Ðcashier€at€a€local€supermarket,€saw€a€man€she€identified€as€HenryÏJackson€in€her€check€out€line.€€Mr.€Jackson€had€fresh€scratchÏmarks€on€his€face€and€ð ðwhat€appeared€to€be€blood€on€him,€freshÏbloodðð€(PC„¢R2£.€2583).€€Ms.€Holt€was€familiar€with€Jackson€and€theÏfact€that€he€usually€had€no€money.€€(PC„¢R2£.€444).€€He€announcedÏð ðI€got€money€todayðð€(PC„¢R2£.€444).€€He€paid€Ms.€Holt€with€a€oneÏhundred€dollar€bill€and€showed€her€that€he€possessed€another€oneÏ(PC„¢R2£.€2583).€€Mr.€Jackson€then€asked€Ms.€Holt€if€she€knew€thatÏMs.€Smith€had€been€killed€(PC„¢R2£.€444,€2583).€€As€he€was€leaving,ÏMs.€Holt€noticed€that€it€was€4:30€¢pm£.€(PC„¢R2£.€444).Ìà ƒ3ÿÿÝòòÚ  Ú9Ú  ÚóóÝ  Ý×  ×£€€According€to€Ô_Ô¢Strickland£Ô_Ô,€he€had€last€seenÐ 0 € ÐMs.€Smith€on€ð ðTuesday€or€Wednesdayðð€of€the€previous€week€(PC„¢R1£.Ï379).Ô_Ԣ׃  ×Ý ƒ3ÿÿÝòòÚ  Ú10Ú  ÚóóÝ  Ý×  ×£Ô_Ô€€According€to€Jackson,€ð ðwe€went€to€bed€earlyðð€onÐ ð@  ÐSaturday,€February€5th.€€According€to€Ô_Ô¢Strickland£Ô_Ô,€ð ðHenry€and€IÏhad€been€drinking€a€lot€on€Saturday€and€was€pretty€high.€€We€wentÏto€bed€around€eight€oððclock€I€guess.€€I€didnððt€get€up€untilÏSunday€morning€and€I€made€some€coffee€for€Henry€and€I.€€Henry€andÏI€stayed€at€the€trailer€all€morningðð€(PC„¢R1£.€379).Ìà  àIn€1988,€then€Deputy€Taylor€Douglas€testified€that€JacksonÏand€Ô_Ô¢Strickland£Ô_Ô€were€eliminated€as€suspects€when€they€each€passedÏa€polygraph€denying€involvement€in€the€murder€(ð ðAnd€of€courseÐ ðone€brown€hair€present€whichÏdemonstrated€some€characteristics€of€¢caucasian£€pubic€hair,€butÏthe€hair€was€different€from€the€hairs€in€the€pubic€hair€standardÏfrom€Smith.ðð€€(R.€2080).€€The€examiner€compared€this€hair€toÏknown€standards€from€Jody,€ð ðand€the€bottom€line€that€we€have€hereÏis€that€whatever€that€pubic€hair€was€or€whose€ever€it€might€haveÐ 0€ Ðbeen,€in€the€pubic€hair€found€in€the€pubic€hair€of€Miss€Smith,Ï[the€examiner]€could€not€match€it€with€Jody€Wright.ðð€€(R.€2095).€ÏThe€examiner€noted€that€the€hair€ð ðdemonstrated€someÏcharacteristics€of€¢caucasian£€pubic€hair.€€Wrightððs€pubic€hairÏstandard€demonstrated€characteristics€of€¢caucasian£€pubic€hair.€ÏThey€were€different€because€one€was€characteristic€of€pubic€hair,Ïthe€other€was€not.ðð€€(R.€2096).Ìà  àThe€records€disclosed€in€1996„97€included€materialsÏrevealing€that€Walter€Perkins€was€fired€by€the€SheriffððsÏâ âDepartment€in€January€of€1986€because€he€was€lazy€andÐ $à" Ðuntrustworthy.¢×ƒ/×Ý ƒ3ÿÿÝòòÚ  Ú21Ú  ÚóóÝ  Ý×  ×£€€He€had€been€written€up€in€1980€over€hisÐ ° Ðâ âhandling€of€another€case.€€There,€a€woman€named€Dell€¢Gillman£,€whoÏhad€sought€help€from€the€Sheriffððs€Department€regarding€Ô_Ô¢spousal£Ô_ÔÏabuse,€claimed€that€Officer€Perkinsðð€report€regarding€hisÏresponse€to€her€call€for€help€was€not€truthful€and€ð ðdid€in€factÏfalsify€the€actual€report.ðð€€She€queried€that€his€conduct€raisedÏthe€question€of€whether€he€would€engaged€in€similar€behavior€inÏother€cases€(¢Exh£.€47).Ìà  àJail€records€revealed€in€1997€included€a€report€that€Mr.ÏWright€had€attempted€suicide€on€the€eve€of€trial€after€his€motherÏhad€died.€€(¢Exh£.€47).€€Though€this€report€indicated€that€FreddieÏWilliams€was€contacted,€Mr.€Williams€had€no€memory€of€theÏincident€(PC„¢R2£.€2536).€€And€the€matter€was€never€brought€to€theÏattention€of€the€trial€court€in€1983.Ìà  àThe€evidentiary€hearing€commenced€in€March€of€1997,€and€wasÏconcluded€December€7„8,€1997.€€Mr.€Wright€called€Freddie€WilliamsÏas€a€witness€to€support€his€claim€that€Judge€Perryððs€factualÏfinding€(that€Freddie€Williams,€as€the€defenseðð€investigator€atÏthe€time€of€trial,€had€seen€the€police€reports€concerning€JacksonÐ àMs.€Smith,€a€seventy„five€year€old€school€teacher€had€livedÏnext€door€to€the€Wrights€for€many€years€(R.€1583).€€Joel€DaleÏWright€was€born€the€seventh€of€eight€on€August€28,€1957€(R.€2968.ÏPC„¢R1£.€63).€€He€and€his€family€had€always€gotten€along€well€withÏMs.€Smith,€despite€Ms.€Smithððs€eccentricities€(PC„¢R1£.€66).€€OverÏthe€years,€her€house€had€become€piled€with€debris;€this€includedÏnewspapers,€groceries,€empty€cat€and€dog€food€containers,€etc.€Ï(R.€1534).€€The€debris€was€between€one€and€three€feet€deepÐ ,`'* Ðthroughout€the€house€(R.€2305).€€The€residence€lacked€runningÏwater€(R.€1597).€€Frequently,€Ms.€Smith€would€sit€in€her€car€asÏopposed€to€her€house€(R.€1611).€€She€would€grade€papers€there.€ÏSometimes€she€would€just€sit€in€the€car€reading€or€eating.€€SheÏgenerally€left€the€back€windows€of€her€house€open€so€that€herÏcats€could€go€in€and€out€unencumbered€(R.€1612).Ìà  àOn€February€6,€1983,€at€4:15€p.m.,€the€Putnam€CountyÏSheriffððs€Office€received€a€call€from€Earl€Smith,€Ms.€SmithððsÏbrother.€€Mr.€Smith,€who€lived€across€the€street€from€Ms.€Smith,Ïhad€just€discovered€her€body€in€her€bedroom€(R.€1628).€€SheriffÏofficers€found€Ms.€Smithððs€body€in€a€crevice€(not€over€six€inchesÏwide€R.€1600)€between€the€bed€and€the€wall€of€her€bedroom.€€Ms.ÏSmith€had€twelve€stab€wounds€in€the€left€side€of€her€face€andÏneck€(R.€1739,€1816).€€The€stab€wounds€were€consistent€with€aÏpocket€knife€(R.€1822).€€Located€on€top€of€Ms.€Smithððs€exposedÏabdomen€was€a€candy€bar€(R.€1728).Ìà ×€€When€he€arrived€home€afterÐ 0 € Ðmidnight,€he€was€locked€out.€€He€walked€across€town€to€CharlesððsÏhouse€where€he€spent€the€night.׃60×Ý ƒ3ÿÿÝòòÚ  Ú25Ú  ÚóóÝ  Ý×  ×€€Charles€vouched€for€theÐ ð@  Ðaccuracy€Jodyððs€report,€confirming€his€arrival€sometime€aroundÏ1:00€a.m.Ô_Ԝ׃7ü×Ý ƒ3ÿÿÝòòÚ  Ú26Ú  ÚóóÝ  Ý×  ×›Ô_Ô€€A€couple€of€months€later,€Charles€had€a€conversationÐ ° Ðwith€his€estranged€wife,€Page,€who€was€dating€a€deputy€sheriff.€ÏCharles€indicated€to€his€estranged€wife€that€Jody€was€makingÐ pÀ Ðtrouble€for€him:€ð ðhe€had€a€lot€of€nerve€to€get€him€in€troubleÏwhen€Charles€said€he€had€enough€Ô_Ô¢shit£Ô_Ô€to€put€him€under€the€jail.ðð€ÏCharles€then€indicated€to€Page€that€Jody€had€confessed€the€murderÏof€Lima€Smith€to€him.€€However,€his€description€of€how€Jody€hadÏcommitted€the€murder€matched€newspaper€accounts,€not€the€evidenceÏfrom€the€scene.œ×ƒ8×Ý ƒ3ÿÿÝòòÚ  Ú27Ú  ÚóóÝ  Ý×  ×›€€Page€told€her€boyfriend,€a€deputy€sheriff.€Ð ` àThird,€a€police€officer,€Walter€Perkins,€who€was€involved€inÏthe€arrest€of€Mr.€Wright,€testified€that€Mr.€Wright€at€one€pointÏwas€alone€with€Officer€Perkins€and€said€to€him:€ð Ðhad€obtained€from€Jody€after€Ms.€Smithððs€death€and€which€theyÏbelieved€was€the€glass€money€jar€described€by€Charles€as€takenÏfrom€Ms.€Smithððs€home€(PC„¢R1£.€771„73).€€Mr.€Pearl€had€a€witnessÏavailable€to€identify€the€glass€jar€as€a€decanter€œthat›€was€aÏWright€family€œheirloom,€and›€œthe€witness›€possessed€the€matchingÏglasses€to€prove€it€(PC„¢R1£.€815„23).€€Mr.€Pearl€decided€toÏpresent€this€evidence€to€impeach€Charlesðð€claim€that€Jody€stole€aÏglass€jar€filled€with€change€from€Ms.€Smith.€€Mr.€Pearl€presentedÏthe€evidence€that€Jody€had€kept€money€in€this€glass€jar.€€He€thenÏforgot€to€present€the€testimony€establishing€that€the€jar€was€aÏdecanter€with€matching€glasses€that€had€been€in€the€Wright€familyÏÔ_Ôfor€years€(PC„¢R1£.€815„23).€€The€prosecutor€capitalized€on€Mr.Ð ` ÐPearlððs€error€in€his€closing,€arguing€that€the€glass€jar€was€theÏone€taken€from€Ms.€Smithððs€residence€at€the€time€of€the€homicideÏ(R.€2742).€€Ìà  àIn€the€defenseððs€case,€Jody€testified€in€his€own€behalf.€€AÏspectator€in€the€courtroom,€Kathy€Waters,€heard€Mr.€WrightððsÏdescription€of€his€movements€around€town€upon€discovering€that€heÏwas€locked€out€of€his€house.€€After€the€evidence€was€closed,€sheÏcontacted€defense€counsel€and€advised€him€that€she€Ô_ÔrememberedÏdriving€some€young€people€home€after€a€church€function€atÏapproximately€12:30€a.m.€on€February€6,€1983,€and€seeing€someoneÏwho€looked€like€Jody€walking€toward€the€Ô_Ô¢Westberry£Ô_Ôððs€trailer.€ÏJudge€Perry€refused€to€allow€the€defense€to€call€Ms.€Waters€as€aÏwitness€saying€it€would€rendered€the€sequestration€ruleÏmeaningless€if€a€witness€could€confer€with€others€and€thenÏprovide€testimony€which€seemed€almost€ð Ðcounsel]€with€any€statement€relating€to€the€investigation,ðð€heÏwas€simply€unsure€whether€he€had€the€statement€prior€to€Mr.ÏWrightððs€trial€(PC„¢R1£.€727).Ìà  àMr.€Dunning€also€testified€that€the€way€to€know€for€certainÏwhat€statements€had€been€provided€to€trial€counsel€was€to€inspectÏthe€signed€receipts.€€ð ðThe€only€was€I€would€have€of€knowing€wouldÏbe€to€go€back€to€the€receipts€that€would€be,€I€believe,€in€theÏState€Attorneyððs€file€that€were€signed€by€[trial€counselððsÏinvestigator]€and€determine€if€that€was€one€of€the€documentsÏfurnishedðð€(PC„¢R1£.€724).€€These€receipts€had€been€prepared€by€Mr.ÏDunning.€€ð ðI€made€sure€that€everything€that€the€receipt€said€wasÏthere€was€there.€€I€had€[trial€counselððs€investigator]€verifyÏthat,€and€I€had€him€sign€for€itðð€(PC„¢R1£.€œ730).׃5×Ý ƒ3ÿÿÝòòÚ  Ú31Ú  ÚóóÝ  Ý× ðscared€of€getting€into€trouble€for€[scrap€metal€business]ðð€(PC„¼¢R1£.€645).€€He€was€also€ð ðworried€that€if€[he]€got€in€trouble€¢Paige£Ïwould€get€in€troubleðð€(PC„¢R1£.€652).€€When€Mr.€Dunning€found€outÐ p&À!$ Ðabout€the€business€prior€to€Mr.€Wrightððs€trial,€Mr.€DunningÏquestioned€¢Westberry£€concerning€it.€€According€to€¢Westberry£,€Mr.ÏDunning€told€him€he€would€not€prosecute€him€over€the€scrap€metalÏbusiness,€but€he€never€guaranteed€¢Westberry£€that€he€would€not€beÏprosecuted€for€stealing€scrap€metal€and€selling€it€for€profit.€Ï¢Westberry£€was€scared€at€the€time€of€trial€and€at€the€time€of€theÏ1989€evidentiary€hearing€that€he€could€still€be€prosecuted€forÏhis€actions€(PC„¢R1£.€653).Ìà  àœThñ ñeñ ññ ñisñ ñ›€additional€œimmunityñ ñ,€which€Mr.€Dunning€ñ ññ! ñorally€ñ! ññ ñextendedÏñ ññ% ñapparently€ñ% ññ ñwithout€Mr.€Westberryððs€ñ ññ& ññ ñfull€ñ ññ& ññ ñunderstandingñ ññ" ñ,ñ" ñ›€was€œñ# ñgivenñ# ññ$ ñextendedñ$ ñ›€afterÏthe€formal€written€immunity€agreement€had€been€prepared€and€wasÏnot€reflected€in€it.€€Mr.€Pearl€testified€that€he€œð ðwas€neverÏinformed€by€the€State€of€any€communication€passing€from€WestberryÏto€the€State€or€back€concerning€the€theft€of€scrap€metals.ðð(PC„¼R1.€791).€€Further,€Mr€Pearl€was€ð ðnever€advised€that€[Westberry]Ïwas€„€„€that€any€prosecution€or€immunity€for€prosecution€wereÏbeing€discussed€with€him€concerning€that€event.ðð(PC„R1.€791).Ìà  àFurther,€Mr.€Pearl€was€not€advised€that€Mr.€Dunning€hadÏwritten€out€Mr.€Westberryððs€written€responses€to€questions€andÏprovided€them€to€Mr.€Westberry€(PC„R1.€830).€€Mr.€Pearl€did€notÏknow€that€such€statements€of€Mr.€Westberry€existed.Ìà  àMr.€Pearl€also€testified€that€he€had€had›€not€received€theÐ ,`'* Мstatements€from€Charlene€Luce,€Kim€Holt€and€Wanda€Brown€(PC„R1.Ï793„808).€€Mr.€Pearl€testified€that€these€statements€would›€haveÏprovided€him€with€œð ða›€truckload€of€œleadsð𛀜that›€he€would€haveÏpursued€and€œused€(PC„R1.€807).›Ìà  àMr.€Pearl€also€testified€to€what€he€described€as€a€seriousÏlapse€on€his€part€during€the€trial.€€He€œtestified€regarding€theÏevents€during€the€trial€leading€to€the€production€a€glassÏdecanter€by€Charlotte€Martinez׃7×Ý ƒ3ÿÿÝòòÚ  Ú32Ú  ÚóóÝ  Ý×  ×€which€she€provided€to€theÐ Ð  Ðprosecutor€as€possibly€the€jar€Charles€Westberry€claimed€Mr.ÏWright€stole€from€Ms.€Smith€(PC„R1.€816).€€Charlene€MartinezÏindicated€that€one€night€when€Jody€needed€money€he€ran€into€hisÏhouse€and€brought€out€the€decanter€filled€with€change.€€Ìà  àOnce,€this€decanter€surfaced€Mr.€Pearl€learned€that€it€inÏfact€was€a€Wright€family€heirloom.€€He€ð ðbrought€down€from€SouthÏCarolina€a€Mrs.€Wiggs€.€.€.€who€was€Jodyððs€[aunt],€who€identifiedÏthat€glass€jar€as€one€having€been€bought€by€her€together€with€aÏâ âgroup€of€matching€glasses€and€given€to€Jodyððs€mother,€which€wouldÐ °"  Ðhave€established€ownership€clearly.ðð€(PC„R1.€818).׃6×Ý ƒ3ÿÿÝòòÚ  Ú33Ú  ÚóóÝ  Ý×  ×€€In€fact,Ð ° Ðâ âMr.€Pearl€accompanied€Mrs.€Wiggs€to€the€Wright€residence€andÏobserved€the€matching€glasses€in€the€cupboard€where€Jodyððs€motherÏhad€kept€them€(PC„R1.€818).€€Based€upon€this,€the€prosecutorÏelected€not€to€present€Charlotte€Martinez€to€testify€about€theÏdecanter€she€had€provided€the€prosecution.€€Mr.€Pearl€thenÏdecided€to€call€her€to€present€the€fact€that€Jody€had€access€toÏmoney€in€his€own€house€if€he€needed€it€and€that€he€acquired€noÏunexplained€infusion€of€cash€(PC„R1.€819).€€However€afterÏpresenting€Ms.€Martinezððs€testimony,€Mr.€Pearl€failed›€to€call€Mr.ÏWrightððs€aunt€to€identify€the€glass€decanter€and€œthe›€matchingÏœglasses.€€Regarding€this€failure€Mr.€Pearl€testified:ÌÒ` °ÒÓÓI€failed€to€prove,€and€I€had€the€proof€in€my€hand,€thatÏthat€jar€was€in€fact€the€property€of€Jodyððs€mother.€€IÏfailed€to€do€it.€€It€was€a€lapse,€a€mistake.€€I€just€ð"ðÏI€canððt€explain€it€to€you.€€It€is€as€if€it€passed€outÏof€my€mind,€perhaps€due€to€the€pressure€of€otherÏmatters€during€the€trial.€€But€I€cannot€explain€it.€€ItÏwas€inferior€performance.ÌÌà ¸ àMr.€Dunning€brilliantly€took€advantage€of€thatÏladse€in€closing€arguments€to€argue€to€the€jury€thatÏthat€could€have€been,€or€must€have€been€the€jar€thatÏCharles€Westberry€had€been€talking€about.€€And,Ïtherefore,€I€feel€very€badly€about€it.€€I€feel€veryÏmuch€at€fault€about€it.€€It€was€a€sorry€performance€onÏmy€part.Ð XXXn+Zp#ÔÔ‡Xn+XXXL Ôð ðAnd€of€course€both€of€them€had€agreed€to€take€a€polygraph€withÐ ð@  Ðno,€no€problem€with€that.€€And€they€ran€very€clean€on€theÏpolygraph€that€neither€of€them€was€involved€with€the€Lima€PaigeÏSmith€murder.ðð)(PC„R1.€964)Ô#†XL XXXn+̨#ÔÔ‡Xn+XXXL Ô.Ô_ԛ׃M×Ý ƒ3ÿÿÝòòÚ  Ú34Ú )«ÒÓ7«ÓÔ_Ô(PC„R1.€1071).€€Captain€Miller€claimed€to€recall€that€there€wasÏan€interview€of€someone€from€whom€ð ðJackson€said€he€got€moneyÐ $à" Ð[for]€cutting€down€a€treeðð€(PC„R1.€1071).€€Captain€Miller€alsoÏbelieved€that€he€had€found€someone€who€said€ð ðMr.€Jackson€wasÏretained€to€cut€down€a€tree,€and€the€scratches€he€received€as€aÏresult€of€the€treeðð€(PC„R1.€1067).€€When€confronted€withÏJacksonððs€own€statement€indicating€that€scratches€came€from€aÏfight€the€night€of€Sunday,€February€6th,€Captain€Miller€retorted:ÌÒ` °ÒÓÓà ¸ àA€€Weððre€talking€about€five€years€of€recollection.€ÏI€havenððt€refreshed€my€memory€with€these€documents.€ÏThat€is,€as€I€recall,€that€I€remember€the€scratches,Ïand€I€thought€he€had€gotten€it€from€the€tree.€€I€standÏcorrected.ÌÌÒ°` f®ÒÓt®Ó(PC„R1.€1068).€€Captain€Miller€also€acknowledged€that€he€couldÏnot€find€a€statement€ð ðfrom€the€individual€that€had€retainedÏJackson€to€cut€down€the€treeðð€(PC„R1.€1070).׃(×Ý ƒ3ÿÿÝòòÚ  Ú35Ú  ÚóóÝ  Ý×  ×€€Captain€MillerÐ P  Ðstated€that€he,€himself,€conducted€none€of€ð ðthe€interviews€withÏregard€to€Mr.€Jackson€and€Mr.€Stricklandðð€(PC„R1.€1066).€€Thus,Ïhe€was€forced€to€rely€entirely€upon€the€reports€of€others:ÌÒ` °ÒÓÓà ¸ àQ€€So€youððre€relying€on€what€other€people€told€youÏwhen€youððre€saying€they€were€dead„ends?ÌÌà ¸ àA€€They€take€the€results€of€their€investigationÏand€bring€it€to€me,€and€indicate€their€opinion.€€And€IÏeither€concur,€or€I€direct€them€to€go€out€and€do€someÏmore.€€In€this€issue€I€concurred.ÌÐ `'°"% ÐÒ°` ˆ±ÒÓ–±Ó(PC„R1.€1066).Ìà  àDeputy€Stout€was€also€called€at€the€1988€evidentiaryÏhearing.€€During€his€testimony€the€following€was€elicited:ÌÒ` °ÒÓÓà ¸ àQ€€Okay.€€In€that€connection,€what€you€found€atÏthe€house,€was€there€anything€to€indicate€one€way€orÏanother€whether€it€was€one€or€two€people€who€had€doneÏthe€crime?ÌÌà ¸ àA€€I€really€donððt€have€an€opinion€one€way€or€theÏother.ÌÌà ¸ àQ€€Okay.€€So€itððs€basically€just€a€void€ofÏevidence;€thereððs€no€evidence€one€way€or€another€toÏindicate€whether€itððs€one,€two,€or€more?ÌÌà ¸ ÐHarvey€Wasserman,€a€supervisor€of€investigation€at€the€DadeÏCounty€State€Attorneyððs€Office.€€Mr.€Wasserman€testified€to€hisÏreading€of€computer€generated€printouts€that€were€produced€inÏ1996€of€Rhonda€Hainesðð€criminal€history.€€He€indicated€that€theÏrecords€he€had€obtained€reflected€that€ð ðin€1985,€1984,€1985,€sheÏhad€two€pending€prostitution„related€cases€in€¢Broward£€County.ðð€Ï(PC„¢R3£.€643).€€According€to€Mr.€Wasserman,€these€two€charges€wereÏnot€disposed€of€until€1988.€€(PC„¢R3£.€640„43).€€He€was€unable€toÏfind€documentation€of€the€eleven€outstanding€charges€that€Ms.ÏHaines€testified€at€trial€were€pending€in€¢Broward£€County€at€thatÏtime.€€(PC„¢R3£.€642)(ð ðQ.€€Okay.€So,€were€there€any€other€casesÏthat€she€had€from€¢Broward£€County€according€to€the€records€thatÏyou€reviewed?€€A.€€No,€sir,€not€from€anything€that€we€have.ðð).€ÏSo€as€of€July€of€1997,€the€State€conceded€the€eleven€charges€ofÏprostitution€against€Rhonda€Haines€were€untraceable.€€Ìà  àYet,€the€trial€prosecutor€¢ackowledged£€that€at€the€time€ofÏtrial€the€eleven€charges€in€fact€existed€and€were€problematic.€ÏWilliam€Howell,€co„counsel€at€trial€for€the€State€and€co„counselÏin€the€3.850€proceedings,€was€called€by€Mr.€Roberts€in€rebuttalÏto€establish€whether€at€the€time€of€trial€Ms.€Haines€had€elevenÐ ñÔ‡0X­nXXXXòÔñ ñà  àIn€the€Stateððs€closing€argument€at€trial,€Rhonda€Haines€wasÐ `'°"% ðbest€friend.ðð€€OnÏeach€of€these€points,€Burnsððs€testimony€would€have€beenÏconsistent€with€the€withheld€evidence:€€that€Beanie€hadÏspoken€of€Burns€to€the€police€as€his€ð ÐRule€3.850€proceedings€because€of€the€cumulative€effects€of€òòBradyóóÐ  ð
