MOTION TO EXCEED PAGE LIMIT OF 50 PAGES

FOR PETITIONS FOR WRIT OF HABEAS CORPUS

UNDER FLA.R.APP.P. 9.100(g)

Petitioner, LINROY BOTTOSON, through counsel, respectfully

moves this Court for the entry of an Order granting Petitioner's

request to exceed the number of pages prescribed for Petitions for

Writ of Habeas Corpus under Fla.R.App.P. 9.100(g). In support of

this motion, Petitioner states:

1. Petitioner is a prisoner presently under a sentence of

death in Florida.

2. Petitioner filed a Writ of Habeas Corpus pursuant to Art.

V § 3 and Fla.R.Crim.P. 3.851 on January 11, 2002.

3. The procedural and other legal aspects of capital habeas

litigation are complex in nature.

4. A page limitation in excess of that prescribed under

Fla.R.App.P. 9.100(g) would allow Petitioner to more adequately

support his claim of entitlement to relief.

5. Petitioner’s case is new to Members of this Court. For

the benefit of the Court, although not required by Rule 9.100,

Petitioner includes in his Petition a statement of the case

relating the facts as found by this Court on direct appeal.

WHEREFORE, Petitioner respectfully requests that this Court

grant the Motion to Exceed Page Limit of 50 Pages for Petitions for

Writ of Habeas Corpus under Fla.R.App.P. 9.100(g).
