ðand€the€bottom€line€that€we€have€hereÏis€that€whatever€that€pubic€hair€was€or€whose€ever€it€might€haveÏbeen,€in€the€pubic€hair€found€in€the€pubic€hair€of€Miss€Smith,Ï[the€examiner]€could€not€match€it€with€Jody€Wright.ðð€€(R.€2095).€ÏThe€examiner€noted€that€the€hair€ð ðdemonstrated€someÏcharacteristics€of€¢caucasian£€pubic€hair.€€Wrightððs€pubic€hairÏstandard€demonstrated€characteristics€of€¢caucasian£€pubic€hair.€ÏThey€were€different€because€one€was€characteristic€of€pubic€hair,Ïthe€other€was€not.ðð€€(R.€œ2096).ñ­ñ׃/×ñ­ññ­ñ׃_×ñ­ñÝ àThe€evidentiary€hearing€commenced€in€March€of€1997,€and€wasÏconcluded€December€7„8,€1997.€€Mr.€Wright€called€Freddie€WilliamsÐ P( #& Ðas€a€witness€to€support€his€claim€that€Judge€Perryððs€factualÏfinding€(that€Freddie€Williams,€as€the€defenseðð€investigator€atÏthe€time€of€trial,€had€seen€the€police€reports€concerning€JacksonÏand€¢Strickland£)€was€erroneous€as€a€matter€of€fact.€€Mr.€WilliamsÏspecifically€testified€that€he€did€not€see€the€police€reportsÏconcerning€Jackson€and€Ô_Ô¢Strickland£Ô_Ô€until€five€years€after€Mr.ÏWrightððs€trial€(PC„¢R2£.€2526„36).€€The€State€objected€to€thisÏtestimony,€arguing€that€right€or€wrong€Judge€Perryððs€finding€wasÏbinding€as€law€of€the€case€(ð Ðin€ruling€denied€Mr.€Wright€due€process.Ìà  àWhen€still€no€action€result,€Mr.€Wright€petitioned€thisÏCourt€for€a€writ€of€mandamus€on€May€25,€2000,€nearly€two€and€oneÏhalf€years€after€the€closing€¢srgument£.€€òòWright€v.€Stateóó,€Case€No.Ð ð@ àMs.€Smith,€a€seventy„five€year€old€school€teacher€had€livedÏnext€door€to€the€Wrights€for€many€years€(R.€1583).€€Joel€DaleÏWright€was€born€the€seventh€of€eight€on€August€28,€1957€(R.€2968.ÏPC„¢R1£.€63).€€He€and€his€family€had€always€gotten€along€well€withÏMs.€Smith,€despite€Ms.€Smithððs€eccentricities€(PC„¢R1£.€66).€€OverÏthe€years,€her€house€had€become€piled€with€debris;€this€includedÏnewspapers,€groceries,€empty€cat€and€dog€food€containers,€etc.€Ï(R.€1534).€€The€debris€was€between€one€and€three€feet€deepÏthroughout€the€house€(R.€2305).€€The€residence€lacked€runningÏwater€(R.€1597).€€Frequently,€Ms.€Smith€would€sit€in€her€car€asÏopposed€to€her€house€(R.€1611).€€She€would€grade€papers€there.€ÏSometimes€she€would€just€sit€in€the€car€reading€or€eating.€€SheÏgenerally€left€the€back€windows€of€her€house€open€so€that€herÏcats€could€go€in€and€out€unencumbered€(R.€1612).Ìà  àOn€February€6,€1983,€at€4:15€p.m.,€the€Putnam€CountyÏSheriffððs€Office€received€a€call€from€Earl€Smith,€Ms.€SmithððsÏbrother.€€Mr.€Smith,€who€lived€across€the€street€from€Ms.€Smith,Ïhad€just€discovered€her€body€in€her€bedroom€(R.€1628).€€SheriffÏofficers€found€Ms.€Smithððs€body€in€a€crevice€(not€over€six€inchesÐ ,`'* Ðwide€R.€1600)€between€the€bed€and€the€wall€of€her€bedroom.€€Ms.ÏSmith€had€twelve€stab€wounds€in€the€left€side€of€her€face€andÏneck€(R.€1739,€1816).€€The€stab€wounds€were€consistent€with€aÏpocket€knife€(R.€1822).€€Located€on€top€of€Ms.€Smithððs€exposedÏabdomen€was€a€candy€bar€(R.€1728).Ìà ðThe€only€was€I€would€have€of€knowing€wouldÏbe€to€go€back€to€the€receipts€that€would€be,€I€believe,€in€theÏState€Attorneyððs€file€that€were€signed€by€[trial€counselððsÏinvestigator]€and€determine€if€that€was€one€of€the€documentsÏfurnishedðð€(PC„¢R1£.€724).€€These€receipts€had€been€prepared€by€Mr.ÏDunning.€€ð ðworried€that€if€[he]€got€in€trouble€¢Paige£Ïwould€get€in€troubleðð€(PC„¢R1£.€652).€€When€Mr.€Dunning€found€outÏabout€the€business€prior€to€Mr.€Wrightððs€trial,€Mr.€DunningÏquestioned€¢Westberry£€concerning€it.€€According€to€¢Westberry£,€Mr.ÏDunning€told€him€he€would€not€prosecute€him€over€the€scrap€metalÏbusiness,€but€he€never€guaranteed€¢Westberry£€that€he€would€not€beÏprosecuted€for€stealing€scrap€metal€and€selling€it€for€profit.€Ð Ðelected€not€to€present€Charlotte€Martinez€to€testify€about€theÏdecanter€she€had€provided€the€prosecution.€€Mr.€Pearl€thenÏdecided€to€call€her€to€present€the€fact€that€Jody€had€access€toÏmoney€in€his€own€house€if€he€needed€it€and€that€he€acquired€noÏunexplained€infusion€of€cash€(PC„¢R1£.€819).€€However€afterÏpresenting€Ms.€Martinezððs€testimony,€Mr.€Pearl€failed€to€call€Mr.ÏWrightððs€aunt€to€identify€the€glass€decanter€and€the€matchingÏglasses.€€Regarding€this€failure€Mr.€Pearl€testified:ÌÒ` °ÒÓÓI€failed€to€prove,€and€I€had€the€proof€in€my€hand,€thatÏjar€was€in€fact€the€property€of€Jodyððs€mother.€€IÏfailed€to€do€it.€€It€was€a€lapse,€a€mistake.€€I€just€ð"ðÏI€canððt€explain€it€to€you.€€It€is€as€if€it€passed€outÏof€my€mind,€perhaps€due€to€the€pressure€of€otherÏmatters€during€the€trial.€€But€I€cannot€explain€it.€€ItÏwas€inferior€performance.ÌÌà àMr.€Dunning€brilliantly€took€advantage€of€thatÏlapse€in€closing€arguments€to€argue€to€the€jury€thatÏcould€have€been,€or€must€have€been€the€jar€that€CharlesÏ¢Westberry£€had€been€talking€about.€€And,€therefore,€IÏfeel€very€badly€about€it.€€I€feel€very€much€at€faultÏabout€it.€€It€was€a€sorry€performance€on€my€part.ÌÌÒ°` ðMr.€Jackson€wasÏretained€to€cut€down€a€tree,€and€the€scratches€he€received€as€aÏresult€of€the€treeðð€(PC„¢R1£.€1067).€€When€confronted€withÏJacksonððs€own€statement€indicating€that€scratches€came€from€aÏfight€the€night€of€Sunday,€February€6th,€Captain€Miller€retorted:Ð  àMr.€Wright€timely€filed€a€motion€for€rehearing€whichÏincluded€a€request€to€amend€the€3.850€motion€on€the€basis€ofÏnewly€discovered€evidence€that€Mr.€Pearl€had€been€a€specialÏdeputy€sheriff€at€the€time€of€Mr.€Wrightððs€trial.€€Judge€PerryÏdenied€the€claim€on€the€basis€of€another€judgeððs€ruling€inÏanother€case€in€which€evidence€had€been€received.€€Judge€PerryÏdid€not€disclose€that€the€Putnam€County€Sheriff€had€provided€himÏwith€a€special€deputy€card€which€Sheriff€Ô_Ô¢Pellicer£Ô_Ô€gave€to€hisÏpolitical€allies€so€that€they€could€get€out€of€speeding€ticketsÏand€other€traffic€stops.€Ìà Ðtestified€that€in€1991€following€the€remand€he€was€handed€aÏpacket€of€material€by€Captain€Cliff€Miller€who€said€these€are€theÏdocuments€that€Mr.€Wright€did€not€receive€in€1988€(PC„¢R2£.€2600„¼01).€€At€that€time,€Mr.€Walsh€was€lead€to€believe€that€thisÏpacket€of€materials€ð ðwere€the€only€records€that€¢CCR£€had€notÏreceived€beforeðð€(PC„¢R2£.€2601).€€These€documents€were€introducedÏinto€evidence€without€objection€as€Exhibit€46€(PC„¢R2£.€2600).€ÏThese€newly€disclosed€documents€included€police€reports€regardingÏcriminal€investigations€of€Henry€Jackson€and€Clayton€Ô_Ô¢Strickland£.Ô_Ô€Ô#†XL XXXn+~Ó#ÔÔ‡Xn+XXXL ÔÐ Ð  ÐÔ#†XL XXXn+rÖ#ÔÔ‡Xn+XXXL ÔOne€of€the€reports€was€regarding€an€incident€in€1984€shortlyÐ °"  Ðafter€Mr.€Wrightððs€trial.€€A€elderly€woman,€Grace€Moore,€hadÏreported€that€after€hiring€Henry€Jackson€to€do€yard€work,€she€wasÏawakened€by€him€the€next€day€with€a€bump€on€her€head€and€theÏmoney€in€her€pantyhose€gone€(¢Exh£.€46).Ô#†XL XXXn+ÉÖ#ÔÔ‡Xn+XXXL ÔÐ 0*€%( Ðà  àSubsequently€in€1996€in€connection€with€another€PutnamÐ ,`'* ÐCounty€case,€òòState€v.€¢Colina£óó,€Mr.€Walsh€learned€that€the€PutnamÐ ° ÐCounty€Sheriffððs€Office€had€a€systemic€problem€that€had€precludedÏit€in€the€past€from€fully€disclosing€all€public€records€to€theÏOffice€of€the€Capital€Collateral€Representative€(PC„¢R2£.€2603).€ÏBased€upon€this€new€information,€Mr.€Walsh€made€new€publicÏrecords€requests€of€the€Putnam€County€Sheriff€on€Mr.€WrightððsÏbehalf.€€An€accordion€folder€full€of€additional€records€wasÏsubsequently€disclosed€(PC„¢R2£.€2603).€€This€accordion€file€wasÏintroduced€into€evidence€as€Exhibit€47.€€Mr.€Walsh€testified€thatÏhe€had€examined€this€documents€and€ascertained€that€¢CCR£€had€notÏpreviously€received€any€of€the€materials€contained€in€Exhibit€47Ï(PC„¢R2£.€2604).€€Ìà  àThe€records€disclosed€in€1996„97€and€contained€in€Exhibit€47Ïincluded€materials€revealing€that€Walter€Perkins€was€fired€by€theÏSheriffððs€Department€in€January€of€1986€because€he€was€lazy€andÏuntrustworthy.¢×ƒ8×Ý ƒ3ÿÿÝòòÚ  Ú41Ú  ÚóóÝ  Ý×  ×£€€He€had€been€written€up€in€1980€over€hisÐ Ð  Ðhandling€of€another€case.€€There,€a€woman€named€Dell€¢Gillman£,€whoÏhad€sought€help€from€the€Sheriffððs€Department€regarding€Ô_Ô¢spousal£Ô_ÔÏabuse,€claimed€that€Officer€Perkinsðð€report€regarding€hisÐ p&À!$ Ðresponse€to€her€call€for€help€was€not€truthful€and€ð ðdid€in€factÏfalsify€the€actual€report.ðð€€She€queried€that€his€conduct€raisedÏthe€question€of€whether€he€would€engaged€in€similar€behavior€inÏother€cases€(¢Exh£.€47).Ìà  àIn€connection€with€this€evidence€concerning€Walter€Perkins,ÏMr€Wright€called€¢Bobbi£€¢Mixon£,€his€sister,€as€a€witness.€€SheÏtestified€during€the€winter€proceeding€Ms.€Smithððs€death€WalterÏPerkins€had€become€angry€with€Mrs.€Wright€and€threatened€her:ÌÒ` °ÒÓÓà ¸ àAnd€Walter€came€up€there€and€said,€told€my€motherÏ„€„€one€of€my€brotherððs€was€seeing€one€of€hisÏstepsisters,€so€both€my€brotherððs€would€go€do€[sic]Ïdown.€€And€he€came€down€there€and€told€my€mother€thatÏhe€wanted€her€to€make€my€two€brothers€stop€going€downÏthere€to€see€his€stepsister.ÌÌà ¸ àAnd€my€mom€in€return€told€him€that€whenever€hisÏstep„dad,€Julian,€and€I€canððt€remember€the€last€name,Ïtold€them€they€couldnððt€come€down€there€any€more€sheÏwould€tell€them.€€Walter€didnððt€live€with€them.€€AndÏWalter€said,€well,€if€you€canððt€keep€those€two€boysÏfrom€down€there€at€my€sisterððs€house,€my€dadððs€house,ÏIððm€going€to€make€you€sorry€you€ever€had€them€two€boys.€ÏAnd€my€mother€got€very€angry.€€I€mean,€no€one€has€theÏright€to€threaten€you.€€And€she€told€Walter€get€off€herÏproperty€and€not€to€come€back€on€her€property€unless€heÏhad€a€search€warrant.€€And€I€remember€my€mother€was€soÏupset.€€But,€now€she€didnððt€call€the€police€orÏanything,€because€Walter€left€as€soon€as€she€told€himÏtoo.ÌÌÒ°` àÒÓ#àÓ(PC„¢R2£.€2587„88).Ìà  àAn€evidence€receipt€form€provided€in€1997€showed€that€TaylorÏDouglas€obtained€ink€rolled€fingerprints€from€Jody€Wright€onÐ ,`'* ÐFebruary€11,€1983,€after€a€February€9th€interview€(Exhibit€47).€ÏYet,€a€comparison€with€the€prints€from€Ms.€Smithððs€house€was€notÏmade€until€April€20,€1983,€after€Walter€Perkins€has€assisted€inÏhis€arrest.Ìà  àJail€records€revealed€in€1997€included€as€part€of€Exhibit€47Ïcontained€a€report€that€Jody€had€attempted€suicide€on€the€eve€ofÏtrial€after€his€motherððs€death€(¢Exh£.€47).€€Though€this€reportÏindicated€that€Freddie€Williams€was€contacted,€Mr.€WilliamsÏtestified€that€he€had€no€memory€of€the€incident€(PC„¢R2£.€2536).€ÏAnd€the€matter€was€never€brought€to€the€attention€of€the€trialÏcourt€in€1983.Ô#†XL XXXn+CØ#ÔÔ‡Xn+XXXL ÔÐ pÀ Ðà  àMr.€Wright€also€sought€to€present€testimony€from€FreddieÏWilliams€that€he€saw€the€Jackson€and€Ô_Ô¢Strickland£Ô_Ô€documents€in€theÏState€Attorneyððs€Office€for€the€first€time€five€years€after€Mr.ÏWrightððs€trial.€€However,€the€Stateððs€objection€to€that€testimonyÏwas€sustained,€and€Judge€¢Nichols£€refused€to€consider€the€factÏthat€the€statements€of€Wanda€Brown,€Charlene€Luce€and€Kim€HoltÏwere€not€disclosed€to€the€defense.Ìà  àWanda€Brown€was€called€as€a€witness€(PC„¢R2£.€2557).€€SheÏtestified€to€her€encounter€with€Clayton€¢Strickland£€on€February€5,Ï1983,€in€front€of€Ms.€Smithððs€home.€€She€testified€that€she€alsoÏwitnessed€an€encounter€between€Mr.€¢Strickland£€and€Ms.€Smith€whichÐ ,`'* Ðended€with€Ms.€Smith€making€hand€motions€for€him€to€leave€herÏalone€(PC„¢R2£.€2560).€€Her€testimony€matched€her€February€7,€1983,Ïstatement€to€the€police,€except€that€she€remembered€that€Mr.ÏJackson€was€present€with€Mr.€¢Strickland£€(PC„¢R2£.€2559).€€Near€theÏend€of€Ms.€Brownððs€testimony€the€State€made€objection€that€theÏtestimony€was€cumulatively€to€what€had€been€presented€in€1988Ï(PC„¢R2£.€2560„61).€€After€much€discussion,€Judge€¢Nichols£€allowedÏMr.€Wrightððs€counsel€to€finish€his€examination€without€making€aÏruling€on€the€Stateððs€objection€(PC„¢R2£.€2570).Ìà  àCharlene€Luce€was€called€as€a€witness€by€Mr.€Wright€(PC„¢R2£.Ï2609).€€She€testified€to€her€knowledge€of€Henry€Jackson€whom€sheÏhad€known€virtually€all€of€her€life€in€1983.€€She€remembered€anÏincident€from€when€she€was€a€little€girl:ÌÒ` °ÒÓÓI€remember€Mrs.€Jackson,€sheððd€be€put€outside€and€itÏwas€nothing€for€them€to€kick€her,€you€know,€just€takeÏand€kick€her€in€the€¢heinie£,€and€grab€her€by€the€hair€ofÏthe€head€and€tell€her€to€get€in€there€and€cook€themÏsomething€to€eat,€or€you€could€hear€them€slapping€her,Ïher€begging€them€to€quit,€you€know,€not€to€hurt€her.ÌÌÒ°` îÒÓîÓ(PC„¢R2£.€2614„15).€€She€remembered€when€Henry€Jackson€killed€hisÏbrother„in„law€(PC„¢R2£.€2615).€€She€remembered€what€it€was€like€toÏmeet€up€with€Henry€Jackson:ÌÒ` °ÒÓÓà ¸ àA€€Well,€he€would€probably,€you€know,€be€allÏright,€but€you€just€never€knew,€you€know.€€It€was€justÏtoo€risky€to€take€a€chance.€€If€you€loaned€him€money,Ïthat€might€be€fine,€youððd€never€expect€to€get€it€paidÐ ,`'* Ðback.€€If€you€helped€him€in€any€way,€that€was€fine,€butÏif€you€tried€to€stand€up€to€him,€tell€him€you€didnððtÏwant€to€be€bothered€with€it,€the€next€time€he€went€onÏone€of€those€drunk€binges€youððd€hear€about€it.ÌÌQ€€Were€you€afraid€of€Henry€Jackson?ÌÌA€€To€a€certain€extent,€yes,€sir.ÌÌÒ°` <ðÒÓJðÓ(PC„¢R2£.€2617).Ìà  àWhen€Mr.€Wrightððs€counsel€began€to€question€Ms.€LuceÏregarding€the€events€the€weekend€of€Ms.€Smithððs€death,€the€StateÏobjected€on€cumulative€grounds€(PC„¢R2£.€2618).€€However,€JudgeÏ¢Nichols£€allowed€the€testimony€(PC„¢R2£.€2619).Ìà  àCharlene€Luce€then€testified€to€her€encounters€with€HenryÏJackson€on€February€4th€and€6th,€1983.€€Her€testimony€was€inÏconformity€with€her€statement€to€the€police€in€1983€and€her€1991Ïaffidavit.€€As€to€her€questioning€of€Henry€as€to€whether€heÏcommitted€the€murder,€her€testimony€was:ÌÒ` °ÒÓÓà ¸ àA€€Well,€we€chit„chatted€there€for€a€few€minutesÏand€I€said€Henry€did€you€do€that?ÌÌà ¸ àQ€€And€what€was€his€reaction€to€that?ÌÌà ¸ àA€€And€he,€for€some€reason,€he€just€turned€realÏred€in€the€face,€and€he€looked€at€me€real€funny,€and€heÏturned€and€walked€away.€€And€I€said,€Henry€I€was€justÏkidding€about€that,€I€wasnððt,€you€know.€€And€he€neverÏdid€answer.ÌÌà ¸ àQ€€Did€he€ever€answer€that€question€for€you?ÌÌà ¸ àA€€No,€sir.Ð ,`'* ЇÒ°` ÌôÒÓÚôÓ(PC„¢R2£.€2622).Ìà  àMr.€Wright€also€called€Kim€Holt€as€a€witness.€€At€the€timeÏof€the€hearing,€her€name€was€Kim€Holt€¢Holliman£€(PC„¢R2£.€2579).€ÏShe€testified€concerning€her€observations€of€Henry€Jackson€as€sheÏhad€reported€in€her€February€28,€1983,€statement€(PC„¢R2£.€2582).€ÏShe€verified€that€it€was€from€Mr.€Jackson€that€she€learned€thatÏMs.€Smith€was€dead,€and€that€at€the€time€Mr.€Jackson€hadÏð ðscratches€on€him€and€had€what€appeared€to€be€blood€on€himðð€(PC„¼¢R2£.€2583).Ìà  àMr.€Wright€called€Mildred€Thomas€as€a€witness.€€Ms.€ThomasÏwas€Kim€Holtððs€mother€(PC„¢R2£.€2506).€€The€State€objected€to€Ms.ÏThomasðð€testimony€regarding€what€Kim€had€told€her€in€February€ofÏ1983.€€The€objection€was€sustained€on€hearsay€grounds,€but€Mr.ÏWright€was€permitted€to€proffer€the€testimony€in€support€of€hisÏclaim€that€the€testimony€was€being€presented€to€show€whatÏinformation€would€have€been€available€to€Mr.€Pearl€in€1983.€€KimÏhad€told€her€mother:ÌÒ` °ÒÓÓthat€a€man€that€usually€came€through€her€line€[]Ïscrounging€around€for€money,€had€come€through€and€heÏhad€money,€and€that€there€were€scratches€on€his€handsÏand€on€his€throat.€€And€I€told€her€I€said€well,€perhapsÏyou€better€tell€the€police€about€it,€because€we€knew€byÏthen€that€Ms.€Page€had€been€killed.€€ÌÌÒ°` ÊúÒÓØúÓ(PC„¢R2£.€2508).Ð  +p&) Ðà  àTaylor€Douglasðð€deposition€in€1997€was€introduced€as€ExhibitÏ27€(PC„¢R2£.€2520).€At€firstÔ#†XL XXXn+¦ç#ÔÔ‡Xn+XXXL Ô,€Taylor€Douglas€indicated€that€ð ðMr.Ð à ÐWright€wasðð€¢polygraphed£,€but€beyond€that€he€was€not€sure.€€As€toÏJackson€and€¢Strickland£€being€¢polygraphed£,€he€indicated,Ïð ðPossibilityðð€(Douglas€¢Depo£,€at€35).€€Taylor€Douglas€was€thenÏpermitted€to€refresh€his€recollection.€€Afterwards,€he€listedÏthose€individuals€who€in€fact€were€¢polygraphed£:€Paul€House,ÏCharles€¢Westberry£,€Jody€Wright€and€Denise€Easter€(Douglas€¢Depo£€atÏ39).€€Jackson€and€¢Strickland£€were€not€on€the€list€of€those€whoÏhad€been€¢polygraphed£.Ô#†XL XXXn+õü#ÔÔ‡Xn+XXXL ÔÐ à Ðà  àMr.€Wright€called€¢Glenna£€Logan€Fox€and€her€sister,€TammyÏLogan€¢Marjenhoff£€as€witnesses€(PC„¢R2£.€2537,€2548).¢×ƒ:×Ý ƒ3ÿÿÝòòÚ  Ú42Ú  ÚóóÝ  Ý×  ×£€€TheyÐ P  Ðtestified€concerning€a€September€9,€1980,€incident€that€had€beenÏreported€to€the€police.€€The€police€report€regarding€the€incidentÏwas€introduced€into€evidence€as€Exhibit€41€(PC„¢R2£.€2543).€€Ms.ÏFox€explained€that€someone€had€been€trying€to€break€into€herÏresidence€for€several€months€(PC„¢R2£.€2549).€€She€had€tried€toÏcatch€the€person€without€success.€€Then€on€September€9th,€sheÏawoke€to€the€screen€door€shaking€ð ðlike€somebody€trying€to€shakeÐ p&À!$ Ðit,€trying€to€get€[]€the€latch€to€come€unlatchedðð€(PC„¢R2£.€2552).€ÏShe€saw€Henry€Jackson€and€he€told€her€he€needed€a€light€for€hisÏcigarette€and€tried€to€get€her€to€open€the€door€(PC„¢R2£€2552„53).€ÏShe€reported€the€incident€to€the€police€and€moved€because€of€herÏfear€of€Jackson€two€weeks€later€(PC„¢R2£.€2554).Ìà  àLeon€Wells€was€called€as€a€witness€by€Mr.€Wright€(PC„¢R2£.Ï2573).¢×ƒ;×Ý ƒ3ÿÿÝòòÚ  Ú43Ú  ÚóóÝ  Ý×  ×£€€He€testified€that€he€had€known€Henry€Jackson€and€hisÐ ð@  Ðbrothers€virtually€all€his€life.€€Mr.€Wells€worked€at€aÏconvenience€story€in€the€early€80ððs€and€had€occasion€to€see€HenryÏcome€into€his€story€on€a€regular€basis,€once€or€twice€a€week€(PC„¼¢R2£.€2574).€€Mr.€Wells€recalled:ÌÒ` °ÒÓÓà ¸ àQ€€Did€you€ever€see€them€fight?ÌÌà ¸ àA€€Oh€yeah,€Iððve€seen€them€fight.ÌÌà ¸ àQ€€How€many€times€do€you€think€youððve€seen€HenryÏJackson€fight?ÌÌà ¸ àA€€In€my€lifetime€30€or€40.ÌÌà ¸ àQ€€Now,€other€than€fighting€did€Henry€have€anyÏother€qualities€that€make€you€remember€him?ÌÌà ¸ àA€€Pertaining€to€his€fighting,€I€think€him€andÏLeroy€both€liked€knives.ÌÌÒ°` YÒÓgÓ(PC„¢R2£.€2575).Ð àQ€€Do€you€recall€the€incident€that€led€to€thisÏpolice€report€dated€January€29th,€1981?ÌÌà ¸ àA€€Itððs€been€a€long€time€ago,€but€they€were€justÏfighting,€just€like€the€report€says,€they€were€arguingÏamongst€one€another€and€just€wouldnððt€leave€the€store.ÌÌà ¸ àQ€€Okay.€€Do€you€think€you€may€have€called€theÏpolice€other€times€other€than€on€this€occasion€on€theÏ¢Jacksons£?ÌÌà ¸ àA€€I€called€them€„€„€one€that€I€rememberÏdistinctly€because€it€involved€a€gun€and€the€one€theÏone€on€¢Crill£€Avenue€where€Henry€had€a€gun€on€his€daddyÏand€they€were€arguing€over€a€bottle€of€wine.ÌÌà ¸ àQ€€Okay.€€Do€you€remember€what€happened€in€thatÏincident?ÌÌà ¸ àA€€They€let€him€go,€because€he€run€around€theÏbuilding€before€the€cops€got€there€and€hid€the€gun€andÏthey€couldnððt€find€the€gun.€€And€they€asked€him€toÏleave€and€they€left.ÌÌà ¸ àQ€€Now,€is€there€anything€about€Henry€Jackson€thatÏyouððd€like€to€tell€the€court€other€than€what€youððveÏsaid€today?ÌÌà ¸ àA€€Well,€you€canððt€go€under€hearsay,€but€they€wereÏterrible€bad€boys.€€Like€I€said€I€grew€up€with€themÏmost€of€my€life€one€way€or€another.ÌÌâ âÒ°` ùÒÓÓ(PC„¢R2£.€2577„78).Ð P( #& Ðà âShe€testified€that€she€had€lived€at€her€address€in€¢Palatka£€for€39Ïyears€(PC„¢R2£.€2630).€€She€indicated€that€she€had€been€veryÏfamiliar€with€Henry€Jackson.€€She€recalled€him€killing€hisÏbrother„in„law:ÌÒ`
