Tosupporthisclaimofinnocence,Mr._Melendez_attorneyshaveuncoveredawealthof `  evidenceindicatingthatVernonJames,probablyinthecompanyoftwootherunknownmen,   committedthemurderofDelBaker.TheevidencethatVernonJamesparticipatedinthemurder 0  inanydegree(frommerelybeingpresenttoinflictingthefatalblows)ismorethanmerely  evidenceagainstVernonJames.ItisevidencethatisinconsistentwiththetestimonyofDavid P LunaFalconandJohn_Berrien_.TheevidencethatVernonJameswasthereconstitutes 0 impeachmentofthetestimonyofthetwowitnessesonwhomtheconvictionrests(EHTr.280). p Eventhetrialprosecutor,recognizedthisrelationshipbetweentheevidencelinkingVernon P JamestothemurderandthetestimonyofDavidLunaFalconandJohn_Berrien_Ԁ(EHTr.92).    Mr._Melendez_Ԁasserts,notonlyhisinnocence,buthisentitlementtoanewtrialonthe  p basisofthisevidenceimplicatingVernonJameswhichhisjurydidnothear.Thefactthatone   canestablishinnocenceandyetbedeniedanewtrialisafactnotlostonundersignedcounsel. @" Undersignedcounseldoescontestwhetherdueprocesscantrulypermitaninnocentmantobe  $ deniedanewtrial.However,undersignedcounseldoesnotbelievethatthiscaseisonethat `"& requiresthatquestiontobeaddressedbecauseunderFloridalawMr._Melendez_Ԁisentitledtoa #@( newtrialonthebasisoftheclaimspresentedinhismotiontovacate.Theseclaimsinclude:1) % * hisargumentthattheStateviolateddueprocessbynotdisclosingattrialandinthepost '`", convictionprocessevidencethatwasfavorabletoMr._Melendez_,eitherbecauseitwas (#. exculpatoryorbecauseitimpeachedtheStatescaseandwitnesses(_Lightbourne_Ԁv.State,742 0*%0 So.2d238(Fla.1999));2)hisargumentthattrialcounselrenderedconstitutionallydeficient +'2 performanceathistrial(_Provenzano_Ԁv.State,616So.2d428,43031(Fla.1993));and3)his  contentionofnewlydiscoveredevidenceofinnocenceunderJonesv.State,591So.2d911(Fla. @ 1991).Onthemerits,theseclaimsmustbeevaluatedcumulatively.Statev._Gunsby_,670So.2d   920(Fla.1996).Whentheproperanalysisisconducted,itisclearthatMr._Melendez_Ԁmustbe `  affordedatrialthatisatrueadversarialtestingwithinthemeaningoftheconstitutional  @ guarantee.      HoweverbecausethisisMr._Melendez_thirdmotiontovacatetovacate,hiscurrent `  counselmustestablishthattheStateprovidedcollateralcounselinthepreviousproceedings   exercisedduediligencebeforethemeritsarerequiredtobeconsidered.Jonesv.State,709So.2d 0  512,522(Fla.1998).Whenduediligenceisshown,thepresidingjudge mustevaluateallthe  admissiblenewlydiscoveredevidenceat[themostrecent]hearinginconjunctionwithnewly P discoveredevidenceatthepriorevidentiaryhearingandthencompareitwiththeevidencethat 0 wasintroducedattrial.Forthatreason,undersignedcounselwillfirstaddressthequestionof p priorcollateralcounselsdiligence.Hewillthentoturntothemeritsofhisclaims. P @= DUEDILIGENCE.     Duediligenceisalegalrequirementforfilingclaimspremiseduponevidencenot  p previouslyavailable.DuediligenceisnotexplicitlydefinedinFlorida3.850caselaw.   However,inStatev._Gunsby_,thisCourtfoundthatatrialattorneywhodidnotexercisedue @" diligenceattrialrendereddeficientperformanceunderthestandardenunciatedin_Strickland_Ԁv.  $ Washington,466U.S.668(1984).Thiscertainlysuggeststhatduediligenceisestablished `"& whereanattorneysperformancewasreasonableunderthe_Strickland_standard. #@(   Under_Gunsby_,duediligencewasnotamorestringentstandardthanthatsetforthin % * _Strickland_Ԁv.Washington.Alawyerwhowasnotdiligentwasfoundtohaverendereddeficient '`", performance.TheCourtdidnotleaveopenthepossibilitythatcounselcouldhavefailedtobe (#. diligent,butstillhaverenderedeffectiverepresentation.Thus,thecaselawdiscussing_Strickland_ 0*%0 immediatelybecomesrelevant.Diligencecanmeannomorethanisrequiredby_Strickland_. +'2 Thus,thewealthofcasesexplaininganddefiningthe_Strickland_standardprovideguidanceasto  whatataminimumconstitutesdiligence.The_Strickland_standardmakesitclearthattheanalysis @ isnottobeconductedwith2020hindsight,butinsteadfromthepointofviewofcounselatthe   timeheisconductinghisinvestigation.Under_Strickland_,thereisastrongpresumptionthat `  counselsperformancewasreasonable.Chandlerv.UnitedStates,218F.3d1305,1314(11th  @ Cir.2000)(inbanc).Thestandardforduediligenceshouldbenohighernoranylessdeferential    tocounsel. H" ThusthisCourt,inassessingtheduediligenceofcollateralcounselneedstoconsiderthe  ($ particularsituationinwhichcollateralcounselfoundthemselvesduringthecourseofthe h"& investigationandwhethercollateralcounsel,withoutthedistortingeffectofhindsight,performed #H(  theirdutiesreasonably. % *   Furtherguidanceofthemeaningofthephrase duediligencecanbeobtainedfromthe   FloridaSupremeCourtsanalysisin_Lightbourne_Ԁv.State.There,theCourtwasfacedwitha @ proceduralhistorysubstantiallysimilartotheproceedingsinMr._Melendez_case.LikeMr.   _Melendez_,Mr._Lightbourne_sfirstRule3.850motionwassummarilydeniedwithoutan `  evidentiaryhearing.Inthelate1980s,Mr._Lightbourne_ԀfiledasecondRule3.850motion,which  @ "focusedprimarilyonattackingthereliability"ofwitnesseswhotestifiedagainstMr.    _Lightbourne_.AnevidentiaryhearingwasorderedbytheFloridaSupremeCourt._Lightbourne_Ԁv. `  _Dugger_,549So.2d1364(Fla.1989).Aftertheevidentiaryhearingwasheld,reliefwasdenied   bythecircuitcourtandthatresultwasaffirmedonappeal._Lightbourne_Ԁv.State,644So.2d54 0  (Fla.1994).Laterin1994,Mr._Lightbourne_Ԁfiledathirdmotionforpostconvictionrelief.The  circuitcourtheldanevidentiaryhearingonthismotionanddeniedrelief.However,thecircuit P courtrefusedtohearthetestimonyofawitnessthatitfoundprocedurallybarredbecauseofa 0 wantofduediligence.TheFloridaSupremeCourtreversedandorderedanewevidentiary p hearing astoEmanuelstestimonyandforthetrialcourttoconsiderthecumulativeeffectofthe P posttrialevidenceinevaluatingthereliabilityandveracity_Chavers_andCarsonstrialtestimony  indeterminingwhetheranewpenaltyphasehearingisrequired,eitherunder_Lightbourne_s  p Bradyornewlydiscoveredevidenceclaims.742So.2dat249.     In_Lightbourne_,theFloridaSupremeCourtfoundthatthetestimonyofpriorcollateral @" counsel thattheyandtheirstaffhadbeendiligentlysearchingforEmanuelsince1989,withno  $ successrequiredmeritsconsiderationofEmanuelstestimony.742So.2dat246.TheCourt `"& concluded: #@( ` Inthiscasethereisconsiderableevidencethat_CCR_Ԁhadbeenactivelylookingfor % * Emanuel.Accordingtotherepresentationsmadetothecourtin1990hearings, H&!+ _CCR_Ԁwasexercisingduediligencesince1989tofind_Lightbourne_s_cellmates_ '`", from1981._CCR_Ԁhadbeensuccessfulinlocating_Carnegia_Ԁby1990,andboth '(#- CarsonandEmanuelwerefoundby1994. (#.  ` =>K>742So.2dat246. 0*%0   Here,Mr._Melendez_Ԁestablishedhisduediligenceata1996evidentiaryhearingsothathis   newlydiscoveredevidenceclaimwasconsideredanddeniedonthemeritsatthatpointintime. @ WhentheFloridaSupremeCourtaffirmedthedenialofthemerits,theCourtdidnotentertain   anyclaimthatMr._Melendez_Ԁhadnotbeendiligentinlocatingthenewevidence.Thedenialof `  themeritswasaffirmedinlightofcircuitcourtscredibilitydeterminations._Melendez_Ԁv.State,  @ 718So.2d746,748(Fla.1998).` [  2      ׀Thus,thecircumstancesarethesameasin_Lightbourne_.      Moreover,Mr._Melendez_Ԁpresentedtothiscourt,attheMayevidentiaryhearing, `  testimonyregarding_CCR_songoingdiligenceafterthe1996evidentiaryhearing._0 [  3      _ԀFollowingthe   1996hearing,theFloridaSupremeCourtaffirmed.Collateralcounselwasobligatedtoprepare 0  andfileafederalhabeaspetition.Inanticipationofproceedingsonthatpetitioninthesummer  of2000,newevidencesurfaced.InAugustof2000,Rosa_Greenbaum_,aninvestigatorwiththe P CapitalCollateralCounselfortheNorthernRegion(thesuccessorofficeto_CCR_),contacted 0 CodySmith,Mr._Melendez_trialinvestigator,todetermineifhehadmaintainedhisoriginaltrial p investigatorfile(EHTr.115,39697).Thiswasincaseitwasnecessarytointroduceoriginal P documentation.Mr.Smiththoughthisoriginalnoteswerepossiblyinhisstoragefacilityin  Lakeland,Florida(EHTr.398).Mr.SmithagreedtotraveltoFloridatodetermineifhehadany  p notes(EHTr.115).Coincidentally,Mr.Smithmadelunchplanswithhisfriendandformer   colleague,RogerAlcott,Mr._Melendez_trialattorney(EHTr.116).Duringtheirlunchmeeting, @" JudgeAlcottrealizedthatwhenherecentlycleanedouthisofficeandassumedhispositionon  $ thebenchhefoundsomeboxeswith"_Melendez_"writtenonthem(EHTr.309).JudgeAlcott `"&  turnedoverthosepartsofhisfile,whichincludedthetranscriptofthetapedstatementwith #@( *     VernonJames(EHTr.278279).CodySmithhadcompletelyforgottenthatsuchatranscript  existed(EHTr.132). @    Despitepriorrequestsforrecordsregardinghiscase,Mr._Melendez_ԀdidnotpossessRoger   AlcottstapedstatementofVernonJamespriortothefallof2000(EHTr.216;_Depo_.ofLeslie `  _Delk_Ԁat67).JudgeAlcottdidntrealizethathehadnotturnedthetranscriptoverbefore(EHTr.  @ 309). [  4      ׀GailAnderson,Mr._Melendez_priorcollateralcounselatthe1996evidentiaryhearing    testifiedthatshehadnodoubtthatthetranscriptwasnotincludedinMr._Melendez_filesbecause `  "thesearewordsdirectlyfromVernonJames,notthroughanotherperson,anditsimplyisnot   somethingyouwouldforget."(EHTr.261).Thus,thetranscriptofthetapedstatementqualifies 0  asnewlydiscoveredevidence.In_Provenzano_Ԁv.State,616So.2dat43031,theFloridaSupreme  Courtfoundthateventhoughanineffectiveassistanceoftrialcounselclaimhadpreviouslybeen P presentedanddenied,itcouldbepresentedagainwherethedocumentprovidingthebasisforthe 0 specificallegationhadnotbeenturnedoverinChapter119materials,andinfacthadbeen p withheld.TheSupremeCourtspecificallyindicatedthat_Provenzano_Ԁshouldbeput inthesame P positionhewouldhavebeeninifthefileshadbeendisclosedwhenfirstrequested.    Further,thetrialprosecutorhasnowtestifiedthathepossessedthetranscriptofthetaped  p statementconductedwithVernonJames(EHTr.87).Hestated, IcannotsithereandsayI   haveanindependentrecollectionofgivinganyparticulardocumenttoanybodyfrom_CCR_(EH @" Tr.88).EventhoughthetapewasveryrelevanttoMr._Melendez_priorRule3.850proceedings  inconnectionwithDwightWellstestimonyinthoseproceedings,itdidntoccurtoMr._Pickard_ @ todisclosetheexistenceofthetranscriptwhichestablishedthatVernonJamestoldRogerAlcott   thathehadalreadyinformedDwightWellsofhispresenceatMr.Bakerswhenthehomicide `  occurred._ [  5      _ԀMr._Pickard_stestimonyinthisregardwasspecifically, Ididntthinkaboutittotell  @ youthetruth(EHTr.90).      TheFloridaSupremeCourthasheldthat:  [_T]he_ԀStateisunderacontinuingobligation `  todiscloseanyexculpatoryevidence .Johnsonv._Butterworth_,713So.2d985,987(Fla.   1998)(emphasisadded);seealsoRobertsv._Butterworth_,668So.2d580(Fla.1996)(findingthat 8  Bradyobligationcontinuesinpostconviction).Againunder_Provenzano_,Mr._Melendez_Ԁshould  beputinthepositionhewouldhavebeeninhadthetranscriptbeendisclosedinatimelyfashion X eitherbytrialcounselorbytheprosecutor.InVenturav.State,673So.2d479(Fla.1996),the 8 FloridaSupremeCourtfoundthattheStatesfailuretodiscloserequestedChapter119materials x precludedthatapplicationofaproceduralbar:"TheStatecannotfailtofurnishrelevant X informationandthenarguethattheclaimneednotbeheardonitsmeritsbecauseofanasserted  proceduraldefaultthatwascausedbytheState'sfailuretoact." (x   Itisworthpausingtoaddressthetwofoldsignificanceofthetranscript:1)itprovides   thebasisforanineffectiveassistanceofcounselclaim;_ [  6      _Ԁand2)itcorroboratestheevidence H" presentedtothelowercourtin1996. [  7      ׀AsMs.Anderson,Mr._Melendez_1996collateralcounsel  explained: @ `  Well,ifthis,asthedocumentseemstoindicate,wasinMr.Alcott'sfile,it   certainlywouldhaveprovidedabasisforanineffectiveassistanceofcounsel  claim.Italsowouldhavecorroboratedthewitnesseswepresentedatthe `  evidentiaryhearing,andparticularlywouldhavecorroboratedMr.Wells,whothe ( x Court,initsorderlatersaidmadeafindingthatMr.Wellshadnotrecordedor  @ otherwisememorializedthisconversationwithMr.James.AndIbelieveinthe    statementMr.JamessaysthathetoldMr.Wellsaboutwhathewastellinginthe    statement. H   ` (EHTr.259260).Astotheineffectiveassistanceofcounselclaim,asMs.Anderson (  explained: Iwouldratherhaveanineffectiveassistanceofcounselclaim....Becausethe h  prejudicestandarddiffersandtheburdenofproof,basically,onthepersonpresentingtheclaim H  ishigherforanewlydiscoveredevidenceclaim.(EHTr.260)._ [  8      _    BesidesthetranscribedstatementofVernonJames,Mr._Melendez_Ԁwasonlyrecentlyable h tolocateandinterviewseveralwitnesseswhopossessedrelevant,exculpatoryinformation.As  wasexplainedin1996,theproductionofthepublicrecordsconcerningtheVernonJames 8 homicideprovidedleadsforMr._Melendez_Ԁinthemid1990swhichdidnotexistbefore.Thefile  containednamesofseveralofVernonJames'friends.Anumberofthoseindividualstestifiedin  1996andwereconsideredonthemeritsbecausecounselestablisheddiligenceatthe1996 @ evidentiaryhearingforobtainingaccesstothefileregardingthemurderofVernonJames.For   example,Deborah_Ciotti_'s,nowDeborahThomas,namewasascertainedfromthefile.Ms. `  ThomastestifiedthatshesawMr.Jamesshortlybeforethehomicide.Hetoldherthathewas  @ goingtorobMr.Bakerandheaskedhertoaccompanyhim(PCR2.92;EHTr.389391).Ms.    Thomasdeclined,butshewitnessedMr.JamespickuptwoAfricanAmericanmalesandshe `  witnessedMr.JamesenterMr.Baker'sbeautysalon(PCR2.9293;EHTr.389391)._ [  9      _ԀThe   VernonJameshomicidefilealsoledMr._Melendez_ԀtoJaniceDawsonandSandraJames.Mr. 0  Jamesconfessedtobothoftheseindividuals(PCR2.115116;127).Infact,hegaveMs.  Dawsonsomeofthejewelryheobtainedduringtherobberyhomicide(PCR2.115116). P   MartinLakewasanindividualwhosenamewascontainedintheVernonJameshomicide 0 filesMr.LakewasconvictedofkillingMr.James.Afterseveralfailedattemptstolocate p MartinLakeinthemid1990s,Mr._Melendez_collateralcounselwasfinallyabletolocatehimin P December,2000(EHTr.399).Rosa_Greenbaum_,Mr._Melendez_investigator,testifiedthatafter  determiningthatMr.LakewasundersupervisioninPolkCountyshewasabletoascertainan  p address.WhenshewenttotheaddressshelearnedthatMr.Lakenolongerresidedatthat   residence,butsheleftabusinesscardincasehereturned(EHTr.399).AweekorsolaterMr. @" LakecalledMs._Greenbaum_ԀatherofficeandtheydiscussedhisknowledgeofVernonJames  $  involvementintheBakerhomicide(EHTr.400).Thereafter,Ms._Greenbaum_ԀmetwithMr. `"& *      Lakeinpersonandobtainedanaffidavitfromhim(EHTr.403;Ex.45).Mr.LakeprovidedMs.  _Greenbaum_Ԁwithseveralotherleadsinthe_Melendez_Ԁinvestigation: @  `  Q:Andwhatinformationdidheprovidethatwasfruitful?    A:Well,therewerebasicallytwomainpartstothat.Heallowedmeto `  reviewhispersonalfilefromhiscase,thecaseinwhichhehadbeenconvictedof ( x killingVernonJames.AndasIreviewedthatInoticedthatthereweresome  @ thingsintherethatIhadnotseenbefore.    ` (EHTr.403404). H     TheodoreSpencerwasanamethatappearedinMr.Lake'sfileregardingtheVernon (  Jamesmurderinvestigation(EHTr.404).WhenMs._Greenbaum_ԀlocatedandinterviewedMr. h  SpencershelearnedthathedidinfacthaveinformationpertainingtoMr.Jamesinvolvementin H  theBakerhomicideMr.JamesconfessedtoMr.SpencerthatMr.Jameshad"_take[n_][Mr.  Del]downwithsomesharpblows."(EHTr.204).However,evenmoreimportantly,Mr. h SpencerinformedMs._Greenbaum_Ԁthattherewereotherindividualswhohadinformationabout  theBakerhomicide(EHTr.205).OneofthoseindividualswasStanley_Brookshire_Ԁ(EHTr.205 8 206).    Mr._Brookshire_'snamehadnotpreviouslybeenknowntoMr._Melendez_legalteam(EH X Tr.225;269).Mr._Brookshire_ԀsawMr.JamesthenightofthemurderattheScottishInnMotel 8 (EHTr.171172).Mr.JameswastakentothehotelbyHenryDavisandJanet_Conaway_Ԁinorder x! tohide(EHTr.188189).Thatsamenight,Mr.JamesalsoconfessedtoMr._Brookshire_Ԁ(EHTr.  X# 173174).Later,Mr.JamestradedMr._Brookshire_ԀacoupleoftheringshestolefromMr.Baker !% duringtherobberyhomicidefordrugs(EHTr.173174). (#x'   Mr.LakenotonlyprovidedMs._Greenbaum_ԀhispersonalfileregardingtheVernonJames $ ) deathinvestigation,healsotoldMs._Greenbaum_ԀthatMr.Jameshadconfessedtohim,aswell H&!+ (Ex.45).Furthermore,Mr.LakeprovidedMs._Greenbaum_ԀwithKennethGraham'sname(EH '(#- Tr.408).KennethGraham,likeMr.Lake,metMr.JamesaftertheBakerhomicide.Mr.James h)$/ confessedtoMr.GrahamandtoldhimaboutthejewelryandmoneyhehadtakenfromMr. *H&1 Bakerduringthemurder(EHTr.366368).Mr.LaketoldMs._Greenbaum_,andMr.Graham ,'3 confirmedthatMr.LakeandMr.Grahammetwhiletheywereincarceratedtogetherinthelate  1980s(EHTr.369).AftertheybecamefriendstheydiscussedVernonJamesandrealizedthathe @ confessedhisinvolvementintheBakerhomicidetobothofthem(EHTr.369).     MartinLakecouldnothavebeenlocatedandinterviewedearlierinthepostconviction `  process.AttemptsweremadetofindhimonceMr._Melendez_attorneysknewhisnameandhis  @ affiliationwithMr.James(EHTr.217;256).Mr.Lakeattestedthathewasoutofstateinthe    mid1990sandhewashidingbecauseofoutstandingarrestwarrants(Ex.45;EHTr.410).Mr. `  LakeledMr._Melendez_ԀtoTheodoreSpencer,Stanley_Brookshire_ԀandKennethGraham.Allof   theinformationtheseindividualsprovidedqualifiesasnewlydiscoveredevidence. 0    AlphonsoAndersonalsoprovidesnewlydiscoveredevidence.Hisnameappearedina  1975incidentreportconcerningVernonJames.Rosa_Greenbaum_ԀwasabletolocateMr. P Andersonin2000andcontacthimeventhoughshehadnobasisforbelievingthatMr.Anderson 0 possessedanyrelevantinformation(EHTr.430). [  10      ׀However,Mr.Andersondidpossessrelevant p information.VernonJameshadaskedMr.AndersontohelphimrobDelBaker(EHTr.151). P ShortlyafterMr.Andersonrefused,Mr.Bakerwasmurdered.Thereafter,Mr.Jamesconfessed  thathehadkilledMr.Bakerandthathefacedlifeinprisonunlessheputtheblameonsomeone  p  else(EHTr.152).   *        Janet_Conaway_Ԁand_Angelia_Ԁ_Haughbrook_Ԁalsoprovidenewlydiscoveredevidencethat   couldnothavebeenpresentedearlier.Janet_Gauntlett_,nowJanet_Conaway_,wasawitnessfor @ whomformercollateralcounselforMr._Melendez_Ԁsearched,butwasunabletolocate(EHTr.   263).However,intheyear2000,Janet_Conaway_'sdaughterappliedforadriverslicensewiththe `  FloridaDepartmentofMotorVehicles(EhTr.411).Thiswasthetriggeringeventwhichcaused  @ Amanda_Gauntlett_ԀtobeplacedintheinvestigativedatabasesintheStateofFlorida(EHTr.411).    WhenMs._Greenbaum_ԀsearchedforJanet_Gauntlett_Ԁinthefallof2000,shefoundanindividual `  namedAmanda_Gauntlett_ԀwhohadarelativenamedJanet_Conaway_Ԁ(EHTr.412).Ms.   _Greenbaum_ԀsearchedforMs._Conaway_ԀandlearnedthatMs._Conaway_Ԁwasformerlyknownas 0  Ms._Gauntlett. [  11      _ԀMs._Conaway_Ԁprovidedcompellingtestimonyasshewasoneofthefirst  individualswhosawVernonJamesafterMr.BakerwasmurderedandtowhomMr.James P confessed.SeeEHTr.185200.
