412›€So.Š D” Š2d€œ332›€(Fla.€œ1982).›€€Further,€even€had€all€of€the€allegedlyĻexculpatory€evidence€and€information€been€heard,€it€would€have€madeĻno€difference€in€the€outcome€of€the€trial.€€The€evidence€ofĻSwafford's€guilt€was,€and€is,€overwhelming!€€œņņSeeó󛀜ņņsupra€text,€ató󛀜55„Š P Š56.€ÓÓņņņ ņŠ ø  ŠÓ  ÓĢĢÓÓSwafford's›€Argument€œIIĢÓ  ÓBradyóó:ó ó›Š $n% Šą  ąThis€is€merely€a€third€presentation€of€Swafford's€originalĻņņBradyóó€claim.€€This€Court€has€twice€rejected€this€claim,€and€if€thisŠ ’'ā") Šissue€is€reached€by€this€Court,€it€must€do€so€yet€œagain.ņņ€€SeeŠ J)š$+ ŠSwafford,óó€679€So.€2d€736,€739€(Fla.€1996).›Š +R&- Šą  ąTo€the€extent€that€Swafford€again€claims€that€cumulativeĻanalysis€is€required€under€ņņœKyles›óó,€the€State€reasserts,€andŠ \¬ Šincorporates€herein,€its€argument€in€the€preceding€point.€BecauseĻthere€is€no€ņņBradyóó€violation,€there€is€no€entitlement€to€ņņKyles'óóŠ Ą  Šreview.Ģą  ąNonetheless,€had€Swafford€met€his€burden€to€demonstrate€newlyĻdiscovered€evidence,€he€would€have€received€a€ņņKylesóó„like€cumulativeŠ Š  Šreview€under€this€Court's€remand€opinion.€His€efforts€to€circumventĻthis€Court's€holding€and€obtain€such€a€review€without€meeting€theϜthreshold›€requirement€must€fail.̜ņņņ ņĢą@ˆˆģąSwafford's›€Argument€œIIIˆĢJudicial€Noticeóó:ó ó›Š l Šą  ąSwafford€claims€that€the€trial€judge€erred€in€declining€toĻtake€judicial€notice€of€two€reports€he€designated€the€"œOverton›ĻCommission€Report"€and€the€"œShevin›€Report."€(IB€œat€72„76).›€€HeĻclaims€that€they€were€relevant€to€the€issue€of€collateral€counsel'sĻdue€diligence€between€October,€1990€and€April,€1994.€(IB€œat€72„73).›€Ļą  ąFlorida€Statutes€šš90.202€provides€which€matters€"may"€beĻjudicially€noticed.€Swafford€claims€that€the€reports€he€wanted€theĻtrial€judge€to€admit€into€evidence€fall€under€subsections€(5)€andĻ(6)€of€that€statutory€provision.€€Those€subsections€provide:ĢÓÓą8  ą(5)ą ` ąOfficial€actions€of€the€legislative,€executive,€and€œńńŠš)@%,Š Š  ŠńńńńĢńńńńŠ œ+ģ&. Šńńńńą  ąńńjudicial›€departments€of€the€United€States€and€of€any€state,€œńń¼ą  ąńńterritory,›€or€jurisdiction€of€the€United€States.ĢĢą8  ą(6)ą ` ąRecords€of€any€court€of€this€state€or€of€any€courtŠ 2‚ Šof€record€of€the€United€States€or€of€any€state,Ļterritory,€or€jurisdiction€of€the€United€States.Š Š Š  ŠĢÓÓšš90.202(5)&(6),€Fla.€Stat.€(1997).Ģą  ąThe€State€contends€that€Swafford€is€not€entitled€to€relief.€ĻFirst,€the€language€of€the€statute€makes€it€clear€that€the€decisionĻwhether€to€take€judicial€notice€is€a€discretionary€one.€€SwaffordĻhas€not€alleged,€much€less€demonstrated,€that€Judge€HutchesonĻabused€his€discretion€in€declining€to€take€judicial€notice€of€theĻreports.€The€State€asserts€that€the€judge's€decision€was€wellĻwithin€his€discretion€and€should€not€be€second„guessed.Ģą  ąSecond,€Swafford€utterly€failed€to€authenticate€the€reports.€ĻHis€attorney's€unsworn€allegations€that€the€reports€were€sanctionedĻby€this€Honorable€Court€are€insufficient.€€Likewise,€his€claim€thatĻthe€reports€were€stamped€in€by€this€Court's€Clerk€are€Ļinsufficient.€€Swafford€did€not€offer€a€certified,€or€sealed,€copyĻof€either€document.€€Without€such,€there€is€no€authentication.€€Ģą  ąNeither€did€Swafford€produce€a€scintilla€of€evidenceĻestablishing€that€the€reports€were,€in€fact,€"[œo]fficial›€actions€ofĻthe€.€.€.€judicial€departments€of€.€.€.€any€state€.€.€."€orĻ"[œr]ecords›€of€any€court€of€this€state€.€.€.."׃Šׯ ƒ #ĆŻņņŚ  Ś34Ś  ŚóóŻ  Ż×  ׀€œšš90.202(5),›€Fla.Š ö&F") ŠStat.€(1997).€€Indeed,€in€the€trial€court,€he€failed€to€so€much€as€Ļallege€that€the€subject€reports€fell€within€any€specific€provisionĻof€the€judicial€notice€statute.€(R€323„324,€485„490).€€Neither€didĻhe€contend,€as€he€does€now€for€the€first€time€on€appeal,€that€itĻwas€mandatory€for€the€trial€judge€to€take€judicial€notice€of€theĻreports.œ×ƒŃׯ ƒ #ĆŻņņŚ  Ś35Ś  ŚóóŻ  Ż×  כ€€Thus,€these€claims€are€procedurally€barred.€ņņ€SeeŠ  \  МSteinhorst›€v.€Stateóó,€œ412›€So.€2d€œ332›€(Fla.€œ1982
